Kindly refer to the communications
made by the Association on subject matter including Ref. No. 50/AIB/T/24 Dt. 02.07.24 as well as 55/AIB/A/24
Dt. 16.07.24, transfer/posting guidelines for Group A officers issued by CBIC
and various DOPT guidelines
2. In continuation to the subject matter, it is brought to your kind notice with due regards that there have been
made several deviations and the AGT office order No. 126/2024 Dt. 02.08.24 has
been issued with errors to the disadvantage of the officers. No doubt that the administration has the prerogative to rotate the officers but it shouldn’t
seem to be arbitrary and unilateral. The transfer order impresses that the use
of highhandedness and undue influence have duly
been used. Some deviations/errors are enumerated as below-
(i) Asstt. Commissioners have been posted to a Zone
which is not of their choice/willingness in the representation even after
spending three years in other zones thousands of KMs away from their
home.
(ii)
Officers have been posted to DG Systems against willingness after working in
DGOV/CESTAT for three years within the same city instead of considering their willingnesses.
(iii) Direct Recruit Asstt. Commissioners are not being
posted to Directorates and non-sensitive seats which requires a serious thought
whether it is under some plan. There seems clear disparity and partiality
between the transfers of Direct Recruit officers and Promotee officers.
(iv) Officers have been posted to the zones which they
didn’t opt. This defeats the purpose of asking willingnesses/options.
(v) There seems no transparency in orders as well as
cut-off date.
(vi) Officers have been posted from one Directorate to
another Directorate against willingness.
(vii) Many officers, already posted at other zones
after promotion, have again been posted to another zone for which no option has
been given. If the placement committee was not willing to consider their
representations to post them to parent zone, they should at least have not been
moved to another zone.
(viii) One officer has been posted to DG Systems,
Delhi from CGST Ghaziabad even after one year without any request given by him
for any transfer. There may be many other such cases who have been moved after
one year as per willingness or against willingness.
(ix) The officers having left less than three years of
service have not been posted to their parent/home/requested place whereas
the cases like Sh. Tirthankar Pyne (S. No. 110, Employee Id 10879) are enjoying
home place since their promotion by not being transferred to outstation despite
of having pretty more than three years service left. He has recently been
transferred to DGGI, Kolkata from DG, Systems, Kolkata. Thus, the purpose of
asking for options/willingnesses has been defeated and influential officers got
desirous postings/places.
(x) Working Spouse cases have not been considered.
(xi) The cases of wards studying in board classes (X
and XII) have not been considered.
(xii) There may be many more deviations/errors, if
scrutinised seriously and deeply. The Association as well as officers were
hopeful that CBIC transfer guidelines and various DOPT guidelines would duly be
considered.
3. In view of above, it is very mush requested to kindly
reconsider the options given by the officers to give due benefit to them accordingly.
If considered necessary, fresh options may also kindly be asked from the adversely
affected officers by giving due consideration to CBIC as well as DOPT
guidelines.
