Sub: Working on holidays.
Madam,
Kindly refer to the earlier
representations made to the former Member (P&V) on the issue and also to
your goodself vide Ref. No. 43/W/14 Dt. 26.02.14
by the Association.
2. It is submitted with due regards that the officers were forced to
work by two days extra (on holidays) per week in last financial year. They were
also forced to work one hour extra per day in Service Tax. Further, they were forced to work
continuously for 3 holidays in the end of the last financial year. It is also
well pertinent to mention that this forced work was taken from them without any
payment of salary for extra work or any other compensation.
3. Not only it, they are also being forced to work on holidays in
the Service Tax in the current financial year further without payment of any
salary or compensation. Not only it, routine orders have again been issued for
them vide letter F. No
296/42/2013-Cx.9 Dt. 14.03.14 of the CBEC to work on three last days of
the current financial year which are again holidays everywhere for 2 days and
somewhere for 3 days. This seems like taking forced labour from the officers. The sections unconnected with collection
of revenue like legal, technical, prosecution, adjudication, appeal, review etc.
in hqrs offices have also been directed to be open on these holidays which have
no role to help the collection of revenue.
4. Your kind attention is also invited to the fact that the fixed working
days/hours as well as holidays in the Central Govt. offices have been decided
by the Cabinet enabling the government officers to have due time for required
rest, relaxation and look after their families to dispose of their
personal/family related obligations. The Superintendents of Central Excise are
already totally demoralized & frustrated due to the lack of promotional
avenues, required working conditions, basic amenities, required facilities etc.
and also non-grant of requisite pay deals. Despite of this total frustration
& demoralisation, the revenue targets are being achieved above the set
targets only due to their sincere efforts. It is also worth to submit that no
authority below the Cabinet has any statutory power to change the Cabinet
decision.
5. It is also worth to mention that the officers are being paid for
the calculated hours/days per month. Forcing them to work for extra hours/days
without compensation/paying extra wages is no-way justified and is unlawful.
Such type of practice gives the only impression that we are living in an
undemocratic & inhumane system to suppress the subordinates instead of
living in the greatest democracy of the world meant for the people, by the
people and of the people.
6. In Puducherry Commissionerate, the officers have been directed to
work on holidays on 22.03.14 & 23.03.14 also. This is in addition to the
directives issued by the CBEC to work on 29.03.14 to 31.03.14 (all holidays
including one being a festival holiday namely Ugadi). Thus, all officers in
Puducherry Commissionerate will be working continuously for 19 days non-stop (from
17.03.14 to 04.04.14) in Puducherry Commissionerate and 13 days at other places
throughout India which will be a killing exercise in itself.
7. It is, therefore, requested that the said directives may kindly be
reconsidered as working non-stop for so many days is not contemplated even in
private organisations or in any of the labour laws. The officers may also kindly
be made the due payment for the extra work done by them in the last financial
year and being done in the current financial year.
