Sub: DPC for the post of Asstt. Commissioner.
Sir,
Kindly refer to the earlier
representations of the Association about the continued delay in convening the
DPC for the post of Assistant Commissioner.
2. It is again submitted with due regards
that a significant number of officers are retiring every month without
promotion despite of thousands of vacancies existing in the grade of Asstt.
Commissioner. The most of the Asstt. Commissioners are also already holding multiple
charges.
3. The Association was given the
understanding that the DPC was held in abeyance due to the court case pending
in the Hon’ble CAT, Mumbai. Now, the final verdict in the matter has come.
4. As far as another case namely Ashok
Kumar vs. Union of India (OA No. 4762/2024) pending before CAT,
New Delhi, it is submitted that the promotions to the post of
Assistant Commissioner are made from the following three feeder streams:
(i) Superintendent of Central Excise
(ii) Superintendent of Customs (Preventive)
(iii) Appraisers of Customs
5. The promotions are affected by a ratio
of 13:2:1. Therefore, the pendency or legal challenge
involving one feeder stream does not and should not affect the
filling of vacancies for another stream. It has also already happened at least
twice in the past. So, as on date, there seems no hindrance to convene the DPC to
promote regularly retiring Superintendents of Central Excise.
6. As your goodself already knows that the
DPCs for vacancy year 2024 & 2025 are still pending, which should have been
conducted very well before the month of respective January of the concerned
year. Therefore, it is requested that the DPC may kindly be conducted at the
earliest taking into consideration all vacancies for the vacancy years 2024
& 2025 as our officers are forced to retire regularly without promotion
with no fault on their part for the want of timely DPC.
7. It is also requested that the DOPT OM
NO. 28036/8/87-ESTT. (D) Dt. 30.03.88 may kindly be used to affect ad-hoc
promotions, if still any court injunction or seniority dispute exists.
