Various cases are being filed in various courts on MACPS by our officers. The applicants are requested to kindly take care of the following points in these cases while approaching the courts-
A. In Blalakrishanan case, the Hon'ble Madras High Court decided-
1) Time scale is not to offset with MACP upgradation.
2) Officer will get 6600/- after 5400/- (irrespective of being PB2 or PB3).
3) 5400 PB3 is no way higher than 5400 PB2.
Govt SLP was dismissed in this case in the Hon'ble Supreme Court. Thus, it has become law of land.
B. In Hariram case, the Hon'ble Delhi High Court decided that time scale is not to be offset with MACP upgradation. This order has already been accepted. Thus, issue has been finally settled.
C. In Subramanium case also, it has been established that time scale and MACP upgradation are altogether different. Time scale can't be treated as MACP upgradation.
So, based on the above verdicts, the officer after getting time scale in 5400/- (irrespective of being PB2 or PB3) should get 6600/- as next MACP upgradation. Accordingly, after 6600/-, it will be 7600/- as next upgradation. Thus, Ist upgradation after time scale of 5400/- will be in 6600/- and IInd upgradation after it will be in 7600/-.
