MACP case in Supreme Court

 Friends, we will have to contribute for MACP case in which govt. is going to file SLP in Supreme Court against order of Jabalpur High Court. Situation is of "do or die" because chapter will be closed for ever, if govt. wins in Supreme Court. 

 We don't know how long the case will go in Supreme Court. It may be finalized on very first hearing or may be lingered on very long. 

In one case to get stay on DPC vacated, we had to approach Supreme Court. Senior advocate appeared for 3 hearings and charged Rs. 7 lac per hearing. It is in addition to fees & expenses of advocates on record who filed petition. Association remained in deficit of Rs 3 lac in this case for want of sufficient contributions.  These 3 lacs were finally shared by 3 officers who were not even to be considered in that DPC. Salute to their spirit. 

Such hefty fees will not be easy to bear for only petitioners of this MACP case. This case will not only benefit petitioners but will be beneficial to all.

One more fact is that 100% officers never contribute. Rather I should say that very less of us participate in monetary contributions. Some are who want to contribute but unable to contribute more amount due to their compelling circumstances. However, even a tiny contribution is of great help, if contributed by all. This contribution is not to be made by members of this group only but we have to motivate others also who are not in this group.

Under the circumstances & considering experience of DPC case, we will have to contribute at least Rs 10000/- per member, so that we may be able to have funds in hands at least for 3-4 hearings. Willing officers may also contribute even more. In case of emergency & more requirement, we may have to contribute more later. It is reiterated that even a tiny contribution will be of great help. 

Some of officers may already be fighting their cases on this issue. But if we are defeated in Supreme Court, the fate of all other pending cases & future cases in various courts will be the same wether it is for 6600 or 7600.

And also please don't forget to motivate others who are not members of this group. No need to say that this case will benefit all cadres, I.e., promotee ACs, Superintendents, Inspectors & also who joined below one rank to Inspector. Not only it, this case will benefit serving as well as retired officers.

Govt. to file SLP in Supreme Court in MACP case

 Friends, 

Now, CBIC has decided to go to Supreme Court against Jabalpur High Court decision in MACP case. We all know very well that it's not easy to fight in Supreme Court due to want of hefty legal fees. If our case is defeated in Supreme Court for want of fees, chapter for us will be closed forever. So, it is reqstd to all to kindly help/contribute for this case generously considering seriousness of the matter, if we don't want to close the matter forever against us. Fate of all cases filed in lower courts on MACP will depend on this case.

Kindly refer to the earlier various representations of the Association on the subject matter including Ref. No. 23/AIB/P/2 Dt. 14.02.22.

2. It is again submitted with due regards that the Association was given understanding on the DPC for the post of Asstt. Commissioner that the same is pending due to the want of the order in Jarnail Singh case by the Hon’ble Supreme Court. It is further submitted that the Hon’ble Supreme Court has already pronounced the order in the Jarnail Singh case.

3. The promotions of thousands of our officers to Group ‘A’ are held up as on date. Around 2000 posts of Asstt. Commissioner are vacant. It is also worth to point out that every DPC for promotion from Group ‘B’ to Group ‘A’ has been delayed and never happened on time as per the schedule prescribed by the DOPT in our CBIC. As on date, the DPCs for three consecutive years, i.e., 2020 to 2022, are pending.

4. The Association believes that there is no reason now which prevents our CBIC to conduct the DPCs for the post of Asstt. Commissioner and issue promotion orders at an early date as the promotion orders for the post of CAO have already been issued vide F. No. 32012/06/2020-Ad.IIA today on 22.03.22 of CBIC to further believe that now there remains no issue for the promotion to the post of Asstt. Commissioner also.

5. Needless to submit that our officers are forced to retire without promotion without any fault on their part. It is also worth to submit that the promotions are to be affected on ad hoc basis only in the present scenario which can very well be done based on the DOPT OM issued vide No. 38036/8/87-ESTT. (D) Dt. 30.03.88 in case of any seniority dispute, revision of seniority or court injunction.

6. It is also worth to mention that the existing seniority list is yet to be exhausted and the promotions are to be affected only on ad-hoc basis. Therefore, it seems that many of the vacancies of Asstt. Commissioner for the years 2020. 2021 and 2022 may also be filled-up on the basis of the existing seniority list and remaining vacancies may be filled in accordance of the joining of the post of the Superintendent to promote the officers on ad-hoc basis. The ad-hoc promotions may be reviewed later based on due seniority list or court verdict/s, if any.

7. It is also worth to mention that our Asstt. Commissioners are already working under tremendous pressure for the want of due manpower at this level, required staff and infrastructure. They are already working with 50% of staff to complete PV, refunds within 30 days, DGARM reports, risky exporters verification, adjudication, investigation etc. etc.  apart from realisation of arrears, every minute whatsapp directions and usual protocol duties. Not only Asstt. Commissioners but our Superintendents are also working under tremendous work pressure due to the reasons mentioned herewith.

8. In view of the above, it is requested that the remaining vacancies of the Asstt. Commissioner relating to the years 2020, 2021 and 2022 may kindly be filled immediately granting ad-hoc promotions on the basis of the existing seniority list as the same is yet to be exhausted fully and further based on the date of joining of the post of Superintendents by the officers.

It is again submitted with due regards that the Association was given understanding on the issuance of All India Seniority List of Central Excise/CGST Superintendents beyond 2006 that the same is pending due to the want of the order in Jarnail Singh case by the Hon’ble Supreme Court. It is further submitted that the Hon’ble Supreme Court has already pronounced the order in the Jarnail Singh case.

3. The All India Seniority List of Central Excise/CGST Superintendents was drafted upto 2011 years ago on the persuasion by the Association. But unfortunately, the said Seniority List is yet to be released and the seniority list for further years is also to be prepared.

4. The Association believes that there is no reason now which prevents our CBIC to release the Seniority List. It is also worth to mention that the promotions of thousands of our officers to Group ‘A’ are held up due to the want of the Seniority List and they are forced to retire without promotion without any fault on their part.

5. In view of the above, it is requested that the All India Seniority List of Central Excise/CGST Superintendents beyond 2006 may kindly be issued at the earliest, so that no officer retires without promotion for the want of seniority list.

Sir, 

Your kind attention is invited to the unlawful, highhanded and atrocious order issued vide C. No. II/10-A/03/2022-Vig Dt. 03/04.03.22 (copy enclosed) by Sh. D. Anil, Commissioner of Customs (Preventive), Tiruchirapalli.

 

2. It is submitted with due regards that Sh. R. Balaji, Superintendent, has been put under suspension by Sh. D. Anil vide above mentioned order because Sh. R. Balaji couldn’t attend Sh. Anil’s private visit on a holiday. As per the information gathered, Sh. Anil went to Rameshwaram on a Sunday for holidaying and private tourism with his wife and family. This visit was not informed officially to any formation. On the way, he visited the Mandapam Customs formation and found that Sh. Balaji was not present there to facilitate and protocol his private visit and serve his family on Sunday. So, he suspended the said officer to satisfy his ego in unlawful and highhanded manner because of not getting private service for him and his family from Sh. Balaji.  

 

3. No need to submit that it is a totally atrocious act on the part of the concerned Commissioner. It is also to reiterate that Sh. Balaji was not aware about his holidaying visit at all as he was not communicated about it by anyone. It is, however, is a question of law as to why a gazetted officer of Govt. of India or even any other officer should be present on the spot to protocol and serve a private visit of any authority or his family on holiday or at any other day to satisfy the personal ego of the concerned authority or to give private facilitation and service to the authority and his family. It is also a question of law whether Sh. Anil, not being the cadre control/appointing/disciplinary authority of Sh. Balaji, is authorized to suspend our Superintendent. It is also a question of law whether our officers are supposed to serve and entertain the wives and children of the higher authorities.

 

4. So, the above incident proves that such authorities want to treat our gazetted officers like their personal servants. They are appeased to treat our officers as their slaves. It is not understood whether our gazetted executive officers are appointed to serve families of such authorities. Such mentality of our higher authorities is required to be mended. Being sit on seats of power, their approach should be like a family head and a welfare officer instead of showing despotic attitude.

 

 

5. In view of the above, it is requested to kindly check such incidents immediately and revoke the suspension of the suspended officer with all consequential benefits for the sake of justice. Such despotic attitude as shown by Sh. Anil is damaging to whole system in our greatest democracy of the world.
