2. It is submitted with due regards
that Sh. P. L. Punia, the Hon’ble Chairman of National Commission for Scheduled
Castes, wrote to the Hon’ble DOPT Minister to devise the specific measures
independent of cadre restructuring for Central Excise Superintendents to grant
them parity with their common entry counterparts to enter into PB4 through time
bound promotions/scales, notional promotions, creation of supernumerary posts,
creation of separate service, direct promotion to higher post/s, upgradation of
posts, in-situ promotions (requiring no creation of posts) or any other
specific measures including batch to batch non-functional financial
upgradation. He has also reiterated for the timely cadre restructuring, next
promotion of Central Excise Superintendent to Senior Time Scale and to undo
working by them under their juniors of Customs recruited in same cadre. The
DOPT Minister has replied him to consider the specific measures, if proposal is
referred to DOPT.
3. Your goodself knows that our officers are retiring with
single promotion in the career. Sh. Punia has also reiterated that not only the general candidates but also
the reserved category candidates are
retiring after only one promotion in the service career of 35-40 years while
their common entry counterparts are getting 5/6 promotions retiring in PB4.
As also admitted by the CBEC in the Board meeting of 12.01.11, even the ongoing
cadre restructuring is unable to redress the problem. It is reiterated that
some of our officers will retire as Asstt. Commissioner on account of the
temporary posts created in the cadre restructuring but none of them will be
able to enter PB4 like their common entry counterparts.
4. In view of the above, it is requested that the due
proposal may kindly be sent to the DOPT to grant parity to our officers with
their common entry counterparts to retire them in PB4 taking the above measures
as asked by Sh. Punia. As reiterated by Sh. Punia, it is also requested that
the measures may kindly be taken to grant next promotion to Senior Time Scale
to our Superintendents, undo working by them under their juniors of Customs
recruited in same cadre and have timely cadre restructurings alongwith also
giving due compensation for undone ones.

that Sh. Lokanath Mishra, the President of the Association, is to come to Delhi
to attend the meeting of the Confederation of Central Government
Gazetted Officers’ Organizations. He wishes to see your goodself accompanied
with the undersigned and a few other office bearers to take up the following
issues-
a) Immediate DPC for the post of Asstt. Commissioner for
the panel years 2013-14 & 2014-15 and also for the vacancies in r/o cadre
restructuring.
b) Scheme to
improve the career prospects of Central Excise Superintendents/Inspectors
independent of cadre restructuring to enter them into PB-4.
c) Implementation of the CBEC circular issued vide
F. No. A-26017/44/94-Ad II(A) Dt. 08.03.95 regarding
arrears of pay.
d) Batch to batch Non Functional
Upgradation to the Central Excise Superintendents/Inspectors
at par with the best common entry counterparts like CSS etc.

2. It is submitted with due regards
that the minutes are silent on some issues and there are also a bit deviations
which require to be corrected. In this regard, the following point-wise
submissions may kindly be taken into kind account for necessary action-
Point
No. 1: The minutes are silent on the scheme to improve the career prospects of Central Excise
Superintendents/Inspectors independent of cadre restructuring to retire them in
PB-4 after getting at least five functional promotions. It was informed
in the meeting that HRD is already under process to bring a scheme for the
officers independent of the cadre restructuring.
Point
No. 2: Nothing was asked from the Association to submit. However, the copy of
the representation will be provided to the DG, HRD. The minutes are silent on
the non-functional time scale in
PB3 instead of PB2 to Superintendents
after 4 years of service.
The proposal for grant of time scale in PB3 was agreed to be sent to DOPT/Expenditure.
Point
No. 3: Board circular file F. No. A-26017/44/94-Ad II(A) Dt. 08.03.95 for arrears of pay was also agreed to
be located for necessary action.

Point No. 6: The minutes are
silent on the victimization of
office bearers & members of the Association. Same action, as regarding JCM meetings, was agreed.
Point
No. 7: The proposal to undo the
MACP irregularities was agreed to be sent to DOPT. It was also assured that the
reply to MACP court case would be expedited. The regular service letter was
decided to be examined for further action. No write-up was asked from the
Association. However, the Association will forward the detailed write-ups on
both the issues to the DG, HRD.
Point
No. 8: The issue of regional
disparities was also discussed and it was informed that the matter is under
examination and will be possible prospectively only.
Point No. 9: The period of 5 years
regarding temporary posts of Asstt. Commissioner was also agreed to be counted
from the date of the effect of promotion instead of date of notification.
Point No. 10: The Association will forward detailed write-ups on
both the issues to the DG, HRD.
Point No. 11: The
minutes are silent on the minimal
(like maximum upto 25%) direct
recruitment of group A. It was
decided that the Association will submit a separate detailed representation on
this issue. The rest of the portion was agreed to be withdrawn for the time
being only.
Point No. 12: The issue regarding batch to batch NFU at par with the
CSS was agreed to be sent to DOPT. The qualifying service/residency period in
accordance of DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 was also
agreed. It was also informed by DG, HRD that the proposal for qualifying
service for next promotion of Inspector as 2 years has already been sent to
DOPT.
Point No. 13:
The operation of vacant STS &
above posts on account of want of eligible officers at JTS level was decided to
be taken up after the implementation of cadre restructuring without any
condition of ‘after one year’.
Point No. 14: —
In addition to above points,
the Member (P&V) was also kind enough to assure of doing the needful on
Shillong issue of transfers.
3. In view of the above, it is
requested that the early steps may kindly be taken to redress all of the
grievances accordingly.
