Extension of due date for filing of Income Tax return


Subramaniam verdict


Dear friends,
Namaste.
          The implementation of the Subramaniam verdict has become one of the burning issues as on date due to indifferent response from the administration in r/o its in rem implementation. The most unfortunate thing is that it is not being implemented even despite of the dismissal of the review petition of the CBIC by the Hon'ble Supreme Court. Its benefit, however, is certain to be given to all  of the affected officers at an early or late date.
          In 2016, an OA was filed in the Hon'ble CAT of Delhi for its in rem implementation which has not been finalised till date despite of the application of early hearing and is posted for the month of September now. The reason of its long penedency in Delhi CAT seems to be the huge number of cases being dealt in this Hon'ble CAT. 
       In the meantime, the petitions were filed in the various CATs including Allahabad, Ahmedabad, Patna, Mumbai, Hyderabad, Bhopal, Ernakulam, Chandigarh etc. by our officers/unit and, as was expected, favourable verdicts were given in these petitions. Needless to say that the advocates got huge money as legal fee in these cases based on the number of the petitioners.
          At some places, the orders given were of in-rem in nature like Allahabad, Patna, Chandigarh etc. The latest one being from Chandigarh on 22.05.19. The para 8 of the verdict is reproduced below-
         8. We expect from the respondents to also examine the cases of other similarly placed persons in the department to extend them the similar benefits, so that they need not approach the Court of law to seek similar benefits, as have already been granted to a specific category, otherwise this Court would be constrained to take coercive measures against the respondents for willful disobedience of the order of this Court.”
          Allahabad CAT also ordered to implement the verdict with all consequential benefits with effect from the dates that officers had completed four years of service in the Grade Pay of Rs. 4800/- (i.e., pay scale of the Superintendent) alongwith the interest at such rates as might be found just and reasonable in the facts and circumstances of the case. It was further ordered that the respondents would ensure that the benefits of the judgment referred above are given to all the persons who are entitled to the same whether they are retired or are in service and that this exercise is to be completed within a month from the date of the receipt of certified copy of the order.
          But despite of specific and in rem verdicts, in rem implementation of the case is still awaited.
       Consdering all ifs & buts, it has already been planned to file contempt on the issue in the Hon'ble Supreme Court as well as Allahabad CAT based on the verdict given by the Hon'ble Supreme Court that the non-petitioners can also file contempt petition. This can, however, also be filed in the Hon'ble CAT of Chandigarh. The relevant paper have already been provided to the advocates on the issue.

         The issue was also discussed with the Member (Admn) in the 12th meeting and a view also came to file a consolidated petition including all officers who are yet to be given benefit. 
          Accordingly, due to the strategic reason, one consolidated petition now may be filed in any of the CATs making all of the remaining officers petitioners in it alongwith the Association at a place where the verdicts are coming at fast speed. One of the such CATs may be Mumbai CAT.
          So, all of the units are requested to prepare the list of the remaining officers in the concerned zones/Commissionerates. All of the affected officers are also requested to contribute a nominal amount to the concerned unit of the Association for the cause, so that the petition under reference may be filed. It is necessary to make the Association one of the petitioners to give the benfit of the verdict to the officers being due in future also ruling out the possibility of denial of the benfit to them by the administration on the ground of being non-petitioners.

Convention to be held on 14.09.19 and 15.09.19 at Jodhpur

Dear friends,
Namaste.
          As now known to everybody that Sh. Manimohan & associates are noway interested in the unity, so we are forced to declare the dates and venue of the 13th General Body Meeting and Convention of the Association.
          It was crystal clear after the meeting of 12th July with the Member (Admn) itself that they are not et al interested in the unity because they didn't agree for the common Convention despite of our repeated offers for the same even during the meeting also. They also didn't offer us to join their Convention during this meeting.
          It is really unfortunate that they have spread the infection that the Promotee Group A officer or Asstt. Commissioner should not be our Secretary General or even not the member of the Association. However, it's also a question of thousand Rupees whether they will like to merge with us if our Secretary General and President will only be the Superintendents.
          One more effort was made to be sit with them for the sake of unity on 27.07.19 at Hyderabad but they avoided it saying that they are not free on this date because of having some other meeting. Finally, we got last response from Sh. Manimohan saying, "I have sufficient support. Why should I sit with them?" So, chapter of unity being closed from his side, we are forced to declare the dates and venue for the Convention.
          Accordingly, as per the availability of space/rooms and other arrangements/factors, the date and venue of the 13th General Body Meeting and Convention of the Association will be as below-

Venue - Jodhpur.
Dates - 14.09.19 to 15.09.19 (Saturday and Sunday)
          Further details regarding arrangement and agenda will be communicated soon.
          However, all of Sh. Manimohan & associates as well as all of the units being said to be with them are once more very cordially invited to join the Convention to be held at Jodhpur on 14.09.19 and 15.09.19 to make it an all-united common Convention in the interest of the unity and common cause.

The Government of India has implemented various measures bringing technological intervention to bring transparency in the day to day administration, such as, implementation of e-Office, e-Leave management system, Employee Information System, Smart Performance Appraisal Report Recording Online Window (SPARROW), Aadhar enabled Bio-metric Attendance System (AEBAS), Pension Sanction and Payment tracking System (Bhavishya), Public Financial Management System (PFMS), Government e-Market (GeM), Central Public Procurement Portal (CPPP), Foreign Visit Management System (FVMS), Web Responsive Pensioner’s Service for pensioners etc.
Various other information related to departments are available on the websites of the Departments.
1. AEBAS- Aadhar Enabled Biometric Attendance enables real time and flawless monitoring of employee attendance thereby ensuring punctuality among employee,
2. e-Office aims to usher in more efficient, effective and transparent inter-government and intra-government transactions and processes. It enhances transparency, assure data security and data.
3. GeM: – Government e-Market (GeM) provided rich listing products for individual categories of Goods Services, transparent and ease of buying and user-friendly dash board for buying and monitoring supplies and payment.
4. Currently, approximately 46.4 lakh tenders with estimated value of Rs.66.00 lakh crores are processed through Central Public Procurement Portal (CPPP) since inception till 30th June, 2019. During the month of June, 2019 around 1.12 lakh tenders worth Rs.1.02 lakh crores were processed on CPPP. Apart from this, procurement of more than Rs.18700.00 crore has been taken place through Government e-Marketplace (GeM) till its inception in 2016.
5. The Web Responsive Pensioner’s Service is providing single point web solution for pensioners to obtain comprehensive information relating to status of the pensions processing and payment.
6. Foreign Visit Management System (FVMS) has been operational for regulating and ensuring efficient and effective foreign travel of officers of Government of India from the rank of Additional Secretary and above for obtaining the approval of the Screening Committee of Secretaries. The URL for the system is fvms.gov.in and all the Ministries / Departments are required to submit their proposal online on this website.
7. The CAG’s Audit reports after they are tabled in the Parliament/Legislature, are uploaded on the website of CAG. Information related to the status of pension, GPF and Gazetted Entitlement cases are available on the websites of respective Account General’s Office. This enables the concerned stakeholders and other visitors to view information relating to audit and accounts activities of the department.

2. It is to submit with due regards that the orders Dt. 20.06.16, 04.07.16 and 11.07.16 of the CBIC relating to MACP upgradation have been ordered to be quashed and set aside by the Hon’ble CAT vide above mentioned order Dt. 20.09.18 with all consequential benefits.
3. As per the verdict,
i) The time scale/NFG is not to be offset with the MACP upgradation.
ii) GP of Rs.5400/- in PB2 and PB3 to be treated as one and the same.
iii) Next upgradation under MACPS is to be granted in the GP of Rs. 6600/- after the grant of time scale in GP of Rs. 5400/-.
iv) The next MACP upgradation is to be granted in GP of Rs. 7600/- accordingly.

            Kindly refer to the earlier requests of the Association on the above matter.
            2. It is to submit with due regards that the DPC for the transition year 2018 as well as the calendar year 2019 are still pending being already overdue as the same were to be convened between 01.08.17 to 31.01.18 and 01.05.18 to 31.10.18 respectively as per the DOPT OM No. 22011/14/2013-Estt(D) Dt.08.05.17.
            3. It is also worth to submit that the repeated stays are coming on the DPC/promotion perhaps due to the improper presentation of facts before the courts or inaction/delayed action by the concerned authorities particularly at local levels due to which the officers are forced to retire without promotion despite of thousands of posts being vacant.
4. Due to the lack of timely action on the part of the concerned authorities at local levels in legal cases, the officers are totally demoralized being unable to get even IInd promotion of the career without any fault on their part. It is also painful that no efforts have ever been made to convene the DPC during the non-stay period.  
5. Under the present circumstances, it is urgently required to get the stays vacated at an early date not only in the interest of the retiring officers but also in the interest of the manpower required for the GST work at Group A entry level. If the Hon’ble CAT is of the view of not vacating the stay, immediate measures may kindly be taken by the CBIC to get the stay/s on DPC vacated by filing petition in the Hon’ble High Court or even in Hon’ble supreme Court, if considered appropriate. Otherwise our officers will keep retiring without promotion despite of thousands of promotional posts being in hand.
            6. Your kind attention is also invited to para 3(i) of the DOPT OM issued vide No. 28036/8/87-ESTT.(D) Dt. 30.03.88. This para allows the ad-hoc promotions even in case of an injunction by a Court/Tribunal.
7. In view of the above, it is requested to kindly take serious steps to conduct the DPC by vacating the stays or applying the provisions of the DOPT OM issued vide No. 28036/8/87-ESTT.(D) Dt. 30.03.88 at the earliest possible date for the sake of justice to our officers retiring without promotion.

Kindly refer to the various communications of the Association made on the MACP matters.
2. Inviting your kind attention to the verdict given in OA/21/584/2019 on 03.07.19 by the Hon’ble CAT of Hyderabad on the issue (copy enclosed), it is to submit with due regards that the Hon’ble CAT has directed to dispose of the representation keeping in mind the rules in force as well as taking into account all the points raised in the representation and after such consideration, if any anomalies are brought to the notice of the respondents, the same can be rectified with proper steps, within a stipulated period of six weeks. It is further to submit that the Hon,ble CAT has given directions keeping in mind the well settled decision of the law as enumerated in a catena of judgements by the Hon’ble Supreme Court and the Hon’ble High Courts and the Tribunal.
3. The Association has submitted various representations to the various authorities including your goodself on the issue but no response has been received from any of the authorities on any of the representation till date.
4. Now, the scenario is that the benefit of court verdicts is being given only to those officers who are approaching the legal courts. It means that our thousands of affected officers are being forced to approach the legal courts despite of the govt. policy for minimum litigations. It is really unfortunate and injustice to implement the court verdicts in discriminatory manner only for the applicants and not in rem for all similarly placed officers. 
5. It is reiterated that the verdicts given by any court, until directed to be implemented in person, are to be implemented in rem as being implemented in revenue matters. But, unfortunately, the verdicts are not being implemented in rem despite of being settled at the level of the Hon’ble Supreme Court or High Courts or CATs even where no appeal has been made.
6. Your kind attention is also invited to the various verdicts given by the Hon'ble Supreme Court for in-rem implementation including the orders Dt. 17.10.14 given in the Civil Appeal No. 9849 of 2014 in the matter of State of Uttar Pradesh & Ors Vs. Arvind Kumar Srivastava & Ors as under: 
“Normal rule is that when a particular set of employees is given relief by the Court, all other identically situated persons need to be treated alike by extending that benefit. Not doing so would amount to discrimination and would be violative of Article 14 of the Constitution of India. This principle needs to be applied in service matters more emphatically as the service jurisprudence evolved by this Court from time to time postulates that all similarly situated persons should be treated similarly. Therefore, the normal rule would be that merely because other similarly situated persons did not approach the Court earlier, they are not to be treated differently.”
            7. Your kind attention is also invited to the to the verdict given by the Hon’ble Apex Court in SLP No. 77457/2017 saying that once the question, in principle, has been settled, it is only appropriate on the part of the Government of India to issue a circular so that it will save the time of the court and the Administrative Departments apart from avoiding unnecessary and avoidable expenditure. The Hon’ble Court further directed the Government of India to immediately look into the matter and issue appropriate orders so that people need not unnecessarily travel either to the Tribunal or the High Court or the Supreme Court.

8. In view of the above, it is requested to kindly also dispose of the representations made by the Association on the issue for the sake of justice considering the points already submitted by the Association. It is also requested that the disposal may kindly be made keeping in mind the rules in force and the well settled decisions of the law as enumerated in a catena of judgements by the Hon’ble Supreme Court, the Hon’ble High Courts and the Hon’ble Central Administrative Tribunals
