The CBEC first time in the history
has recommended our issues to revenue Head Quarters after the issuance of 7th
CPC report for consideration by Empowered Committee. These issues include initial pay scale at
par with DSP of CBI, i.e., initial pay scale in the G.P. of 5400/- in PB-3
(Level – 10) for Superintendents, next promotion to STS (Deputy Commissioner)
as group B gazetted officers in Central as well as state governments are being
granted promotion to STS at the most of the places, batch to batch NFU at par
with CSS to compensate financial loss on the lines of Group A because we are
not getting functional promotions equal to our counterparts, uniform promotion
hierarchy for Group B officers across all departments/ministry of Govt. of
India as promotional hierarchy differs department to department for group B
officers in the Govt., minimum 5 functional promotions, department specific
flexible/dynamic promotions scheme like Scientists/Doctors, merger of GP of
5400/- in PB-2 & PB-3 (Level-9 & Level-10) etc.
Initial GP of 5400/- in PB-2 as recommended by 6th CPC
under para 7.15.24 granting parity with Chief Enforcement Officer was approved
by competent authority of Expenditure for our Superintendent but the lower rank
officer of the level of Under Secretary said to recommend the same to 7th
CPC. The issue was not forwarded to the 7th CPC by the CBEC because
the issue was already settled by the 6th CPC and instead of it, CBEC
forwarded our representation to the 7th CPC in which we sought the
initial scale for our Superintendent cadre at par with DSP of CBI, i.e., Rs.
5400/- in PB-3. It is surprising that the said US asked to forward the issue
again to 7th CPC which was already recommended by the 6th
CPC.
The issue of arrears at par with the Supdt. of NCB is also being pursued
and already got recommended to the Expenditure by CBEC as well as IFU. The
Superintendent (NCB) were granted higher pay scale of Rs. 7500-12000 at par
with us based on our precedence on 20.04.2005 retrospectively with arrears w.e.f. 01.01.1996,
whereas we were granted this scale before them on 21.04.2004 with prospective
effect. It is clarified that the Supdts. of NCB were part and parcel of our RRs
and seniority list being promoted to the same post of Asstt. Commr. since they
were under CBEC from very beginning and were sent under control of Home
Ministry in 2003 only. This case is also being pursued legally in the Principal
Bench of CAT. Supdts. of NCB were also granted Time Scale after 4 years of
service based on our precedence.
One case is being pursued legally for general implementation of
Chandrashekaran case in the Principal Bench of CAT to grant GP of Rs. 6600/- under MACP upgradation on completion of 30 years of
service to those Superintendents who got time scale after 4 years of service prior to 01.09.08 in GP of
Rs. 5400/- in PB2. Sh. Chandrasekran has also filed contempt in High Court
Chennai and a case also in Chennai CAT against withdrawal of the benefit of GP
of Rs. 6600/- granted to him on completion of 30 years of service.
A case is already on final stage in Principal Bench of CAT seeking a GP of
Rs. 7600/- in PB-3 after 30 years of service with full justification under MACP
upgradation. The offsetting of time scale with MACP upgradation and para 8.1 of
MACPS have been challenged in this case due to which we are unable to get due
benefit under MACPS.
A case is also on final stage in Principal Bench of CAT seeking a Time
Scale in PB-3 instead of PB-2 after 4 yrs of service for our Supdts. as the
group B gazetted officers have been granted this time scale in PB3 at the most
of the places.
One case is being pursued legally for general implementation of
Subramanium case in Principal Bench of CAT in which Sh. Subramanium belonging
to Inspector cadre has been granted the benefit of time scale after completing
4 years of service after getting Ist ACP upgradation.
A case seeking
pay scale at par with DSP of CBI with arrears since 01.01.1986 for our Supdts.
is also on final hearing in Cuttak CAT.
Two cases, one in Cuttak CAT and another in Jabalpur High Court,
are on final hearing seeking arrears at par with CBI Insprs. since 01.01.1986
for C.Ex. Insprs. These both cases will benefit our Supdt. cadre as all the
C.Ex. Insprs. of that period have already become Supdts. Jabalpur High Court case is being looked after by the General secretary of our Nagpur Unit and the then Secretary General of Inspectors Association, Sh. K. V. Sriniwas alongwith Sh. K. P. Rai from Bhopal, our retired Superintendent and then individual applicant as Inspector in this case. Cuttack CAT cases are being looked after by our Cuttack Unit.
One case
regarding RR’s seeking parity with intra-organisational counterparts has already been won in Delhi
CAT in which Govt. has been given times of four months to finalize new rules.
A case has also been won in Allahabad High Court regarding Allahabad CAT case in which CAT had
directed to give extra 58 posts of AC to Appraiser stream from Central Excise quota
in regularization matter. CAT also observed that 125 posts of AC were also
given less to Customs Superintendent stream in comparison of Central Excise
Superintendents. Had these posts were given to them from Central Excise quota,
we were at loss of posts in thousands during regularization on account of
cascading effect of sharing huge number of posts with Customs from our quota as
our officers enter into group A at fag end of the career.
A committee was
formed in PMO regarding our stagnation under the Chairmanship of Sh. P. K.
Mishra, Addl. Principal Secretary to PM. The issues like pay scale, minimum 5
functional promotions, NFU at par with CSS counterparts, direct promotion to STS, merger of Level 9 &
10, uniform promotional hierarchy for group B officers across all
departments/ministries etc. are being taken up with the committee.
One more
committee was formed within CBEC under the Chairmanship of Sh. Balesh Kumar,
ADG, HRM, HRD. Issues like continuance of
temporary posts of AC, earmarking of share of promotee officers upto the level of
Commissioner, no direct recruitment for a certain period in IRS & minimum
direct recruitment of IRS every year by filling up remaining vacancies by promotion,
merger of three executive streams at group B non gazetted as well as gazetted
level and formulation of all India seniority list accordingly at Inspector
level, benefit of past service at the time of entry into group A, scheme like
NFU to benefit past as well as new generation etc. are being taken up with this
committee.
DPCs for the post of AC for the years 2016-17 & 2017-18 is also being
pursued which are at halt due to some legal verdict given by Madras High Court
on Parmar issue.
