Constitution of Pensioners' Association

 ALL INDIA PENSIONER’S ASSOCIATION OF CENTRAL BOARD OF INDIRECT TAXES & CUSTOMS.

Central Headquarters
LOKANATH BHAWAN, JENA MATH LANE, KUNDHEI BENTA SAHI, NEAR PANCH MUKHI CHAURA, PURI (ODISHA) - 752001.

CONSTITUTION

(This constitution was adopted by the National Conference of the Association held at New Delhi on
10th and 11th March, 2016 and amended on 5th April, 2019 by the National Conference of the Association
held at New Delhi)

1. The name of the Association shall be “All India Pensioner’s Association of Central Board of
Indirect Taxes and Customs”.

2. Aims and objects: The object for which the Association is established are:
(a) To unite the entire retired officers /pensioners of field formations of Central Board of
Indirect Taxes and Customs (previously known as Central Board of Excise and Customs) Government of
India under the aegis of the “All India Pensioner’s Association of Central Board of Indirect Taxes and
Customs” hereinafter referred to as “Association”;
(b) To safeguard and promote the interest of all retired officers /pensioners of field
formations of Central Board of Indirect Taxes and Customs (previously known as Central Board of Excise
and Customs) Government of India.
(c) To do all such things as are incidental or conducive to the attainment of the above
objects or any of them.

3. The Central Headquarters of the Confederation shall be at the residence of Secretary General.
4. Composition:

(a) The Membership of the Association shall be open to all retired officers /pensioners
of field formations of Central Board of Indirect Taxes and Customs (previously known as Central Board
of Excise and Customs) Government of India ,through affiliated units.

(b) Forfeiture of rights: Any affiliated unit of the Association who shall not pay the
subscription within 3 months from the end of the financial year shall forfeit the rights and
privileges of affiliation at the discretion of the National Executive.

5. Affiliation:
The State units of the Association shall be eligible for affiliation subject to the
provision made in Part II herein. One or more units in a State shall be formed at the discretion of
the National Executive.

6. Affiliation fees:
A fee of Rs.100 shall accompany the application for affiliation.

7. Subscription
Every affiliated unit shall pay an annual subscription at the rate of Rs.100/- (Rupees one
hundred) only per member of the affiliated unit to the Association CHQ within the financial year. The
subscription shall be payable within 3 months from the end of the financial year failing which the
certificate of affiliation shall be rescinded. . However, the National Executive Committee may extend
the date of deposit on exceptional case.

8. Management:
The Management of the Association shall be vested in the following bodies:-
(a) The National Conference, which shall meet once in three years. In exceptional
Circumstances, the tenure may be extended by three months by the National executive.
(b) The National Executive which shall meet at least once in six months.

9. Composition of National Conference, and National Executive :
A. National Conference.
The National Conference shall consist (a) office bearers of All India Association (b)
National Executive Committee members (c) office bearers and delegates elected and nominated by the
affiliated units of the Association .
B. National Executive Committee
The National Executive Committee shall consist of
(a) Office bearers of All India Association.
(b) One member nominated by the affiliated units of the Association.

10. Powers and duties.
A. National Conference. The National Conference shall be the supreme body of the
Association and shall have absolute control over the affairs and property of the Association apart from
the following powers.
(a) to elect office bearers listed in Article 13.
(b) to consider and adopt the triennial report and accounts of the Association.
(c) to effect or rectify changes in the constitution of the Association by
decisions taken by the 2/3rd majority of the representatives assembled at the National Conference.
(d) to decide all question on policy
(e) to act as a final court of appeal against the suspension of any office
bearers.
B. National Executive Committee:- In between the sessions
of the National Conference, the National Executive shall exercise all powers of the National Conference
except as those specified in clauses (a) to (d) of article 10. National Executive Committee shall
however be competent to take decision on all matters not contrary to the decision of the National
Conference. It shall have the powers to fill up the vacancies of the office bearers on majority
decision.

11. Powers and duties of All India Office bearers.
The office bearers shall be responsible to the National Conference, and National Executive
Committee. The President shall preside over the meeting of the National Conference, and National
Executive Committee and exercise general supervision over the work of the Association. Vice presidents
shall perform the duties of the President in the absence of the President and shall assist him in
his work and on recommendation of Secretary General one of them shall preside over the meeting in
absence of President. Secretary General shall be the chief executive officer of the Association. He
shall conduct correspondence with all concerned, sign papers, maintain minutes books and shall perform
all functions attached to the post. The Joint Secretaries shall assist the Secretary General and work
under him. On recommendation of President one of them shall also perform the duties of the Secretary
General, in his absence. Financial Secretary shall be nominated by Secretary General and shall be
responsible for the funds of the Association and receive all fees, moneys and contributions on behalf
of the Association and grant receipts. He shall be responsible for the proper maintenance of accounts
of the Association. Two Organising Secretaries shall be nominated by Secretary General and shall
assist the Secretary General in Organisational matters and shall perform specific duties assigned by
the Secretary General.

12. Voting in the Managing bodies.
Each delegate/office bearer of affiliated unit/ Members of National Executive Committee
including office bearers of All India Association as the case may be shall have one vote.

13. Election:
(a) The delegate/Member of the National Executive Committee shall be elected or nominated
by the respective affiliated units of the Association in such a manner as they may deem fit.
(b) The All India Office bearers: The following Office bearers shall be elected from
among the delegates / office bearers of affiliated units/ Members of National Executive Committee
including office bearers of All India Association attending the National Conference in a democratic
manner. Two election officers shall be nominated by Secretary General to conduct election in National
Conference and decision of election officers on election matters shall be final.
(i). One President
(ii) Three Vice Presidents
(iii) One Secretary General
(iv). Three Joint Secretaries
(c) Immediate after election the Finance Secretary and Two Organising Secretaries shall be nominated by
Secretary General and they shall also be members of National Executive Committee with voting power.

14. Expenses of Delegates//Executive Committee Members :
The expenses of the delegates/ National Executive committee members/office bearers of
affiliated units, other than the President, Secretary General, Finance Secretary and Organising
Secretaries shall be borne by the respective affiliates units of which he is a primary member. The
expenses of the President, Secretary General, Finance Secretary and Organising Secretaries shall be met
out of the funds of the Association. The National Executive Committee is empowered to authorize meeting
the expenses of any office bearers on exceptional circumstances.

15. Tenure of Office:
All the all India office bearers and members of the National Executive committee shall hold
the office till the next conference.

16. Auditor
The Auditor shall be nominated by the National Council and shall not be an all India office
bearer and shall audit the accounts of the Association.

17. Notice of meetings
(a) Notice of the meeting of the National Conference shall be served at least 30 days
before the date thereof and notice of the National Executive Committee shall be served at least 15 days
in advance. In case of an emergency meeting, the notice period may be reduced by half.
(b) The notice of the meetings shall be served only to the affiliated units and not
to the National Executive Committee members/Delegates individually except in the case of All India
office bearers for whom the notice will be served individually.

18. Quorum
(a) The quorum of a meeting of the National Conference shall be one fourth of its
strength.
(b) The quorum of a meeting of the National Executive Committee shall be one third
of its strength.

19. Requisition meeting: A requisition meeting of the National Executive Committee shall be
convened, if 12 (twelve) members of the National Executive Committee give notice for the same.

20. Funds: The funds of the Association shall be deposited in a scheduled bank and operated jointly
by the Secretary General and Finance Secretary. Subscriptions/Donation shall be collected by All India
Association through affiliated units.

21. Amendment in the Constitution. No amendment to the Constitution shall be carried except by 75%
of authorised delegates/members of National Executive Committee including all India office bearers
present in the National Conference voting in favour of amendment(s) at the National Conference.

22. Financial Year: The financial year shall be from 1st April to 31 st March.

23. The Association shall be registered under registration of the Society Act and applied for grant
from Government of India.
PART- II
1. The one or more units shall be formed at State levels consisting of all retired officers
/pensioners of field formations of Central Board of Indirect Taxes and Customs (previously known as
Central Board of Excise and Customs) Government of India.
2. The units shall have power to frame rules to suit the local conditions but not inconsistent
with articles of the Constitution of the All India Association. The units shall elect office bearers in
accordance with their approved constitutions/rules and run the affairs of the units as per such
approved constitution/rules.
3. The units shall apply for affiliation along with a fee of Rs.100 and necessary affiliation
shall be granted after approval in National Executive Committee.
4. Every affiliated unit shall pay an annual subscription at the rate of Rs.100/- (Rupees one
hundred) only per member of the affiliated unit to the Association CHQ within the financial year. The
subscription shall be payable within 3 months from the end of the financial year failing which the
certificate of affiliation shall be rescinded. However the National Executive Committee may extend the

5. The units shall faithfully carry out the directives of the All India Association and shall
refrain from chalking out separate programmes on issues, which are already under the purview of the
Confederation without prior intimation.
6. The units shall collect subscriptions/donation from the members of the affiliated units.

Sir,

            Kindly refer to the various communications of the Association covering the subject mentioned issues of workload, manpower, infrastructure and system etc.

            2. It is again submitted with due regards that the Range and Division Offices under the field formations are acutely short of the required manpower and infrastructure. Due to it, the officers are work-loaded tremendously beyond the human limits. System is also not functioning properly. Officers are unable even to take optimum use of the system due to its improper functioning. However, system should be of the type that we may be able to take its maximum and efficient use.   

3. Recently, action has been initiated against one of our officers namely Sh. Akash Chandran, Superintendent of Nagarcoil Range of Tirunveli Division of Chennai Zone in relation of non-adhar validation GST registration without appreciating the work related problems being faced by our officers. It has been said in the Memorandum issued to Sh. Akash Chandran under Rule 16 of CCS (CCA) Rules, 1965 that he took 14 days to send the verification report to the concerned authority instead of sending it within the stipulated time. News in the air is that such action is also being contemplated against many more officers. Such type of actions against the officers are really disappointing, demoralizing and horrifying and shall suppress the work culture knowing very well that our officers are working day and night even beyond office hours and even on holidays. Official orders are being issued by the authorities to force them to come to office even on statutory holidays without giving them time to be relaxed and refreshed. It is also worth to mention that the time to get relaxed and refreshed is very necessary for the employees even as per DOPT guidelines but our authorities seem to be not worried et al about relaxing and refreshing our officers. Rather authorities seem more interested in taking punitive actions against the officers without any genuine reason and also without understanding the actual problems.

4. As already brought to your kind notice that our officers are already busy throughout to provide non-statutory reports and other works as being asked by our authorities. Such reports should kindly be produced by the concerned authorities from system itself for at least optimum use of the system. Your goodself was also requested to take measures that statutory works are not harmed on account of such non-statutory reports/works which are being asked every hour from our officers in time bound manner by the authorities. Instead of taking some remedial measures, punitive actions have been started to be taken against our officers. As far as infrastructure including vehicles meant for staffside for official work is concerned, the same are being enjoyed by the higher authorities as per their sweet will and disposal, whether official or unofficial, instead of providing the same to the staffside to be used for official purpose. If the movements of the vehicles meant for official work are verified, it will be crystal clear that who is using these vehicles and for what purpose.

5 In view of the above, it is very much requested to take remedial measures in r/o workload, manpower, infrastructure and system to provide required work culture to the officers instead of taking punitive actions against them. The action initiated against Sh. Akash may also kindly be withdrawn and such action may also kindly not be initiated against any other officer. It may also kindly be taken into kind consideration that it is not possible for human being to work in mechanical manner particularly when the problems like tremendous workload, acute shortage of manpower and infrastructure, poor system etc. are being faced.

            2. Inviting your kind attention to the Office Order No. 156/2020 issued vide F. No. 32012/13/2020-Ad. II Dt. 24.12.20 of CBIC promoting 968 officers to the post of Asstt. Commissioner, it is to submit with due regards that many of the officers have not joined the post of Asstt. Commissioner in pursuance of the above referred Office Order of the CBIC. The non-joining of officers is defeating the very purpose for which these ad-hoc promotions were made.

3. The DOPT have mentioned in the above referred OM Dt. 13.01.21 that the vacancies on account of non-joining of the officers shall be filled-up by considering the eligible officers next in the order of the seniority.

4. In view of the above; it is requested that the same procedure may kindly be followed by the CBIC to promote some more officers in the order of the seniority in lieu of the vacancies being remained unfilled on account of non-joining of the officers promoted to the post of Asstt. Commissioner. It is also requested that some more officers may also kindly be promoted in lieu of the officers who already have unfortunately expired or retired or taken VRS etc. and whose names figure in the promotion orders issued vide Office Order Dt. 24.12.20.

Madam,

            It is to submit with due regards that 968 officers have been promoted to the post of Asstt. Commissioner recently which include 770 from Central Excise stream. Now, their transfer/posting is on the cards as the options for the same already being asked.

2. The following submissions may kindly be considered sympathetically in r/o their transfer/posting-

A. If vacancies exist at the parent station/zone, the officers may kindly not be transferred to another station/zone barring those officers who have given the options to be posted out of station/zone. At least the officers having 5 years or less service left may kindly not be transferred to another station/zone barring those who have opted to be transferred outside.

B. The officers promoted earlier and transferred to another station/zone may also kindly be brought to the requested station/zone. At least those, who are left with 3 or less years of service, may kindly be brought to the requested place in consonance of the guidelines issued by the CBIC for the transfer/posting of group ‘A’ officers. The compassionate grounds including acute medical ones of self, spouse, parents or children may also kindly be considered.

C. If the officers are to be transferred to other station/zone for the want of the vacancies, they may kindly be transferred to the nearest station/zone and may kindly be brought back as soon as the vacancies occur at the parent place. The officers may kindly be retained at parent place in the serial from the eldest to the youngest in r/o age barring specific requests to go to outstation and genuine compassionate grounds.

3. The reason behind the request to post the officers at parent place is that these old aged officers are prone to various old age diseases and having regular treatment at the parent place. All of them are also engaged to fulfill their family obligations  like  settlement  of the career issues of young wards, settlement  of  marriage  of  their  wards particularly daughters, care of old and ailing parents being under medical supervision at the parent place etc. If they are transferred at this stage, neither they shall be able to fulfill their family obligations nor be able to transfer whole family to new place or have double establishments, i.e., one at the old place and another at the new place, due to the financial constraints. No need to submit that these officers get promotion on the fag end of the career without benefit of even a single rupee. They are not in the position to get their family transferred to the new place with them due to prevailing circumstances. This will put them under unwarranted and unbearable financial burden.

 4. It is further to submit that non-transfer to other station/zone will also save huge govt. expenditure to be incurred on TTA.

5. In view of the above; it is requested that the officers may kindly not be transferred to outstations except those who have opted to go to outstations, if vacancies exist at the parent place. The officers already transferred to outstations may also kindly be brought back to their requested places giving kind consideration to their compassionate grounds as well as the transfer guidelines meant for Group ‘A’ officers.
