In rem implementation of Subramaniam verdict.
Sir,
Kindly refer to earlier
communication Ref. No. 94/AIB/S/21 Dt. 17.06.21 of the Association.
2. Your kind attention is again invited to
the orders given in OA No. 536/2020, 714/2020 and 811/2020 by the Hon’ble
Central Administrative Tribunal, Allahabad.
3. The Hon’ble tribunal ordered in all of
three OAs as below-
“A copy of this order be also served on the Union Finance Secretary by the Registry
to consider issuing directions on identical matters such as above for in rem consideration and not in personam. This would avoid needless
litigation in the future.”
4. The issue in the matter relates to the grant of Non Functional Grade
(NFG) after completion of four years of service in the pay scale of Central
Excise Superintendent. For the want of the directions to be issued at your good
end as asked by the Hon’ble Tribunal, thousands of officers are forced to
approach legal courts throughout the country increasing the needless
litigations. The matter is based on the verdict given by the Hon’ble High Court
of Madras in W.P. No. 13225/2010 in the case of Sh. M. Subramaniam. The SLP and
Review Petition filed by the Govt. of India in this matter against the order of
the Hon’ble High Court of Madras were also dismissed by the Hon’ble Supreme
Court.
5. In view of the above, it is requested to kindly issue the directions
for in rem implementation of the verdict.
