Sub: Retrospective implementation of the
pay scale revision of the Superintendents of Central Excise at par with
Superintendents of Narcotics Control Bureau.
Madam,
Kindly refer to earlier communications of the Association
on above matter.
2. It
is submitted with due regards that the pay scale of the Superintendents of
Narcotics Control Bureau was revised to Rs. 7500-12000/- from Rs. 6500-10500/- w.e.f. 01.01.96 with all consequential
benefits vide U.O. No. 169/1/2005-IC dt. 11.04.05 of the Department of
Expenditure leading to the issuance of Order F. No. II/2(38)/2004-Estt. dt.
20.04.05 by the Narcotics Control Bureau whereas the pay scale of the
Superintendents of Central Excise was revised to Rs. 7500-12000/- from Rs.
6500-10500/- prospectively w.e.f. 21.04.04, i.e., from the date of issuance of
the order vide O.M. No. 6/37/98-IC dt. 21.04.04.
3. It is very well worth to mention that the
Superintendents of Narcotics Control Bureau were granted the retrospective
benefit despite of the fact that their pay
scales were revised even after the revision of pay scales of Superintendents of
Central Excise based on the parity and precedent of Central Excise
Superintendents. The Association has been continuously raising the demand
for implementing the revised pay scale with retrospective effect instead of
21.04.2004 since very beginning but nothing has been done till date. It is further mentioned that the Superintendents in Narcotics Control Bureau were also granted the non-functional time
scale on completion of 4 years of service based on the parity and precedent of
the Superintendents of Central Excise.

There exists an established parity and relativity between the Superintendents
of NCB (Narcotics Control Bureau) and Superintendents of Central Excise as the
nature of duties, mode of recruitment, functions and responsibilities of these
posts are the same. The Superintendents of Central Excise are also working as
Superintendents in NCB since the creation of NCB. NCB was also a part of CBEC
under the Department of Revenue and remained its part till 18.02.03. The
Superintendents of NCB were sharing common seniority with the Superintendents
of Central Excise for promotion to the Group ‘A’ till 18.02.03. The
Allocation of Business Rules, 1961 were amended vide Notification No.
I/22/1/2003-CAB dt. 18.02.03 [S.O. 193(E)] to include the NCB in the Ministry
of Home Affairs. Even after that, NCB is being monitored by the CBEC/Department
of Revenue and the Superintendents of Central Excise are till now performing
their duties as Superintendents of NCB.

The mode of recruitment of the Inspectors in CBEC and Intelligence Officers in
NCB is also common. The posts of Superintendents in CBEC and NCB are also
filled-up through promotion from the Inspectors/Intelligence Officers. The High
Power Committee formed by the then Finance Minister also accepted that the
Superintendents of Central Excise and the Superintendents of NCB are at par.
Further, the Sixth Pay Commission had categorically observed vide Para 7.15.20
of its report that the duties & responsibilities attached to these posts
whether in Central Excise or in the Narcotics Control Bureau are similar.

Thus, the non-grant of retrospective revision of pay scale to the Central
Excise Superintendents is not justified as the grave anomaly has arisen on
account of the different dates of revision prescribed by the Department of
Expenditure for different categories of employees. If the pay scale of the
Superintendents of NCB was revised w.e.f. 01.01.96 by the Department of
Expenditure, the prospective revision of pay scale from 21.04.04 for the
Superintendents of Central Excise is gross injustice to them.

In view of the above, it is very much requested to give the retrospective
effect to the enhanced pay scale of the Central Excise Superintendents at par
with the Superintendents of NCB.

the submissions made to your goodself in person during the meeting of 17.01.17
and 10.02.17.

As you already know, it is submitted with due regards that the most of our
officers are forced to retire with single promotion in the career of 35-40 years
after joining as Inspector despite of being instrumental in collecting govt. revenue
always above the targets in comparison to 5-6 promotions being enjoyed by other
counterparts. No need to say that other intra (CBDT in same department of
Revenue) and inter (CSS also working in CBEC itself) departmental counterparts
of these officers are already getting the promotions to the level of Addl.
Commissioner/Director and many of them are also reaching the level of
Commissioner/Joint Secretary.

The Association is very much thankful to you being very considerate to the
cause of these poor officers. You were
pleased to say in the meeting that our officers should get at least 3
promotions. As far as the promotional hierarchy is concerned, it is varying
department to department in the Govt. of India as under-
a) Somewhere promotional hierarchy is Level-7àLevel-11àLevel-13
(CPWD etc.).
b) Somewhere promotional hierarchy is Level-7àLevel-8àLevel-11àLevel-12àLevel-13
(CSS, Railway Board, CSSS, AFHQ, CVC, UPSC, MEA, MPA, NCB, Rajya Sabha
Secretariat etc.).
c) Somewhere promotional hierarchy is Level-8àLevel-10àLevel-11àLevel-12àLevel-13
(CBI, IB, etc.).
d) Somewhere promotional hierarchy is Level-7àLevel-8àLevel-10àLevel11àLevel-12àLevel-13
(CBEC, CBDT etc.).
e) Somewhere promotional hierarchy is Level-7àLevel-9àLevel-10àLevel11àLevel-12àLevel-13
(Department of Posts etc.).
f) Somewhere promotional hierarchy is Level-7àLevel-10àLevel11àLevel-12àLevel-13
(Hindi Departments etc.)
4. It is further submitted that the posts under Level-10 & Level-11 and also Level-12 & Level-13 are
functionally the same. Thus, our officers should be granted at least 3
promotions in the promotional hierarchy of Level-7àLevel-8àLevel-11àLevel-13
and so on. Officer may kindly be promoted, functionally or non-functionally,
after the completion of residency period as prescribed by DOPT vide OM No. AB.
14017/61/2008-Estt. (RR) Dt. 24.03.09. It is 7 years for Level-7 to Level-11
and 10 years for Level-11 to Level-13 and further 3 years for Level-13 to Level-14
and so on.

Not only it, the promotional hierarchy for group B officers is required to be
made same across all the Departments/Ministries of the govt. of India. The CBEC has already recommended to Revenue
Hqrs for the uniform promotional hierarchy across all the
Departments/Ministries vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16.
6. If functional promotions are not possible to be
given for the time being on account of sufficient number posts not being existed,
immediate steps may kindly be taken to grant in-situ promotions after
completion of standard residency period/s prescribed by the DOPT. No need to
say that no functional post is required to grant in-situ promotions as the
concerned officer works only on the post held by him/her before the promotion. The
officer is only given the designation and scale of higher post under in-situ
promotion. This will also remove the intra as well as inter cadre disparities. Precedent
of such promotions already exists in CSS and also in other departments in the
form of schemes like FCS (Flexible Complementary Scheme) and DACP (Dynamic
Assured Career Progression). Side by side, NFU (Non-functional Financial
Upgradation) may also kindly be granted to our officers on batch to batch basis
to compensate them the financial loss in comparison of the best placed
counterparts. This NFU was also
recommended for our officers by the CBEC to the Revenue Hqrs vide OM F.
No.A-26017/154//2015-Ad.IIA Dt. 22.02.16. Not only NFU or uniform
promotional hierarchy but also other recommendations made by the CBEC vide
above OM are very much required to be accepted by the competent authority to
resolve our HR issues to give a bit consolation to our officers. No need to
submit that you were also pleased to say
in the meeting that our HR issues would be resolved.
7.
In view of the above, it is requested-
i)
To grant at least 3 promotions to our officers in the promotional hierarchy of Level-7àLevel-8àLevel-11àLevel-13 and so on making promotional hierarchy for group
B officers ‘uniform’ across all Departments/Ministries of Govt. of India.
ii)
To grant NFU to our officers on batch to batch basis to compensate them
financially in comparison to the best placed counterparts.
iii)
To accept the recommendations made by the CBEC vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16.
