INDIA CONVENTION & GENERAL BODY MEETING OF THE ALL INDIA ASSOCIATION OF
CENTRAL EXCISE GAZETTED EXECUTIVE OFFICERS HELD ON 27TH AND 28TH
MAY, 2017 AT GANDHIDHAM, GUJRAT

The
12th Convention and Annual General Body Meeting of AIACEGEO was held
at Gandhidham (Gujrat) hosted jointly by the Associate Units of Kandla and Kutch.
n PROCEEDINGS OF 27TH
MAY, 2017 –
The convention was
formally inaugurated by Shri J. A. Khan, IRS, Commissioner of Central Excise
Commissionerate, Ahmedabad-II. The retired veteran leaders of the AIACEGEO,
Shri S. P. Siddhanta, Shri S. K. Pareek and Shri Lokanath Mishra also graced the
occasion by their presence. The Chief Guest and veteran leaders addressed the
gathering and impressed upon the need of unity in the cadre. The Secretary
General, Shri Ravi Malik, also addressed the gathering and informed about
various service matters that had been taken up by the Association and also appraised
about the status of various court cases pertaining to service matters pending
in various courts/CATs throughout India.
Right after the inaugural
ceremony, the proceedings of the meeting started. In absence of the President,
Shri R. Chandramouli, the senior-most Vice President, Shri Ravi Joshi, presided
the meeting.
The Secretary General, at
the outset, congratulated all the members who had been promoted to the grade of
Assistant Commissioner in the DPC of February, 2017. Secretary General informed
that efforts were on to get the DPC for the subsequent vacancy years and the
Board is being pursued by the AIB for the same. Around 20 newly promoted Assistant Commissioners also attended the meeting
being the part & parcel as well as members of the AIACEGEO as decided in
Jaipur and Daman conventions.
Subsequently, the Convention
began as per agenda points. The Minutes of AEC meetings, which had already been
circulated via e-mail, were placed before the house for ratification.
Similarly, the Minutes of Associate Committee meetings were also placed for
passing by the house. Both the minutes were passed by the house without any
modification. Then the Secretary General requested the Treasurer, Shri N. R. Manda,
to present the statement of accounts and audit report for confirmation by the
house. Shri Manda presented the statement of accounts & audit report. He requested
all associate units to clear their respective dues at the earliest alongwith
submitting the DDO certificates. The details regarding pending dues were
provided to all the delegates. The Secretary General also requested all the
Units to clear the pending dues and provide DDO certificates to the AIB at the
earliest for the year 2016-17 and also 2017-18. The Hou se passed the statement
of accounts and audit report unanimously.
Subsequently, the
Secretary General requested all the delegates to introduce themselves. He also requested Sh. Ashutosh Nivsarkar from
Indore and Sh. Pavan Reddy from Hyderabad to draw minutes of the meeting in
addition to Sh. C. S. Sharma, Office Secretary. During the
process of introduction, Shri Reji Mathew from Vadodara Unit raised an issue
regarding confirmation of the minutes of Daman Convention placed before the
house. He mentioned that it was decided
during Daman Convention that the promotee ACs would be members of the AIACEGEO
but they would not be entitled to contest as office bearers of the AIB. Shri
Reji Mathew said that this rider was missing in the Minutes of the Daman
Convention and the same should be added before passing. Shri L. L. Singhvi from
Indore Unit seconded the argument of Shri Reji Mathew and stated that it was
decided in Daman Convention that promotee IRS officers would be members of
AIACEGEO but they would not hold any post in AIB. Shri Jitendra Singh from
Ahmedabad, who happened to be a member of the Committee which drafted the
amendment to the Constitution, mentioned that there was no such rider proposed
by the Committee about disentitling any member from contesting the elections. He emphasized that every member including
promote ACs is very well entitled to contest the elections of AIACEGEO.
Further during the
discussions, Shri Shrinath Gopalan from Bangalore also mentioned that minutes
of Daman Convention need to be revised to include the rider which was discussed
in Daman that promotee IRS officers would not be entitled to contest the elections
of AIB. Shri S. K. Sharma from Bhopal was in favour of promotee IRS officers
for contesting the elections of AIACEGEO saying that no such decision was taken
in Daman Convention to debar them from contesting the elections. The General Secretary of Cochin Unit stated
that he was not present in Daman convention, so can’t comment on the issue.
Delegates from Bhubaneswar also mentioned that they were not present in Daman,
hence cannot comment upon the proceedings that took place at Daman but Sh.
Lakanath Mishra, the then President of AIACEGEO from Bhubaneshwar Unit who
presided the Daman convention, can confirm the things. Delegates from Daman,
Delhi, Guntur and Hyderabad opined in favor of promotee ACs contesting
elections of AIACEGEO. Sh. C. S. Sharma said that grant of dual membership is
meaningless. It is clear insult to the concerned members to give membership
with any rider. Shri Raina representing Jaipur Unit vehemently opposed the
proposal of ACs becoming office bearers of AIB, though he mentioned that he was
not present in Daman Convention, so he cannot comment upon the proceedings.
Delegate from Kandla Unit stated that
he did not remember what transpired at Daman but he was in favor of ACs
contesting for office bearers of AIACEGEO. Shri Ashish Bajpeyi from Kanpur Unit
and Sh. R. K. Solanki from Meerut were also in favor of promotee ACs for
contesting for elections of AIB saying that no such decision was taken in Daman
against promotee ACs.
Delegate from Kolkata
said that there is no use of giving half-hearted membership to promotee ACs, if
they are not allowed to be office bearers. Once they have been
given membership, they are very well authorized to contest for elections too.
He further added that no decision to debar them from contesting for elections
was taken in Daman. Delegate from Lucknow Unit mentioned that such a rider was
definitely discussed by someone in Daman but no final decision was arrived at.
He further opined that there should be no bar on ACs contesting for elections
of AIB. Delegate from Meerut forcefully mentioned that once a member, ACs can’t
be prevented to contest for the elections. Shri A. K. Sasmal stated that there
cannot be dual membership for promotee ACs. He emphasized that AIACEGEO should
be by the Superintendents, of the Superintendents and for the Superintendents. He
was against the membership of ACs in the AIACEGEO. Delegate from
Bihar/Jharkhand/Patna/Jamshedpur mentioned that he was not there in Daman but
the decision can be taken in this General Body Meeting on this issue. Shri
Anand Kishore from Raipur Unit opined that once the ACs have been made member,
there is no reason to debar them from contesting for the elections and they are
very well entitled to contest for elections. He also added that no decision to
debar the promotee group A officers from contesting the elections of the
Association was taken in Daman. Delegate from Rajkot stated that he was not
present in Daman Convention but he maintained that whatever is written in the
Constitution of AIACEGEO, should prevail. If membership has been given, the
promote ACs are entitled to contest the elections. Delegate from Surat Unit opined that there cannot be dual
membership. Once someone is inducted as member, he is entitled to
contest the elections. The delegates from Vizag, Kutch and Agra also said that
the promotee ACs are entitled to contest the elections being the member of
AIACEGEO. Delegate from Tirupati said that he was not present in Daman
Convention but promotee ACs are entitled to contest the elections, once made
members of AIACEGEO. Representative from Nellore Unit said that in his view
though ACs can contest but Superintendent should lead the AIACEGEO in the
interest of cadre and ACs should be inducted as advisors. He also said that he
was not present in Daman. Sh. Pavan Reddy opined that as per amended
constitution, the promotee ACs are members of AIACEGEO and they can contest the
elections. Sh Apurba from
Kolkatta said that all promotee officers are their members and they can contest
for any post in AIB as per the resolution.
The
views of former Presidents, Sh. Sushil Pareek and Sh. Lakanath Mishra, were
also asked for confirmation as both were present in Daman Convention. The Daman
Convention was also presided by Sh. Mishra.
Sh.
Mishra said that no such decision that promotee group A officers would not be
eligible to contest the elections was taken in Daman nor any such thing was
recommended by the concerned committee.
Sh.
Pareek said that the issue was raised by somebody in Daman but no such decision
was taken that promotee ACs/promotee group ‘A’ officers would not be entitled
to contest the elections. He said that no member can be given second grade
treatment on the issue of the contesting the elections. He added that no member
should be insulted by giving the membership with a rider.
Sh.
Sanjay Srivastva from Lakhnow raised the point that as per his knowledge
another convention is also scheduled in Chennai on the same date called by Sh.
R. Chandramouli, former President of AICEGEO. It should be condemned and
declared illegal by this house.
Sh.
Sanjay Mishra from Patna also asked the august house that we should try to
patch-up with other group who are trying to split the unity of this Association.
Sh.
Jithendra from Bangalore said that date and venue was not decided in Delhi. The
Secretary General informed that the tentative date and venue was declared in
Delhi itself which was accepted by the House.
The
matter was discussed in the house in details and it was informed from the
presidium that the date and venue was decided by
Sh. R. Chandramouli himself on 04.02.17 in the AEC meeting held in Delhi and
he himself declared the said AEC meeting as preconvention
meeting. After long discussions, it was resolved by the house that Chennai
convention is illegal and is condemned and also the Gandhidham convention is
the only authorized Convention and the body present in Gandhidham is the only
authorized body. It was also decided that newly elected body will try to patch
up with Chennai group, if they are willing without any condition.
After getting the views of
the delegates present, the Presidium announced that out of total 41 Units
affiliated to AIACEGEO, 28 Units were present in the Convention and accordingly
the quorum is complete. They added that four more units have already sent
message in support of Gandhidham Convention but couldn’t attend due to the unavoidable
circumstances. They further said that 2 or 3 units took neutral stand by not
attending Gandhidham or Chennai. It was further ruled and declared by the
Presidium that in view of the majority, the Minutes of Daman Convention are
correct and no further amendment was required. Accordingly, minutes of the
Daman convention were passed by the house and promotee ACs/promotee group ‘A’
officers were duly allowed to contest for the elections.
The Presidium also
announced that the present Convention at Gandhidham is legal as the same is
being held in accordance with the decision taken by the Associate Executive
Committee (AEC) of AIACEGEO.
Sh. Sanjay Mishra also suggested to inform all
CCs that this is the only legal body on the basis of the subscription already
being deducted in the name of AIACEGEO and anybody else or any splinter group
can’t use the name of AIACEGEO. Sh. Ashutosh from Indore also expressed the
same views and suggested that All India Body should give schedule for elections
to all units alongwith appointment of one observer from the nearby zone.
Sh.
Harpal Singh also suggested that the splinters should not be allowed to use the
name and logo of our AIACAGEO.
Sh.
Raja Rao from Vizag suggested that AIB should visit each unit for unity.
Sh.
Srinath informed that DDO certificates are required as per CCA RSA Rules, 1993.
The Treasurer, Shri N .R. Manda,
impressed upon the necessity of clearing the dues by all Units and he also
urged the delegates to contribute maximum donations/funds to AIB for meeting
out the expenses of legal fights pending at various fora.
Further, the Report of the Association was
placed by the Secretary General for approval. During discussions on the same,
Shri Jithendra from Bangalore Unit asked about the details of number of DDO
certificates received by the AIB. The Secretary General replied that the same
is being compiled. The report was approved by the House.
The Presidium declared the
Report as being approved by the house.
Further Shri Anand Kishore
from Raipur Unit raised the issue that some of the Superintendents have been
engaged in forming a separate Association and demanded condemnation of such
move. He emphasized that such members are trying to create splinter groups in
various units which is detrimental to the interest of the cadre. Shri Harpal
Singh from Meerut Unit vehemently opposed forming of splinter groups and
emphasized that there cannot be another Association in the same name. Such move
of splinters was condemned by the House.
Taking forward the
discussions, Shri Ashutosh Nivsarkar from Indore Unit suggested that there
should be a clear guideline for formation of the Units and suggested that in
view of the reorganization under GST regime, it would be better to create single
unit for all executive Commissionerates, Audit Commissionerate and Appeal
Commissionerate falling under a zone. It was also suggested that instead of
leaving the elections of individual units to the Units themselves, the AIB
should decide a calendar for conducting elections in affiliated Units under
supervision of an observer appointed by the AIB. Shri Shrinath Gopalan from
Bangalore categorically cited the RSA Rules and emphasized that DDO
Certificates are of immense importance for the Association. He added that RSA
Rules apply to whole of India and the DDOs are bound to deduct the subscription
once it is asked by the Association. He maintained that this is a mandatory
requirement which should be strictly followed. Shri Abhay Singh Meena from
Jaipur suggested that the membership should be restricted to those members who
had got the subscription deducted from their salary. He pointed out that some
of the members do not give subscription and accordingly asked to link the
voting rights with deduction of subscription.
Shri Pawan Reddy from
Hyderabad raised the issue of a parallel Convention being held at Chennai. He
mentioned that there is a need to find out the reasons for such division in the
cadre. He emphatically pressed that the submission of DDO Certificates should
be made compulsory. He said that efforts should be made to pursue the IRS (IDT)
OA to give it a second thought in the interest of cadre to be merged with
AIACEGEO. He also requested that the Chennai faction should be approached and
persuaded to join the AIACEGEO to maintain unity.
Shri M. K. Mishra from
Mumbai mentioned that there is necessity to stick to the RSA Rules. Delegate
from Mumbai also emphasized on the importance of DDO Certificates. It was also
suggested to have administrative guidelines to stop splinter groups from
emerging at various places. Shri Reji Mathew from Vadodara also seconded the idea
of having a check off system and suggested that necessary amendments should be
made in the constitution to make DDO Certificates compulsory. Shri Sanjay
Mishra from Bihar/Jharkhand also insisted on DDO Certificates and also
requested that efforts should be made to bring unity in the cadre.
Shri Somasekaran from
Kerala Unit raised the issue of problem being faced by the members in GST rollout
relating to infrastructure, mapping, migration etc. He urged that these matters
should be taken up by the AIB with the Board.
Delegate from Bhubaneshwar
pointed out that the portion “group B officers” has not been replaced by “Gazzetted officers” in the preamble of
the Constitution of AIACEGEO. The Secretary General replied that the same shall
be taken care of.
Shri Asok Gain from
Kolkata read out the resolution passed by the Kolkata Unit.
The Secretary General again
requested that all units must concentrate on providing of DDO Certificates,
clearing the pending dues and donate maximum funds to the AIB.
Sh. Niranjan Godara, Asstt.
Commissioner, was declared the Election Officer for the elections to be
conducted next day on 28.05.17 to elect the new office bearers of AIACEGEO. He
was asked to choose the suitable officers to help him to conduct the process of
elections.
n PROCEEDINGS ON 28TH
MAY 2017
On 28th May,
the house again met to elect the new All India Body. The elections were held
democratically with the use of secret ballot, (each unit being allowed number
of votes equal to the number of Commissionerates represented by them as per the
Constitution).
Sh. Raina from Jaipur challenged the nomination of
Sh Ravi Malik for the post of Secretary General being Asstt. Commissioner
before the Election officer in writing. Election officer duly considered the
matter on merits and rejected his representation. Election officer gave 5
minutes time to each candidate to present the respective agenda for the post of
President and Secretary General.
After
the completion of election process, the result was declared by the election
officer, Sh. Niranjan Godara, Asstt. Commissioner, in the evening and the
following office bearers were declared elected-
