Honourable Jabalpur CAT order.
2. It has been mentioned in the
reply that as a sequel to CAT, Jabalpur bench order dated 24.02.95 in OA
No. 541/1994, pay scales of Inspectors, Examiners, Preventive Officers were upgraded from Rs. 5500-9000 to
Rs. 6500-10500 and those of Superintendents
(Customs/Central Excise) and
Appraisers were upgraded from Rs. 6500-10500 to Rs. 7500-12000 w.e.f.
21.04.2004.
3. In this regard, it is to submit
with due respect that the Jabalpur CAT order dated 24.02.95 is yet to be
implemented in complete form. The Honourable CAT directed to place our Inspector and also make the payment of
the arrears of the pay to our officers at par with the CBI Inspectors w.e.f. the date from which the CBI Inspectors were placed in the pay scale of Rs. 2000-3200/-, if Vth pay commission recommends the same pay scale for both categories of Inspectors. No need to say that the CBI Inspectors were placed in the said pay scale w.e.f. 01.01.86. But the complete order of the Honourable CAT has not been implemented despite of same pay scale
being recommended for both categories by the Vth CPC and despite of the repeated requests of the Association. It is
also worth to reiterate that no appeal was made in the Honourable Supreme Court
against the CAT order.
4. As far as the question of referring the matter
to the Department of Expenditure is concerned, the Honourable CAT gave no such direction. Regarding the date
of effect, arrears are to be paid w.e.f. 01.01.86 instead of 01.01.96 as per
the order given by the Honourable CAT.
5. As far as the question of filing the Writ is
concerned, the Association has filed no Writ in the Honourable High Court of Madhya Pradesh regarding the said order of the
Honourable CAT. It is also worth to mention that
all of the then Central Excise Inspectors have already become Superintendents
and Asstt. Commissioner or above and many of them have also retired but the complete order is yet to be implemented.
6. In view of the above, it is
requested to kindly implement the said order in complete form at an early date by making the payment of the due arrears with the due interest to our officers including me.
