I am getting several calls regarding the hearing of 07.08.18 in Supreme Court on Bharthan issue. The callers are particularly asking whether the next DPC for the post of Asstt. Commissioner will happen or not and whether Sh. Manimohan & Associates are still pleading for the stay on DPC.
Yes friends, unfortunately, they have made their overwhelming efforts on 07.08.18 to halt the DPC during the pendency of the case in the Supreme Court. They pleaded that no DPC should happen till the case is not finally decided by the Supreme Court.
The views of the AIACEGEO on the issue, however, are that the DPC should not be halted because our officers are being retired regularly without promotion for the want of the DPC and all are very eagerly waiting for the DPC to happen.
If DPC happens, it will be harmful for nobody including the petitioners of CAT in this case because the promotion orders may very well be reviewed after coming of the Supreme Court verdict on the issue. Moreover, we don't know how much time would be taken for the final verdict to come. Normally, such SLPs are converted into Civil Appeals which generally take years to be decided. The ASG, however, said that he would do the final arguments on the next hearing.
As far as the individual RAVI MALIK is concerned, no doubt that I would also be benefited if verdict comes in the favour of the petitioners of CAT. But I am of the opinion that our officers should not be retired without promotion even if the final benefit go to the petitioners as well as me. I am forced to mention my name because Sh. Manimohan & Associates have already challenged my individual seniority in the Hon'ble Supreme Court. However, this is misrepresentation of facts by them by filing such affidavit which is perjury beyond any doubt.
