Sub: Promotional avenues of Central Excise
Superintendents.

It is submitted
with due regards that the most of our officers are forced to retire with single
promotion in the career of 35-40 years after joining as Inspector despite of being
instrumental in collecting govt. revenue always above the targets in comparison
to 5-6 promotions being enjoyed by other counterparts. No need to say that
other intra (Examiners of Customs in the same organization of CBEC and Income
Tax Inspectors in CBDT under the same department of Revenue) and inter (CSS
also working in CBEC itself) departmental counterparts of these officers are
already getting the promotions to the level of Addl. Commissioner/Director and
many of them are also reaching the level of Commissioner/Joint Secretary. The
Examiner of 1984 has already become Addl. Commissioner (already 5 promotions)
years ago with fair chances to become Commissioner whereas the Central Excise
Inspector of 1984 is yet to become Asstt. Commissioner (the rarest IInd
promotion) despite of both belonging to same cadre of Inspector under the same
organization of CBEC with same administrative hierarchy in same Department of
Revenue under same Ministry of Finance and also recruited through same process
under common examination. We have nothing against any counterpart and wish them
to get more promotions but our request is to bring us also at par with
them.

As far as the promotional hierarchy is concerned, it is varying department to
department in the Govt. of India as under-
a) Somewhere promotional hierarchy is Level-7àLevel-11àLevel-13
(CPWD etc.).
b) Somewhere promotional hierarchy is Level-7àLevel-8àLevel-11àLevel-12àLevel-13
(CSS, Railway Board, CSSS, AFHQ, CVC, UPSC, MEA, MPA, NCB, Rajya Sabha
Secretariat etc.).
c) Somewhere promotional hierarchy is Level-8àLevel-10àLevel-11àLevel-12àLevel-13
(CBI, IB, etc.).
d) Somewhere promotional hierarchy is Level-7àLevel-8àLevel-10àLevel11àLevel-12àLevel-13
(CBEC, CBDT etc.).
e) Somewhere promotional hierarchy is Level-7àLevel-9àLevel-10àLevel11àLevel-12àLevel-13
(Department of Posts etc.).
f) Somewhere promotional hierarchy is Level-7àLevel-10àLevel11àLevel-12àLevel-13
(Hindi Departments etc.)
3. It is further submitted that the posts under Level-10 & Level-11 and also Level-12 & Level-13
are functionally the same. In view of para 2 above, the promotional hierarchy for group B officers is
required to be made same across all the Departments/Ministries of the govt. of
India and our officers
may kindly be promoted, functionally or non-functionally, after the completion
of residency period as prescribed by DOPT vide OM No. AB. 14017/61/2008-Estt.
(RR) Dt. 24.03.09. It is 7 years for Level-7 to Level-11 and 10 years for
Level-11 to Level-13 and further 3 years for Level-13 to Level-14 and so on. The CBEC has
already recommended to Revenue Hqrs for the uniform promotional hierarchy
across all the Departments/Ministries vide OM F. No.A-26017/154//2015-Ad.IIA
Dt. 22.02.16.
4. If functional promotions are not possible to be
given for the time being on account of sufficient number posts not being
existed, immediate steps may kindly be taken to grant in-situ promotions after
completion of standard residency period/s prescribed by the DOPT. No need to
say that no functional post is required to grant in-situ promotions as the
concerned officer works only on the post held by him/her before the promotion.
The officer is only given the designation and scale of higher post under
in-situ promotions. This will also remove the intra as well as inter cadre
disparities in CBEC. Precedent of such promotions already exists in CSS and
also in other departments in the form of schemes like FCS (Flexible
Complementary Scheme) and DACP (Dynamic Assured Career Progression). Side by
side, NFU (Non-functional Financial Upgradation) may also kindly be granted to
our officers on batch to batch basis to compensate them against the financial
loss in comparison of the best placed counterparts. This NFU was also recommended for our officers by the CBEC to the Revenue
Hqrs vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16. Not only NFU or
uniform promotional hierarchy but also other recommendations made by the CBEC
vide above OM are very much required to be accepted by the competent authority
to resolve our HR issues to give a bit consolation to our officers. Other
recommended issues vide OM F.
No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 of CBEC also include initial pay
scale of Rs. 5400 in PB3 (Level-10) for Central Excise Superintendent, promotion of Central Excise Superintendent
to STS post like the most of other
counterparts in Central as well as State governments, merger of grade pay of Rs. 5400 in PB2 & PB3 (Level-9 & 10) etc. Thus, all of
the issues recommended by the CBEC to Revenue Hqrs vide OM F. No.A-26017/154//2015-Ad.IIA
Dt. 22.02.16 may kindly be taken care of.

It is also worth to submit that cadre restructuring happened in CBEC in the
year 2013 but nothing was done for Central Excise Superintendents in it except
creating 2118 posts at JTS level of Asstt. Commissioner merely for 5 years
without any right for the further promotion. Further these posts were to be
distributed between Central Excise and Customs in the ratio of 13:3.
Accordingly considering the acute stagnation of Central Excise group B
executive officers, the Cabinet also
approved to bring a scheme to remove the stagnation of executive group B
officers in CBEC independent of cadre restructuring. But very unfortunately
the said scheme is still awaited even after 3½ years of its approval by the
Cabinet. The CBEC also recommended to Revenue Hqrs vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 to examine the
issue of the stagnation and further promotions of our officers in relation of
the point to allow minimum of five functional promotions after joining the post
of Inspector but any concrete result is still awaited.

In view of the above, it is requested-
i) To grant an initial pay scale of
Level-10 (GP of 5400 in PB3) to Central Excise Superintendent as recommended
vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 of CBEC.
ii) To grant at least 5
functional promotions to our officers after joining as Inspector as recommended
vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 of CBEC and ensure parity
in promotions with better placed counterparts considering particularly that the
Cabinet also approved to bring a scheme to remove the stagnation of executive
group B officers in CBEC independent of cadre restructuring.
iii) To grant NFU to our officers
on batch to batch basis to compensate them financially in comparison to the
best placed counterparts as recommended vide OM F. No.A-26017/154//2015-Ad.IIA
Dt. 22.02.16 of CBEC.
iv) To grant next promotion to
STS post to Central Excise Superintendent as recommended vide OM F. No.A-26017/154//2015-Ad.IIA
Dt. 22.02.16 of CBEC.
v) To merge Level-9 and Level-10
as recommended vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 of CBEC.
vi) To make uniform promotional
hierarchy for group B officers across all Departments/Ministries in Govt. of
India as recommended vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 of
CBEC.
