Sub:o Prmotion orders against the DPC held
on 06.03.14 for the post of Asstt. Commissioner.
Madam,
Your
kind attention is invited to the para 11 of the letter
No. 437/6/2009-CC&BE Dt. 05.03.09 (copy enclosed) of the Election
Commission of India saying that regular recruitment/appointment or
promotion through the UPSC, State Public Service Commissions or the Staff
Selection Commission or any other statutory authority can continue during the election code.
2. It is further submitted with due
regards that the Association came to know about the permission of the Election
Commission being sought by the CBEC for the issuance of the subject-mentioned
orders. But as per the above mentioned letter of the Election Commission, regular appointments or promotions through the UPSC are not
hit by the model code of conduct and no permission is required in the
matter. The above letter has also been reiterated in the letter No.
437/6/1/2014-CC&BE Dt. 05.03.14 (copy enclosed) of the Election Commission
under para 5.

Principal Secretary to ECI, on phone. His phone number is 23710221.

In view of the above, it is requested that the promotion orders regarding the
subject-mentioned DPC may kindly be issued at an early date without further
delay, otherwise many more of our
officers will again retire this month without promotion. It is also requested
that the officers may kindly be allowed to work as Asstt. Commissioner at their
existing place of posting, if orders are issued on in-situ basis.
