All our members are once again requested to carryout the agitational programme communicated in totality.
We have interalia demanded for Grade Pay of Rs.5400 in PB-3 w.e.f 01.01.2006 to all Superintendents of Central Excise and Time scale in PB-3 on completion of 4 years service as Superintendent , Stagnation to be reduced to less than 4 years for induction to Group-A in STS ( DC) grade directly, 3rd MACP & 2nd MACP should be Grade Pay Rs. 7600 in PB-3 & 6600 in PB-3 respectively, Parity in matter of career prospects of (Group-B) Inspector along with Examiner of Customs and other counter parts duly removing regional disparity in promotions, creation of separate service to maintain all India seniority list for Inspectors, introduction of in situ/ time bound promotional scheme to grant 4 promotions to all Inspectors of Central Excise in their entire service career, those have completed 8 years as Inspector and 20 years as Inspector and Supdt. combinedly should be upgraded to the post of Supdt and AC respectively, immediate DPC against existing vacancies in the cadre of AC, regularization of adhoc promotions pending since 97 on revised ratio as per SC decision dated 03.08.13, three upgradations under MACP should be post based like ACP scheme, provision for proper infrastructures to all offices with a provision of sitting arrangement as per prescribed norms, granting of pay scale of 2000-3200 & 6500-10500 to the cadre of Inspector w.e.f 01.01.86 & 01.01.96 respectively, granting of pay scale of 2200-4000 & 8000-13500 to the cadre of Superintendent w.e.f 01.01.86 & 01.01.96 respectively, immediate approval of CR of CBEC as cleared by FM & CR must be conducted in every 4 years block like CSS etc.etc..
However recently the Committee of Secretaries has cleared the CR proposals of CBEC on 27.08.13.The new strength approved by such Committee is as below-

By such approval our stagnation issue will not be solved unless our all demands are redressed by Govt. immediately. It is also required to convert all temporary posts of 2118 as proposed by COS on 27.08.13 to permanent. Therefore to put pressure on CBEC it is required to conduct agitation. As per the decision of AEC meeting held at Patna during May 2013, we have served notice upon FM to conduct mild agitation for wearing black badges and conducting lunch hours demonstration.
All the unit Secretaries are requested to submit notice(s) to the respective Chief Commissioner(s)/ Commissioner(s) enclosing the notice served by SG to FM. Regional Office Bearers and Unit Office Bearers are requested to conduct meeting(s) at different places of their jurisdiction to motivate our members to participate in the agitation to be held on 04.09.13 and try to make it a grand success. Press release should also be made by all Units before and after the agitation to be conducted on 04.09.13. All the unit Secretaries are requested to appeal all other local Associations to join with us in the agitation to be conducted on 04.09.13 , they are free to add their charter of demands pertaining to local issues along with our demands also .

CBEC
wants to start the exercise/home work of promotions from group B to
group
A immediately in accordance of the CR proposal approved by CRC on
27.08.13. The list of the officers, whose ACR dossiers & vigilance
clearance etc. are required, will be issued very soon. Volunteers are required from our officers throughout India to work in HRD at Delhi
to look after the work of compilation & monitoring of these
ACR dossiers & vigilance clearance etc. All the units & members
are requested to come forward for this work, at least 2 officers from
each zone. Two officers from Cochin Customs have already shown their
willingness to our Association for this work. Particularly
the names of the officers, whose families are settled in Delhi or who
wants to come to Delhi due to their prevailing
circumstances/compassionate grounds, may kindly be forwarded to All
India Body immediately. Other interested officers, including those who
are on the verge of promotion, may also play an important role in the
matter based on the precedent of Mr. Zulu who came to Delhi from
Hyderabad for DPC work of last promotion orders of Superintendent to AC.
It is required to expedite the work of promotion from group B to group
A, particularly keeping in view the large number of monthly retirements
of our officers. So, kindly don't hesitate to come forward treating the
matter as the MOST IMMEDIATE.

The copy of notice dated 22.07.13 served upon the FM by SG to conduct agitation on 04.09 .13 by all our members has already been placed on our website. It is therefore necessary that all units should ensure that no stone is left unturned to make the agitational programme a grand success .
The SG has already clarified that -" Letter to FM dated 22.07.13 in itself is the notice
because it has been served w.r.t. earlier notice bearing clear subject
of revival of Satyagraha. It is not fresh agitation but the old one is
being revived referring earlier communications addressed to FM in this
regard. The language is very clear & specific as below-
"In view of the above, it is intimated that the Satyagraha programme WOULD BE REVIVED with bearing of black badges and observing lunch hour Shantigoshthis (peaceful meetings) before the offices of the respective Commissioners & Chief Commissioners by our officers on 04.09.13 throughout India"
It is clear from above that the action to be taken (instead of intention) has been expressed.
"It was decided that first persuasion should be made to achieve OUR GOALS. ------ If persuasion is failed, the agitation is to be conducted in phased manner starting from mild programmes such as WEARING OF BLACK BADGES AND CONDUCTING OF LUNCH HOURS DEMONSTRATIONS ETC"
It is clear that "our goals" including cadre restructuring were to be demanded. Cadre restructuring is already the very first point in the agenda, charter has not been changed because the programme is only the continuation of already declared one. Moreover, no programme is observed based on only single point because we can't observe independent programmes on every point. All important points/goals are always to be included in the charter. As far as cadre restructuring is concerned, now it is expected that it is going to be cleared later or sooner in the form of as approved by FM. So, we have to concentrate on other points also particular relating to parity with other common entry counterparts already attaining the PB4 levels easily. No doubt that thousands of our Superintendents would enter group 'A' as a result of the ongoing cadre restructuring but it is also true that we are not going to attain PB4 levels by it. However, the pending grievances have only been mentioned to reflect their inaction and make due pressure on them".

Yes
friends, it can happen but only by an effective, united and complete
agitation forgetting all the vested interests. So, all the units, office
bearers and members are again requested to be well prepared not only
for the programme of 04.09.13 but also for stronger programmes in
future.
In accordance with the letter dated 26.07.13 of
Honourable Shri V. Narayanaswamy , MOS(DOPT) addressed to Honourable
Shri P.L.Punia, MP , the DOPT has submitted the note on 12.07.13 to
Cabinet Secretary with reference to the CR proposal of CBEC for
convening COS meeting for clearance and finalization of such
proposals by Committee of Secretaries.
In fact in such note of DOPT , particularly relating to removal of
stagnation as existed in all the cadres of CBEC ( except Gr-A) is
not an encouraging one to address the stagnation head-on and another
area which will further add up to the woe is implementation part.The
meeting of the Group of Secretaries is not going to be conducted
during August on the ground that the Parliament is in session. From
the letter of MOS(DOPT) it appears that CBEC has not submitted any
proposal to DOPT for removal of the stagnation problems as existed in
our cadres. Hence
at present we have no other alternative except to opt for agitation. I ,
there fore appeal to all our friends to join in the agitation to be
conducted by members of our Association on 04.09.13 and make the same a

3) I, on personal
level, is also in support of the strongest
programme. The notice of mild programme has only been served as per the
decision of Patna meeting as also clear under para 1) above. However,
nothing is better than the strongest possible programme provided all the
units are actually in the position of observing the same in actual
spirit instead of paper spirit. There is no problem for Kolkata and many
of other units but there are many units which even don't serve the
notice to local authorities or start talking about Conduct Rules or
observe the programme only for formality. Only effective & complete
programme would be any help of us to give proper message to them.
However, suggestions would be asked from the units and office bearers or
the programme would be observed in some other manner in the future to
make it effective despite of minimum participation like gathering before

CADRE RESTRUCTING OF CBEC & ITS PRESENT POSITION.
T he Central Board of Excise and Customs submitted initially a proposal
for creation of around 3900 nos. of Gr-A posts. The DOPT with
discussions with the then FM reduced the proposals to around 2500 nos of
Gr-A posts. Most of the staff Associations ( except AIACEGEO) were not
interested on such increase of Gr-A posts for the simple ground that CR
is for IRS officers only. However The All India Association of Central
Excise Gazetted Executive Officers (AIACEGEO) started agitations and
put pressure for creation of more nos. of Gr-A posts in course of the
ensuing CR. Due to such pressure and agitation, FM agreed to create
around 3400 nos. of Group -A posts . Finally the Committee of
Secretaries headed by Cabinet Secretary have cleared for creation of
3360 nos. of Gr-A posts in CBEC on 27.08.13. The proposal now will be
placed before next meeting of Cabinet for approval. Thanks to leaders of
AIACEGEO who took initiative for increase of such Gr-A posts. The break
up of such 3360 nos. posts are furnished below:

Subject: CR vs agitation-- Message From: Ravi Malik SG/AIACEGEO to conduct agitation on 04.09.13.
Dear friends,
Namaste and A VERY HAPPY & SPECIAL JANMASHTAMI to all members & office
bearers (all India as well as units) alongwith families.
2. No doubt that it is historic success of we all and our
Association to get cleared thousands of promotional posts for our officers by
Cadre Review Committee when even hundreds of promotions were like a dream. Now,
it is expected that CR would also be cleared soon by the Cabinet and our
thousands of officers would be able to enter group ‘A’. Now, it seems that the
new strength at AC/DC level might be 4168 (2050 permanent & 2118 temporary
for 5 years) + 250 reserved pool. Around 400+ vacancies may also be available
due to cascading effect on account of promotions at higher levels. All of
temporary posts may be used only for the promotee officers for next 5 years
after filling these in one go at the time of implementation. Permanent posts
may be distributed between directs & promotees. However, the things will
only be confirmed after the issuance of the minutes of the meeting.
3. But it’s only a beginning, it’s not our final aim. Our aim
is to retire our officers in PB4 like our common entry counterparts by getting
parity with the best placed common entry counterpart. If group ‘A’ officers can
get it, we can also get it but it will depend on the gravity of the united
efforts to be made by us in the future.
4. In the remote past, not only our direct Inspectors but
also our promotee Inspectors were able to attain the level of Commissioner. Not
only it, the previous Chairman has already admitted in a meeting with the
Association during his stint as the Member (P&V) that our promotee
Inspectors also reached the level of Member of CBEC. During one another
meeting, one of the lady office bearers of IRS Association admitted that even
our Sepoy had reached the level of Commissioner. Our Counterparts of CBDT &
CSS are already reaching the level of Commissioner & Joint Secretary and
all of them are retiring at the levels of ADC & Director (both PB4 posts).
5. The parity (functional or even only financial) with our
common entry counterparts is very well possible by adopting the measures like
below-
a) time bound promotions/scales (time scales after every 5 years for us were also recommended by CBEC to
6th CPC but the same is now being back tracked by them),
b) notional promotions,
c) creation of supernumerary posts,
d) creation of separate service (it was also recommended by CBEC to 6th CPC for us but now it
is also being back tracked by them),
e) direct promotion to higher post/s (Customs Ministerial officers
are being promoted to the post of Customs Appraiser without working for a
single day on the post of Customs Examiner),
f) in-situ promotions (requiring
no creation of posts),
g) batch to batch functional
upgradation at par with best placed common entry counterparts like CSS etc.
and/or
h) any other specific measure/s including batch to batch non-functional upgradation at par with best
placed common entry counterparts like CSS etc. also requiring no creation of
posts on the lines of DOPT OM No. AB.14017/64/2008-Estt.(RR) dt. 24.04.09
granting NFU to other group ‘A’ officers at par with IAS and
i) re-framing the recruitment rules
without trifurcating the single cadre of Inspector/Superintendent and prescribing
the qualifying service in consonance of the DOPT
OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 which stipulates the promotion
of the grade of Inspector to the grade of Joint Commissioner, Additional Commissioner
& Commissioner after completion of 12, 17 & 20 years of service
respectively. The validity of this OM was also admitted by CBEC during
the presentation of cadre restructuring proposal on 18.01.11 but they showed
their inability to implement it due to the want of the required number of
vacancies/posts. Therefore, the officers may even be granted in-situ promotions
after prescribed service also requiring
no creation of posts independent of cadre restructuring.
6. So, Dear Friends, we have not to show any complacency
regarding our agitational programmes. I have received the message for service
of notice to the local authorities only from two units for 04.09.13. All other units are requested to
serve the immediate notice to their local administration for 4th
September. No doubt, it is a light programme but we have to be ready for
stronger programmes in future. We have not to forget that the immediate key for
redressal of all of our grievances is only the strong agitation. So, be ready
for immediate action. The cadre restructuring will enable only around 7% of our
officers (including Inspectors & Superintendents) to enter junior group ‘A’
in comparison to our above mentioned counterparts, 100% of whom are already
entering PB4. Even the cadre restructuring is yet to be cleared finally by the
Cabinet and then be notified & implemented.

The All India Association of Central Excise Gazetted Executive Officers , the organization representing about 11,800 Gazetted Executive Officers of the Central Excise, Customs and Service Tax Department,
has embarked upon an agitation programme from 25/09/2012, demanding
immediate approval of Cadre Restructuring proposal of CBEC without any
cut as cleared by the Honourable Finance Minister and Department of
Expenditure, implementation of Apex Court Order dated 03.08.11
retrospectively as per judgement, granting of GP-5400 in PB-3 to the
grade of Superintendent of Central Excise w.e.f 01.01.2006 ,
introduction of in situ scheme to remove stagnation etc.. The department
is already facing acute shortage of manpower both at the staff and
officers level, especially at the cutting edge level i.e. Assistant
Commissioners who are playing a very crucial role in revenue collection.
Near about 8000 nos. of Superintendents have
completed 30 year of services as Inspectors and Superintendents
combinedly at present and waiting for their promotion to Gr-A. The
Inspectors who are joining in the department as direct recruit are
retiring by getting one promotion to the grade of Superintendent in
their service career. Whereas those similar placed employees who are
joining in Income Tax department or in CSS or as Examiner in Customs are
getting almost 5 to 6 promotions in their service career, While 1992
batch Examiners are being promoted to the grade of Asst. Commissioner,
the 1975 batch Inspectors are still Superintendents and are being forced
to work under the 1992 batch of Examiners who are quite juniors to
them in service. The parity is the basic concept of our Constitution,
parity in promotion is required to be maintained amongst the similar
placed employees of same department, but till date the Govt. of India
have not initiated any action to maintain parity in promotion amongst
the Examiners/Preventive Officers and Inspectors of CBEC . The
educational qualification, mode of recruitment and Grade Pay for these
post are similar. The Examiner, Preventive Officers and Inspectors are
being recruited by the same examination conducted by Staff Selection
Commission.
Recently the Honourable Apex Court have decided for revision of recruitment Rules and making regularization of pending adhoc promotions since 97 on the basis of such new recruitment rules, but Govt. of India made contempt of the said order dated 03.08.11 by not regularizing the pending adhoc promotions on the basis of said new amended /revised recruitment rules retrospectively. Whereas in past in a similar occasion Govt made adhoc regularization with retrospective effect to allow benefits to the officers of the Customs wing. Major revenue of Govt. of India are being collected through CBEC. Inspectors and Superintendents are basically responsible for collection of such major revenue. But these officers are not being awarded at least two promotions in their service career and are not being granted with appropriate pay as has been granted to similar placed employees of Central Govt.
Considering the utter frustration of
Superintendents who are languishing without any promotion for around
18/20 years and being forced to work under their natural juniors by 17
years, AIACEGEO had served a notice dated 22.07.13, on the Finance
Minister of India informing
that the Satyagraha programme would be revived with bearing of black
badges and observing lunch hour Shantigoshthis (peaceful meetings)
before the offices of the respective Commissioners & Chief
Commissioners by our members on 04.09.13 throughout India, if nothing
positive happens in respect of the charter of demands and other staff
grievances. As the Govt. failed to redressed all the genuine demands, AIACEGEO
is constrained to adopt the agitation with
bearing of black badges and observing lunch hour Shantigoshthis
(peaceful meetings) before the offices of the respective Commissioners
& Chief Commissioners by all its members on 04.09.13 throughout

The Gazetted Executive Officers posted in entire 124 Commissionerates have confirmed their participation in the strike action. The strike is organized by the All India Central Excise Gazetted Executive Officers, New Delhi on the basis of the strike notice served on 22.07.13 to Finance Minister of India for a settlement of the 10 Point charter of demands.. The Gazetted Executive Officers of throughout the country are mainly agitated over the delay in approval of Cadre Restructuring proposals of Central Board of Excise and Customs and cleared by the Honourable Finance Minister & Department of Expenditure since long. It is required to approve Cadre Restructuring in every 5 years but only one cadre restructurings was approved during 2002 by Central Government for this old Department . There are near about 12000 Gazetted Executive Officers working in Central Excise, Service Tax and Customs Department but all most all of these Gazetted Executive Officers are retiring without getting promotion to Gr-A posts. The Gazetted Executive Officers known as Superintendent of Central Excise are retiring after getting only one promotion in their service career on account of decades long acute stagnation. They are deprived of the appropriate pay scale/pay band & grade pay. They are facing the worst career prospects and working conditions. The employee grievance redressal mechanism has totally failed as the administration has no interest to redress the staff grievances. The Gazetted Executive Officers of Central Excise are forced to work under the extreme juniors of Customs belonging to the same cadre. The cadre restructuring is pending with the government for last 7 years. The concerned authorities are taking nothing seriously in relation of any of the issues. In view the above, the Association is forced to decide to revive the agitational programme .
Inspectors & Superintendents despite their honesty and dedication to duty, are being suffered a lot during their service career from the hands of stubborn and egoistic IRS officers without marching ahead to lowest rung of Gr-A posts. It is known to every one that these IRS officers are famous to harass their subordinates .
It is worth to mention that the DOPT Minister as well as the Chairman of SC Commission and the Member of Parliament Sh. Jafar Ali Naqvi alongwith other VIP’s have already shown their agony regarding the career progression of group ‘B’ Central Excise Executive officers but our own CBEC seems to be least concerned regarding this. After restructuring, the dirct recruitee IRS officers and Examiners/Appraisers will get fast and premature promotions and the sense of responsibility will be eroded rapidly. All the IRS officers are very jubilant and no one is bothered about work and output.
The present RESTRUCTURING of the Income-tax Department is a wonderful episode. Much of the elite people are wondering, as to how the top officers of the Department succeeded in making a fool of the Political Masters and IAS Secretaries in getting their approval and sanction for the restructuring. The ITGOA feels that they have been cheated by the top officers of the Department, and therefore they have already started agitation aginst the approval of present CR. In the last week of May, 2013 the Cabinet has approved new restructuring of the Income tax department. This restructuring has already created chaos and this will not cultivate a sense of honesty, dedication to duty, responsibility and public service.
In the other hands much of the elite people are wondering, as to how the top officers of the CBEC are unable to succeed in making convince the Political Masters and IAS Secretaries like CBDT in
getting their approval and sanction for the restructuring of CBEC to
remove the stagnation existed in the subordinate cadres particularly in
the cadres of Inspector and Superintendent. In the last CR only 586
nos.of Gr-A posts were sanctioned for CBEC where as around 1400 nos.GR-A posts were sanctioned for CBDT for which
one Inspector of Income Tax can easily get promotion up to the cadre of
Commissioner , where as one Inspector of Central Excise can not join in
lowest rung of Gr-A posts in his service career due to less sanction of Gr-A posts for CBEC and faulty HR policy of CBEC. Because of such faulty HR policy of CBEC, ITGOA has stated recently that CBEC is Inspector
oriented deprtment and CBDT is officer oriented department. Parity is
the basic concept of the Constitution of India. Parity in promotion is
required to be maintained along with the similar placed employees. CBEC
has never adopted any policy to award promotion to the cadre of
Inspector of Central Excise either at par with Inspector of Income Tax
or at par with Examiner of Customs. The CBEC has also not adopted any
policy for removal of regional disparity in promotion as existed within
the cadre of Inspector of Central Excise. The Inspector raj has already
been abolished hence like CBDT, CBEC should be officers oriented
department. Therefore CENGO INDIA appeals to all the employees of Central Excise, Customs and Service Tax Department to join in the agitation to be conducted on 04.09.13 by AIACEGEO and try to make it a grand success. The Satyagraha may be continued by
AIACEGEO in the form of gatherings before the residences of higher
authorities, mass casual leaves, strike etc. after its revival on
04.09.13, if the concerned authorities show no seriousness to devise the
measures for our officers to grant them parity with their common entry
