Sub: Presentation of roses to CCA’s on Excise day.


Dear friends,
good morning.
                As reported, the programme of 12.02.14 & 13.02.14 was not observed by many units. It may be perhaps due to time constraint or not having the habit of opening the mails daily. All are again requested not only to open the mails but also go through cengoindia.blogspot.in daily for updation. We all have also to understand that we can achieve our goals only by strong, effective & united agitation, otherwise there is no hope for us. Our goal is not to retire merely as AC but it is to enter into PB4 like in remote past and like other counterparts at present.
                The copy of the Notice served upon the FM with copy to other authorities is posted below which is self explanatory. All the units have to present the roses (2 or 3 in bunch) to the respective CCA's on Excise day. The presentation as posted below  is also to be enclosed with the roses to present it to the CCA. We have to act immediately and defeat the time.

2. As you know, it is submitted with due regards that the celebration of Central Excise day was started on the demand of Central Excise executive staff. But very unfortunately, nothing is left to celebrate in the life of these poor officers in relation of career, pay or any other service matter. Despite of total demoralisation, disappointment, job dissatisfaction, demotivation & frustration, the revenue targets are regularly being achieved above the set goals by the sincere efforts of these officers, i.e., Superintendents & Inspectors of Central Excise. Under the present circumstances, these officers are forced to retire at a PB2 post after only one promotion in the service career while their common entry counterparts are easily enjoying PB4 levels after getting 5-6 promotions. These officers are getting promotion (if any) merely to Junior Time Scale while their counterparts of CPWD, CSS etc. to Senior Time Scale. The employee grievance redressal mechanism has totally failed. These poor officers are also forced to work under the extreme juniors of Customs belonging to the same cadre. If career prospects were disclosed at the time of recruitment, these officers would have never joined this job. Instead of taking some positive measures in r/o of their career prospects, the CBEC is planning to increase the residency period and reduce the promotion quota for these officersto limit them within the post of Superintendent.
3. Nobody is worried about this actual workforce of CBEC. The direct IRS officers have been ensured upto 9 promotions to upgrade them within the standard residency periods prescribed by DOPT by creating the posts at Apex, HAG+ etc. levels in higher scales even without availability of the eligible officers but no measures are being taken for the Central Excise Superintendents & Inspectors to promote/upgrade them within the standard residency periods prescribed by DOPT. The Income Tax Inspectors and the Assistants of CSS under the Department of Revenue are also able to reach the post of Commissioner and Joint Secretary. The Central Excise Inspector, whether direct or promotee, was also reaching the level of Commissioner or above in the remote past but the things have been distorted in such a way in the CBEC that he/she is forced to retire merely on the post of Superintendent now barring 1%. The CBEC is even unable to conduct the DPC for promotions at prescribed intervals vide DOPT guidelines. Last DPC for group B to group A was conducted in June, 11 around 32 months ago instead of yearly basis with advance panel but nobody is worriedin CBEC about it. No seriousness is also being shown to implement the cadre restructuring already notified two months ago.
4. In view of the above, the Central Excise Cadre Controlling Authorities under CBEC will be presented roses on Excise day by the Association congratulating & wishing 9 promotions in the career and also the post-retirement membership/chairpersonship in any authority/commission/tribunal for all direct IRS officers throughout India. The next step/s will be intimated in the due course.

      Charter of demands
1. Immediate implementation of cadre restructuring.
2.Scheme to improve the career prospects of Central Excise Superintendents/Inspectors independent of cadre restructuringto retire them in PB-4 after gettingat least five functional promotions.
3. Next promotion of Central Excise Superintendent in STS like many other group ‘B’ gazetted officers.
4. A pay scale equivalent to the Grade Pay of Rs. 5400/- in PB3 to the Superintendent of Central Excise w.e.f. the date of the grant of the same to the counterparts of IB, CBI etc. alongwith other perks as being granted to the analogous counterparts of IB & CBI.
5. Non-functional time scale in PB3 instead of PB2 to Superintendents after 4 years of service.
6. Seniority benefit on promotion to group ‘A’ in lieu of the service rendered in group ‘B’.
7. Fulfilment of the commitments made during the presentation on cadre restructuring on 18.01.11.
8. Promoting all Superintendents completing 1.5 times of qualifying service on the lines of CSS.
9. Stop victimization of office bearers & members of Association.
10. Regularisation of ad hoc promotions based on the rules existing on the date of regularisation.
11. Undoing of the MACP irregularities.
12. Counting of regular service as per F. No. A/60/13/RTI/2006-Ad.IIIB Dt. 26.05.06 of CBEC.
13. Merger of group ‘B’ Executive non-gazetted as well as gazetted categories under CBEC into one.
14. Parity between the officers of headquarters organisations& field offices.
                            15. Conversion of temporary posts of Asstt. Commissioner to regular/permanent keeping the same intact for promotee officers forever.
16. Time scale after every 7 years to the officers after joining the job as Inspector.
17. Deletion of the clause in cadre restructuring notification that the officers promoted against the temporary posts of Asstt. Commissioner would not be entitled for further promotion.
18. No senior of Central Excise should work under the junior of Customs or CSS.
19. Minimal (like maximum upto 25%) direct recruitment of group A as also in the Indian Postal Service.
20. Share of promotion in group A meant for Central Excise to be kept intact to prevent its distribution among the officers of Customs.
21. Qualifying service/residency period in accordance of DOPT OM No. AB-14017/61/2008-Estt.(RR) dt.24.03.09.
22. Implementation of the CBEC circular issued vide F. No. A-26017/44/94-Ad II(A) Dt. 08.03.95 regarding arrears of pay.
23. Posting of Association functionaries at administrative/Association Hqrs office.
24. Batch to batch Non Functional Financial Upgradation to the Central Excise executive officers at par with the best common entry counterparts like CSS etc.
25. Creation of reserve pool posts.
26. Operation of vacant STS & above posts on account of want of eligible officers at JTS level.
27. Filling-up of all newly created/vacant posts alongwith vacancies to be cascaded downwards on account of promotions at higher levels in one go only by promotions like last cadre restructuring.
28. Filling-up of all posts of Asstt. Commissioner first from the Central Excise Superintendents only till all of Central Excise Superintendents of 2002 enter group A like Appraisers.
