Madam,
It is submitted with due regards that the promotion orders of the equal
number of the serving officers are to be issued by implementing the
provisions of extended panel against the retired officers considered in the
DPC. But it seems that the orders of the equal number of serving officers
are not being issued by the CBEC against the retired officers considered in the
DPC. It is, therefore, requested to kindly provide the following information
under RTI Act.
(a) The names of the equal
number of the serving officers as on the
date of promotion order who have
been promoted to the post of Asstt. Commissioner against the retired officers, (b) number of the retired officers considered for DPC (c) total number
of vacancies, (d) total number of officers promoted & (e) the total number
of officers considered for DPC in r/o the following DPC’s/promotions-
i) Regular DPC held
for the 1979 onward promotions from group ‘B’ to group ‘A’ post of Asstt.
Commissioner based on the judgment
(originating the ratio formula of 6:1:2) of the Hon’ble Supreme Court. Kindly
also provide the information whether this DPC was effective for the promotions
from 1979 or 1980.
ii) Regular DPC held
against the post-1996 ad hoc promotions from group ‘B’ to group ‘A’ post of
Asstt. Commissioner in r/o the judgment
dt. 03.08.11 in CWP No. 385/10 of the Hon’ble
Supreme Court.
iii) Promotion orders issued in
October, 10 for group ‘B’ to group ‘A’ post of Asstt.
Commissioner.
iv) DPC conducted in the month of
June, 12 for the order No. 124/2012 Dt. 12.07.12 for the promotions from group ‘B’ to group ‘A’ post of Asstt.
Commissioner.
v) DPC conducted on
04.03.14 for the order No. 74/2014 Dt. 31.03.14 for the promotions from group ‘B’ to group ‘A’ post of Asstt. Commissioner.
vi) All other
DPC’s/orders
for the promotions from group ‘B’ to group ‘A’ post
of Asstt. Commissioner prior to October, 10 and afterwards.
The information
regarding the names of equal number of
the serving officers against the
retired officers considered in r/o of the above DPC’s and promotion orders
may kindly be specifically provided.

It is submitted, as you know, with due regards that the CBEC is far
behind the prescribed schedule of DPC’s for promotion from group ‘B’ to
group ‘A’ post of Asstt. Commissioner.
As on date, the CBEC is two panels behind the prescribed schedule. It is, therefore,
requested to kindly provide the following information under RTI Act-
i) The date of last DPC held as per the prescribed schedule (in the month
of preceding January of the relevant panel year) for promotion to the
post of Asstt. Commissioner.
ii) The names of the Central Excise Superintendents in r/o regular as well as extended
panel who retired without promotion to the post of Asstt. Commissioner for the
want of holding of timely DPC.
iii) The statutory
provisions/grounds under which the DPC’s
for promotion to the post of Asstt. Commissioner are regularly being
delayed.
