reservation.
Sir,
Kindly
refer to the earlier requests of the Association on the subject matter as well
as the DOPT OM issued vide F. No. 36012/11/2016- Estt.(Res-I)
{Pt-II} Dt. 15.06.18.
2. It is to submit with due regards
that the above referred DOPT OM has been issued as
per the directions of the Hon’ble Supreme
Court on the issue of the reservation in promotions. So, it
is clear now that the promotions may be affected against the vacancies kept
unfilled for the purpose of reservation in accordance of the above mentioned DOPT
OM.
3. In view of the above, it is requested to conduct the DPC for
the post of Asstt. Commissioner against all
vacancies kept unfilled for the purpose of reservation
at an early date in accordance of the above mentioned DOPT OM.

No. CBOEC/E/2018/01119 Dt. 28.03.18 in r/o Flexible Complementary/Dynamic
Assured Career Progression Scheme for Superintendents.
2. The issue of at least five
functional promotions to officers after joining as Inspector has already been
recommended by the CBIC vide OM F.
No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 in r/o 7th CPC report which needs to be taken
up seriously by our CBIC.
3. The study team constituted by the
CBIC has taken no step till date on the issue even after the expiry of more
than 4.5 years of the recommendations of the Cabinet/CRC/Cabinet Secretary to
take extra measures to remove stagnation of group B Central Excise executive
officers independent of cadre restructuring.
4. The temporary posts of Asstt.
Commissioner have been created for a limited period with the clause of no
further promotion. Even if these 2118 posts are further extended, our officers
will not be able to get five promotions due to the clause of no further
promotion after being promoted against these pots. Moreover, these posts have
also not been included in the RRs. So, our officers will not be able to get
adequate career progression on account of these posts.
5. If direct recruitment to Group A
service can’t be less than 50%, the remaining 50% meant for promotions may
kindly be made “post based instead of vacancy based” as our officers are always
at loss on account of it being vacancy based. However, the DOPT has already
asked that direct recruitment should not be more than 3% of the total strength.
In such case, the remaining 47% may also kindly be attributed for the purpose
of promotions. Reduction in the percentage of direct recruitment will also help
to improve the stature of direct Group A service instead of affecting it
adversely. This is the only reason that DOPT also asked to minimize the direct
recruitment to the limit of 3% otherwise the officers of the same batch may be
Additional Commissioner or Commissioner or Principal/Chief Commissioner or
Member/Chairman.
6. In view of the above, it is requested
to kindly take necessary steps to bring Flexible Complementary/Dynamic Assured
Career Progression Scheme or separate service or in-situ promotion scheme for
Superintendents to grant them minimum five promotions after joining as
Inspector. In the meantime, it is
requested to implement the scheme granting in-situ promotion to the post of
Asstt. Commissioner after completion of 20 years and to the post of Deputy
Commissioner after completion of 25 years of service respectively after joining
as Inspector as approved by the Board in
the meeting of 18.02.11.
