As we all know that DPC for the post of Asstt. Commissioner is never held timely in our CBIC as per the established record. Despite of it, we got our DPC done ahead of all others after the last cadre restructuring after toiling hard for it. But unfortunately, we had to fight in the legal courts against the stays to get every DPC happened after it. For the DPC of February, 2017, we had to go to the Madras CAT and then Madras High Court. Again for the DPC of May, 2018, we had to go to the Supreme court.
Needless to say that such legal stays always delay the DPCs and our officers keep retiring every month on regular basis despite of thousands of promotional posts being in hand. Needless also to say that everybody has right to fight for one's legal cause having valid reasons. But to get the DPC stayed is in interest of none. The legal cases may be fought without getting the stay on DPC to rule out the retirement of our officers without getting rare IInd promotion of the career under the present circumstances. It is reiterated that the person going to legal court shall get his/her due benefit later or sooner, if having valid cause. But to deprive others at the fag end of the career seems against the natural justice.
As on date, the DPCs for the year 2018 and 2019 are due but there is again a stay from Jabalpur CAT on the DPC. The AIACEGEO had to approach the Jabalpur CAT to get this stay also vacated by filing an IA. The result of the same is awaited. Even if the stay is vacated, we don't know when and from where the next stay may come. Such stays are not only delaying the promotions from group B to A but these are also affecting the promotions at lower levels, i.e., Inspector to Superintendent and Ministerial to Inspector and so on due to the cascading effect.
It is, therefore, appealed to all not to kindly get the DPC stalled by taking stay against it from any legal court.
