2. It is submitted with due regards that more than seven months have already expired after Cabinet approval and around seven months to the notification of the cadre restructuring but the DPC for the post of Asstt. Commissioner meant for the cutting edge officers is still awaited.
3. Very disappointingly, it is happening despite of the provisions vide the DOPT OM No. 22011/9/98-Estt. (D) Dt. 14.12.2000 to fix the responsibility for the lapse in adherence to the prescribed time frame in holding of DPC’s. It is well pertinent to mention that the CBEC is presently behind by 2 modal years in the matter. As a result; many unlucky officers, due for the rarest IInd promotion in the career of 35-40 years, have already retired and many more are retiring every month. Even the provisions of extended panel are unable to give any relief to the serving officers due to the delayed process. The consideration zone is also still pending with the concerned section.
4. Even more surprising & disappointing is that the CBEC has asked to include the names of the retired officers in the seniority list of the Central Excise Superintendents vide the letter F.No.A-26017/42/2014-Ad.IIA Dt. 30.04.14. It is really out of all understandings as to why the names of the retired officers should be included in the seniority list. All general prudence says that only the names of working officers as on date should be included in the seniority list to give promotion to the serving officers only because the retired officers have no right for promotion. It seems the negative tactics of the concerned section only to delay the process and with the intention to consider the maximum number of the retired officers to deny the benefit of the promotion to the serving officers.
5. It is also submitted that the ACR dossiers of more than 90% officers due for promotion have already been received by the CBEC from the field formations. The DOPT guidelines very clearly say that the proposal for DPC can be sent to UPSC, if 90% of the ACR’s are available in certain cases involving collection of large number of ACR’s
6. In view of the above, it is requested to kindly take immediate steps for sending the DPC proposal to UPSC for the post of Asstt. Commissioner without including the names of the retired officers for the DPC’s for the model years 2013-14 and 2014-15 duly including cadre restructuring posts/vacancies.
