Minutes of the 10th Convention & General Body Meeting held at Jaipur on 21.07.12 to 22.07.12

The meeting was organized by the Jaipur Unit in a grand manner. Sh. Ajesh Kumar, IRS, was the Chief Guest of the meeting. The Chief Guest addressed the gathering stressing the need of sufficient promotional avenues for the officers. S/Sh. Susheel Kumar Pareek, Ravi Malik, C. S. Sharma and N. R. Manda were honoured by Jaipur Unit. The officers like S/Sh. Vimal kumar (Meerut), Kiran Pandit (Pune) and A. K. Singh (Patna-Ranchi-Jamshedpur) able to enter group ‘A’ were also honoured.
S/Sh. Sushil Pareek (President), Ravi Malik (Secretary General) and S. P. Siddhanta (former Secretary General) also addressed the house. S/Sh. Sushil Pareek and Ravi Malik welcomed the delegates and apprised them about the developments in the cadre related issues. The Secretary General apprised the house about the current status of the cadre restructuring. Sh. Lokanath Mishra, being the senior most Vice President, was invited to come to dais and take seat.
The agenda was started with the presentation of the report of the current body, audit report & accounts and also arrears of subscription. The minutes and the decisions taken in the Ludhiana AEC meeting held on 16.07.11 to 17.07.11 as well as the Associate Committee Meetings held at Delhi on 16.10.11 and 29.04.12 were also circulated. All the agenda points were also discussed during the discussions on the report.
Sh. Vatan Kamble, the General Secretary of the Aurangabad Unit, appreciated the report and asked the Association to keep it up. He also appealed all the delegates to support the Association in overwhelming manner.
Sh. Jitendra Singh, the President of the Ahmedabad Unit and also one of the Joint Secretaries (W) of the Association, appreciated the report. He also asked to expedite the point No. 3 and 12. It was replied that the points would be pursued to be expedited accordingly.
Allahabad Unit was not present during the discussions as they reported on next day.
Sh. V. Suresh Kumar, the President of the Bangalore Unit and also one of the Vice Presidents (S) of the Association, said on being termed the report as the “report of the existing body” that he was never consulted as the office bearer of the Association. He viewed it despite of him always being invited to attend every meeting, AEC as well as Associate Committee, alongwith other office bearers for due consultation, suggestions and discussions on various issues in the interest of the cadre. Not only it, he alongwith others was also asked to send constructive suggestions on mail and also requested alongwith other zonal office bearers to make the role of the zonal office bearers effective and active. He, however, made no comments on the other points of the report. It was replied that he was being consulted regularly through above mentioned process.
Sh. Sanjeev Sharma, the President of the Bhopal Unit, appreciated the report. He also asked for rectification of the seniority list. It was replied that the matter would be taken up accordingly on the basis of the representations to be made by the units/individuals. The units/individuals were requested to make due representations in this regard.
Sh. K. P. S. Rai, one of the Vice Presidents (C) of the Association, appreciated the report.
Sh. Niranjan Pradhan, the General Secretary of the Bhubaneswar Unit appreciated the report and thanked for the efforts of the Association to get cleared 3600 posts of AC+DC from DOPT. He said that it was an achievement to get so many posts to benefit our cadre promoting more than 2000 Superintendents of Central Excise despite of the drastic cuts made by DOPT. He also suggested to approach the PM (the then FM also) to speed up the matter. He also suggested to make some efforts for getting some cost recovery posts for the promotion of our officers. He also enquired what ratio was applied to the promotions made in the month of June, 12. It was replied that the old ratio of 6:1:2 was applied to the said promotions. He also appealed to all the delegates to help the All India Body by donating maximum funds. He also reiterated that our regular service should be counted from 1st July of the year following the competitive examination in the case of direct recruits and from 1st July of the select year in the case of promotee officers.
Sh. Boota Singh, the General Secretary of the Chandigarh Unit appreciated the report. He said that the work of Association was greatly improved by the existing body.
Sh. R. Chandramouli, the General Secretary of the Chennai Unit thanked to the Secretary General for solving even individual cases relating to the Chennai Zone. He showed his worry why the Board was delaying the implementation of Supreme Court order. He also wanted to know about the status of the Income Tax arrears case since 01.01.96, he was replied that CBDT was planning to file the appeal in the High Court. He also apprised the house that PAO of Chennai was objecting the time scale without any valid reason. He also requested to waive the subscription dues of Chennai Unit in lieu of the MACPS case filed by the unit in the Chennai CAT. He also apprised the house that the JCM meetings were not being held in Chennai.
Sh. M. Ramachandran, the General Secretary of the Coimbatore Unit opined that the grade pay of Rs. 5400/- PB2 and PB3 should be clubbed. He also stressed that we should get parity with our common entry counterparts.
Sh. P. C. Ajithkumar, the General Secretary of the Cochin Unit and also one of the Joint Secretaries (S) of the Association, showed his worry about non-grant of time scale in PB3. He also opined that more meetings should be held with the higher authorities to pursue the cadre restructuring.
Sh. Ravi Joshi, the Vice President of the Delhi Unit and also one of the Vice Presidents (N) of the Association, appreciated the report. He thanked the Association to make hectic efforts in the interest of the cadre.
Goa Unit was not present.
Guntur Unit was not present during the discussions as they reported later.
Sh. B. Vijaya Bhaskar Reddy, the General Secretary of the Hyderabad Unit, appreciated the report.
Sh. V. K. Sharma, the General Secretary of the Indore Unit, appreciated the report.
Sh. Sampat Rai, on behalf of the Jaipur Unit appreciated the report.
Kanpur Unit was not present.
Sh. Tirthanka Pyne, the President of the Kolkata Unit, asked why the Excise Day boycott programme was deferred. He was explained the circumstances under which the programme was deferred. He said that 2000 Superintendents of Central Excise would not be able to get promotion under cadre restructuring and also asked to pursue the point No. 12, 13, 18, 25, 28 & 50 of the report.
Sh. B. V. N. Tewari, the General Secretary of the Lucknow Unit, appreciated the report.
Sh. N. N. Lal of the Lucknow Unit also appreciated the report.
Madurai Unit was not present.
Sh. S. S. Chauhan, the General Secretary of the Meerut Unit, appreciated the report.
Sh. A. K. Sasmal, the General Secretary of Mumbai Unit, didn’t endorse the report.
Sh. B. N. Dongre, the General Secretary of the Nagpur Unit, appreciated the report. He also asked to pursue the point No. 16 of the report and also expressed his displeasure on the attitude of the authorities quoting that the former Member (P&V) didn’t visit their unit despite of the directions of the then Chairman to resolve an important issue relating to mass harassment to the staff.
Sh. Vijay P. Pagare, the General Secretary of the Nasik Unit, appreciated the report and asked to pursue the point No. 23 of the report. He said that the necessary measures should be taken for the safety of the Superintendents under ACES. He also asked to take the measures for the implementation of the Supreme Court order regarding recruitment rules as the time limit had already expired on 30.06.12.
Sh. B. K. Sinha, the General Secretary of the Patna-Ranchi-Jamshedpur Unit, asked to pursue the point No. 1, 2, 12, 16, 21, and 23 of the report.
Ms. Rekha Joshi, the General Secretary of the Pune Unit, asked to pursue the point No. 2, 16, and 23 of the report. She also asked for the waiver of the subscription of the Pune Unit in lieu of the Supreme Court case being fought by them. It was replied that the Pune Unit didn’t fight the case in consonance of the consent of the All India Body after the Bangalore meeting on the issue. It was very specifically mentioned by the Chair that Pune Unit kept not consulting the All India Body on the issue. They also didn’t consult the All India Body before filing the clarificatory I.A. for retrospective implementation of the new ratio of 13:2:1 giving the impression to the Board as well as Supreme Court of acceptance of the ratio formula by us despite of the fact that any of ratio formula is detrimental to the interest of our cadre. They didn’t also consult All India Body in the matter of filing contempt petition.
Sh. Anand Kishore, the General Secretary of the Raipur Unit and also one of the Joint Secretaries (C) of the Association, appreciated the report.
Sh. G. K. Jhala, the General Secretary of the Rajkot Unit, appreciated the report. He said that now time would start to get results of the efforts made by the Association.
Sh. Probir K. Sen, the General Secretary of the Shillong Unit, appreciated the report. He opined that we should also be granted time scale in PB3 and CBEC should implement the Supreme Court verdict without delay.
Sh. Jas Ram meena, the General Secretary of the Surat Unit, appreciated the report.
Sh. Raja Climax, the General Secretary of the Tirunelveli Unit, appreciated the report.
Trichy Unit was not present.
Sh. J. Vedehsur, the representative of the Tirupati Unit, appreciated the report.
Sh. S. K. Jha, the President of the Vapi Daman-Unit, appreciated the report. He thanked the Association on result-oriented interference in the transfer/posting matter of the zone.
Sh. Chetan Pawar, the President of the Vadodara Unit, appreciated the report.
Sh. Ajay, the representative of the Vizag Unit, appreciated the report.
The audit report and the statement of the accounts upto 30.06.12 were also place before the house. The report of the current body, audit report & statement of accounts were accepted, approved and cleared by the house. The minutes and the decisions taken in the Ludhiana AEC meeting held on 16.07.11 to 17.07.11 as well as the Associate Committee Meetings held at Delhi on 16.10.11 and 29.04.12 were also accepted and ratified by the house.

Subscription & funds
Sh. N. R. Manda, the Treasurer of the Association, presented the details of the subscription dues & arrears requesting all the Units to clear the same. He also appealed all the units to donate maximum funds to the Association and also clear the funds as promised in Chennai AEC meeting.

Resolutions passed & decisions taken
The following resolutions were passed and decisions taken in the meeting-
1) The report of the current body, audit report & statement of accounts were accepted, approved and cleared by the house.
2) The minutes and the decisions taken in the Ludhiana AEC meeting held on 16.07.11 to 17.07.11 as well as the Associate Committee Meetings held at Delhi on 16.10.11 and 29.04.12 were accepted and ratified by the house.
3) The subscription of Pune Unit was waived for the period 2010-11 and 2011-12 in relation of the expenditure made by them in Supreme Court case alongwith the All India Body.
4) The subscription of Bhubaneswar Unit was waived for the period 2010-11 and 2011-12 in relation of the expenditure made by them in CAT case in relation of pay scale and arrears.
5) The subscription of Chennai Unit was waived for the period 2010-11 and 2011-12 in relation of the expenditure made by them in CAT case in relation of MACPS.
6) A committee was formed to look into the amendment of the Constitution of the Association to add the promotee IRS officers as the members. This committee will submit its report in the AEC meeting for the purpose of the final decision to be taken by the house on the issue. The following officers will act as the members of the committee-
            a) Sh. N. N. Lal from Lucknow.
            b) Sh. Niranjan Pradhan from Bhubneshwar
            c) Sh. Jitender Singh from Ahmedabad.
            d) Sh. A. S. Roy from Kolkata
e) Sh. B. A. Chakravraty from Chennai
7) A logo will be prepared for the Association for the purpose of mentioning it on letter head.
8) The office bearers of the units as well as All India office bearers should be posted to the respective headquarters of the Association.
9) It was unanimously decided that we would join JAC for common agitational programme with our own charter of demands in case of any conflict in the charter.

Elections
            Elections were also held on 22,07,12 to elect the new body for the Association. Sh. S. P. Sharma, the Deputy Commissioner posted in Jaipur Commissionerate, acted as Election Officer. The result of the elections is as under-
1) Sh. Ravi Malik, the existing Secretary General, was again elected un-opposed as Secretary General for the next tenure.
2) Sh. Lokanath Mishra was elected as the President.
The result for the posts of the Vice-Presidents and Joint Secretaries is as under-

Sh. C. S. Sharma & Sh. N. R. Manda were nominated as the Office Secretary & Treasure respectively again for the next tenure by the Secretary General.
After declaration of result of election, the new office bearers were introduced to the house. Then the house assembled for a short period. The Mumbai Unit suggested that our Association should join JAC  and this was supported by Klokata Unit. It was unanimously decided that we would join JAC for common agitational programme with our own charter of demands in case of any conflict in the charter.
