Kindly refer to the Ref. No. 219/U/14 Dt. 01.12.14, 48/AIB/U/17 Dt.
26.07.17, 183/AIB/A/18 Dt. 19.07.18 etc. of the Association.

As this Association came to know, it is to submit with due regards that two of
our Inspectors have been suspended in Lucknow Zone in the name of not wearing
the uniform. Needless to say that this incident may be highlighted by the media
resulting in the bad name to our CBIC because the situation has already been
highly precipitated due to unrest among the officers. It seems that the
situation could have been handled in the matured manner to avoid the ugly shape
of the events without allowing a non-issue to be converted to big issue.

As per the information, the situation cropped up in regard of wearing of the
uniform by the officers in the GST era. Needless to say that the uniform and
its use should always be respected maintaining the grace associated with it.
But it seems that the matter was handled in such a manner that the officers had
to think that the uniform was being imposed on them in disgraceful manner. It
is a fact that all of our officers are ever obedient and disciplined having
utmost regard and respect for the authorities. But the circumstances under
which the situation has gone to such an unwarranted extent are really to be
analysed in cool, just and impartial manner without having any room for any
ego. It is really unfortunate that our own administration at Lucknow was
pleased to call the police against our own officers second time within one year
giving a very bad message in the time when whole of our machinery should have
been busy in the most prioritised work of revenue enhancement in the last days
of the financial year. Needless to say that these last days of the financial
year are understood as the most sensitive and important from the angle of the
revenue but we are indulged in some other activities relating to ego instead of
being revenue concerned in these days.

The issue is now being projected as the fight between the administration and
staffside perhaps due to the clash of egos which is no way a healthy signal for
the whole CBIC. Instead of handling the situation in amicable manner, we are
perhaps busy in finding out which side is on the fault. This approach is not
certainly in the interest of the revenue as well as the respect of our
department. We don’t know whether it
would result into further damage and bad name to our CBIC or the matter would
be resolved amicably without being prey of any ego or fight between cadres. It
seems better that we all should fight all-unitedly to enhance the revenue and
also for better service conditions and career prospects instead of infightings.
No need to say that all Group A, B and C officers would have to work in tandem
for the same to bring back our old glory. We have to refrain ourselves from
anything which may give the bad image to our organization namely CBIC. The ego
of any individual or group can never be above our service and department. No
need to say that the mistrust and oppression from any side would make the
ground situation worse, tense and unworkable by spoiling the atmosphere against
the interest of revenue. Needless to say also that the seniors have to play
more matured and responsible role in the matter than others.

As far as the wearing of uniform is concerned, the issue of its misuse for the
sake of grace and respect of the uniform is being raised before our Board for
years. As a result, the submissions made by the Association were circulated to
the field formations throughout the country asking suggestions in the time of
Central Excise. The HRD wing was entrusted the work of drawing the guidelines
for wearing of the uniform by the officers. Accordingly, the draft guidelines
prepared by the HRD were again circulated to the field formations by our Board
to finalise the issue which is still pending in the time of GST. Thus, the
officers are in confusion and dilemma to decide which uniform is to be worn and
on what occasion. Perhaps due to such confusion, the current situation cropped
up and reached the unwarranted height.
6. It is worth to mention that the Association requested
to formulate the statuary provisions to wear the uniform, if its wearing is
necessary in consonance of the nature of the job. If it happens, it was
requested to make it compulsory for all “from top to bottom” and also treat it
in the graceful and respectful manner granting all the required facilities and
amenities to the officers. The use of uniform merely for protocol purpose no
way seems to be graceful and respectful for the department or officers. The
CBIC also replied to the Central Information Commission that there exist no
statutory provisions in the CBIC to wear the uniform. So, the formulation of
the statutory provisions is very much required if we intend to go with the
uniform.

No doubt that wearing of the uniform to perform official duties is a matter of
pride for uniformed officers. Uniform is also given tremendous social respect
everywhere. But side by side, it is also true that it is worn in other
organizations from top to bottom without any exception with complete respect
and due facilities. Whereas in our organization, the officers are forced to
wear the uniform even at the places and occasions where it serves no purpose.
8. As far as GST regime is concerned, the officers are not aware whether
uniform is to be worn or not because there is no prescription of the uniform
under GST. Even if it is to be worn, there is no prescription for badges and
other standards for uniform under GST. Accordingly, proper uniform is to be
notified in GST regime for official purpose for all officers from top to bottom
alongwith all facilities and amenities prescribing statutory provisions. Only
then, the respect of the uniform can be maintained.

In view of the above, it is requested that the issue may kindly be settled
amicably and-
i)
The suspension of our Inspectors be revoked without further delay.
ii)
The statutory
guidelines for wearing of uniform from top to bottom in GST regime making due
prescription of uniform as well as badges and other standards etc. be issued to
remove confusion and dilemma.
