Sir,
Kindly refer to the meeting held
under your Chair on 18.08.17.
2. It is to submit with due regards
that the next meeting under employee
grievance redressal mechanism was to be conducted within two months of the
said meeting extendable by one month. But neither any further meeting has been
held under the mechanism to consider new points nor the position of the earlier
points has been reviewed even after expiry of more than 9 months of the said
meeting as there seems no progress in r/o earlier points.
3. In view of the above, it is
requested to redress the following new points and review the
position of earlier points-
A. NEW POINTS:
(i) DPC for the post of Asstt. Commissioner for the transition year 2018.
(ii) Extension of the temporary posts of Asstt. Commissioner for smooth
functioning of GST as the said posts were justified for GST functioning.
(iii) Revival of in-situ promotion scheme as approved in
Board meeting of 18.02.11.
(iv) Unification (Central Excise/GST & Customs) and
merger (different CCAs) of cadres as done in the case of Directorates to remove
inter cadre as well as regional disparities.
(v) Implementation of the Subramanium case.
(vi) Retrospective implementation of enhanced pay scale of
Central Excise/GST Superintendents w.e.f. 01.01.96 at par with the
Superintendents of NCB.
(vii) Promotion of ad hoc Assistant Commissioners to the post
of Deputy Commissioner on completion of 4 years of service.
(viii) Taking action on DOPT OM issued vide Dy. No. 1173974/16/JS(CPC)
of the month of June, 2016.
(ix) Implementation of the verdict
given in OA No. 684/2018 by Principal Bench of Hon’ble CAT on 09.02.18 as the
matter was to be disposed off within 3 months of the receipt of the order.
(x) Implementation of the report of
the Stagnation Committee headed by Sh. Balesh Kumar, ADG, HRM-I.
(xi) General implementation of all Court orders.
(i) Initial pay scale to Central Excise
Superintendent at par with DSP of CBI (already recommended by CBIC vide OM F. No.A-26017/154//2015-Ad.IIA
Dt. 22.02.16)
alongwith other perks & allowances etc.
(ii) Batch to batch Non Functional Financial
Upgradation to our officers to grant financial parity with the best placed
counterparts of CSS etc. (already recommended by CBIC vide OM F. No.A-26017/154//2015-Ad.IIA
Dt. 22.02.16).
(iii)
Non-functional time scale in PB3 to Central Excise Superintendents like other
counterparts instead of PB2 after 4 years of service.
(iv) Next promotion of Central Excise Superintendent
to STS like other group ‘B’ gazetted officers of Central as well as State
Governments (already recommended by CBIC vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16).
(v) Scheme to improve the career prospects of
Central Excise Superintendents to grant minimum 5 functional promotions as our
officers are retiring with single promotion in the service career of 35-40
years (already recommended by CBIC vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 and Cabinet also approved
to bring a scheme to remove the stagnation of group B Central Excise executive
officers independent of cadre restructuring).
(vi) Flexible Complementary/Dynamic Assured Career
Progression Scheme for Superintendents in accordance of the observations of CBIC
under OM F.
No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 about the disparities in promotions that it is an
alarming anomalous situation.
(vii) Implementation of the CBIC circular issued
vide F. No. A-26017/44/94-Ad II (A) Dt. 08.03.95 regarding arrears of pay.
(viii) Implementation of para 7.15.24 of 6th
CPC report in light of UO No. 6/37/98-IC Dt. 24.11.14 of Expenditure.
(ix)
Undoing of MACP irregularities (para 8.1, upgradation in promotional hierarchy
and offsetting of MACP upgradation with time scale) as our officers were able
to get the grade pay of Rs. 5400/- in PB3 after 24 years of service under ACPS
while now getting the same after 30 years of service under MACPS.
(x) Uniform promotional
hierarchy for all Group ‘B’ officers across all departments/ministries in Govt.
of India (already
recommended by CBIC vide
OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16).
(xi) Merger of Level 9 and 10 (already recommended by CBIC vide OM F.
No.A-26017/154//2015-Ad.IIA Dt. 22.02.16).
(xii) Finalisation of RRs as per the verdict given in OA No. 2323/2012 by Principal Bench of Hon’ble CAT as
more than one year has already expired after the delivery of the verdict.
(xiii) Upgradation of posts & scales like state
governments under GST.
(xiv) Infrastructure and office space for staffside.

2. It is to submit with due regards
that only one point has been redressed out of 13 points submitted in the
meeting of 07.04.17. It is, therefore, requested to review the position of old
points and also consider a few new points for redressal as below-
A. NEW POINTS:
(i) Extension of the temporary posts
of Asstt. Commissioner for smooth functioning of GST as the said posts were
justified for GST functioning/requirement.
(ii) Revival of in-situ promotion scheme as approved in Board
meeting of 18.02.11 as an instant measure to remove at least
intra-cadre/regional disparities.
(iii) Unification (Central Excise/GST & Customs) and
merger (different CCAs) of cadres as done in the case of Directorates to remove
inter cadre as well as regional disparities.
(iv) Finalisation of RRs to place Central Excise
Inspectors, Preventive Officers and Examiners of same year at par in the matter
of promotion as per the verdict given in OA No. 2323/2012 by
Principal Bench of Hon’ble CAT as the RRs were to be reframed within four
months of the receipt of the order whereas 15 months have already expired after
the delivery of the verdict.
(v) Upgradation
of posts & scales like state governments under GST.

(xi)

Sir,
It is to submit with due regards
that this Association represents the Central Excise/GST Superintendents and
Group ‘A’ promotee officers under the Central Board of Indirect Tax &
Customs (CBIC). The most of our officers are forced to retire with only single
promotion in the career after joining as Inspector in comparison to 5/6
promotions to our counterparts of Customs (in our own organization of CBIC),
Income Tax (in our own Department of Revenue), CSS etc. It is also worth to
submit that the officers promoted to the temporary post of Asstt. Commissioner
have no right to further promotion and are being promoted only on ad-hoc basis.
Our officers are also not being granted due pay scales. Accordingly, it is
requested to consider the following points for due redressal-
(i) Extension of the temporary posts of Asstt. Commissioner for smooth
functioning of GST as the said posts were justified for GST functioning/requirement.
(ii) Upgradation
of posts & scales like state governments under GST.
(iii) Initial pay scale to Central Excise
Superintendent at par with DSP of CBI (already recommended by CBIC vide OM F. No.A-26017/154//2015-Ad.IIA

Progression Scheme for Superintendents in accordance of the observations of CBIC

Madam,

2. It is to submit with due regards
again that the last cadre restructuring was happened in CBIC in the year of
2013 which was initiated in the year of 2006. Prior to 2013, earlier cadre
structuring was happened in the year of 2001-02 which also took years for its finalisation.
3. As per the provisions of
periodical happening of cadre restructurings, at least one more cadre
restructuring should have happened after 2013. If we talk with reference to the
cadre restructuring of 2001-02, at least four cadre restructurings should have
happened alongwith the beginning of
the process for the fifth one as on date.
4. No need to resubmit that the most of our officers are forced to retire
only with single promotion in the career after joining as Inspector. The
temporary posts of Asstt. Commissioner created in the last cadre restructuring
for a limited period were also not able to do the due good for our officers
because of the rider of no further promotion against these posts and also not being
included in the Group ‘A’ recruitment rules. Accordingly, the process of new
cadre restructuring is required to be initiated immediately.
5. It is also worth to mention that the main thrust in the earlier cadre
restructurings was only on the career progression of the direct recruit Group ‘A’
officers without any career planning for Group ‘B’ and ‘C’ officers to give opportunity
to these officers to reach higher levels like Group ‘A’.
6. In view of the above, it is once again requested to initiate the
process for new cadre restructuring particularly taking into consideration
the poor career prospects of the officers joining the CBIC as Inspector of
Central Excise/GST.
