Govt. of India, DoP&T O.M. No.
22011/5/86-Estt.(D), dated 10th
April, 1989 as amended by OM No. 22011/5/91-Estt(D)
dated 27.03.97- issued as consolidated instructions on Departmental Promotion
Committee . Para 3.1 stipulates as
under:-
“ ….. A vacancy shall be
filled in accordance with the recruitment rules in
force on the date of
vacancy, unless rules made subsequently have been
expressly given
retrospective effect. Since amendments to the recruitment
rules normally have only
prospective application, the existing vacancies
should be filled as per the
recruitment rules in force. Holding of DPC
meetings need not be
delayed or postponed on the ground that recruitment
rules for a post are being
reviewed/amended.”
Para 4.2.3 provides no
proposal for holding at DPC should be sent to UPSC until unless all the ACRs
complete and up to date are available. In creation cases involving collection of
large number of ACRs, the proposal can be sent only if at least 90% of the ACRs(
up to date and complete) are available.
Hence, now Board should
submit the proposal to UPSC to hold the DPC urgently.
