Delay in the DPC for the promotion
to the post of Asstt. Commissioner.
Madam,
With due regards, your goodself was
pleased to assure the Association on 25.08.14 that the proposal for DPC for 421
regular posts would be sent to UPSC immediately. You were also pleased to
assure very specifically that proposal for 2118 temporary posts would also be
sent next week. But very unfortunately, none of the proposals has been sent to
UPSC till date despite of expiry of more than one month to kind assurance of
yours.

On account of regular retirements of our officers without promotion despite of
thousands of vacancies being in hand, it is very unfortunate that the promotion
process is being delayed for one reason or another. Timely relaxation was not
obtained for filling-up of temporary posts from DOPT and it was kept pending in
CBEC for more than seven months. Field formations were asked to add the names
of retired officers in the seniority list. Latestly, the seniority list was
amended resulting in revamping of the proposal of DPC. At the eleventh hour,
the changed strength being effective from1999 was communicated to one of our
zones resulting into last hour amendment of seniority list.

The decisions on the representations regarding seniority were not taken timely
despite of the repeated requests of the Association. At the nick of the time,
seniority was amended to delay the proposal further. The Association came to
know that some zonal authorities have now approached the CBEC for amendment of
the all India seniority list of Central Excise Superintendents based on one
reason or another. As a result, the DPC is being further delayed due to such
type of process/es on account of untimely action of concerned zones/CBEC.

In view of above, it is requested that the seniority matters may kindly be
resolved immediately based on relevant rules and sanction letter/s of Ministry
signed by the competent authority in r/o strength of the officers allocated to
various zones without delaying the promotion process further even for a single
day. Due justice may kindly be given to all zones/officers and no injustice be
done to any zone/officer in this regard. The Association expects and requests
that the proposal for all of the vacant posts of Asstt. commissioner be sent to
the UPSC during this week, if was not sent in the assured week.

Counting of the effective period for existence of temporary posts of Asstt.
Commissioner.
Madam,
Kindly
refer to the letter F. No. A-12018/01/2014-Ad.II Dt. 14.08.14 of the CBEC
regarding relaxation of DOPT to fill-up all temporary posts of Asstt.
Commissioner by promotion. The effective period for existence of temporary
posts of Asstt. Commissioner has been mentioned as 18.12.13 to 17.12.18 in this
letter.
2.
It is submitted with due regards that the Hon’ble Finance Minister has already
approved to count this period of 5 years only from the date of happening of
promotions to all of these posts instead of 18.12.13. The Association requested
all of the concerned authorities including CBEC to Finance Minister to count
the said period from the date of happening of promotions to all of these posts
instead of 18.12.13. But very unfortunately, the contrary thing has been
mentioned in the above referred letter of Section Ad.II of the CBEC putting our
officers to great injustice.

It is worth to mention in this regard that only the concerned section is
responsible for delay to make the promotions effective on the said temporary
posts without any fault of our officers. It doesn’t mean that all of these
posts would be abolished without making promotion, if the CBEC is unable to
conduct the DPC for 5 years. CBEC has already delayed it for more than 8
months.

In view of the above, it is requested that the effective period of 5 years for
the existence of the temporary posts of the Asstt. Commissioner may kindly be
counted only from the date of happening of promotions to all of these posts
instead of 18.12.13 as also already approved by the Finance Minister.

It is submitted with due regards that the minutes regarding the change in the
reward policy were issued vide F.No.296/03/2012-CX.9 Dt. 28.0313 by CBEC on the
basis of the decision taken to amend the reward policy in the Board meeting on
27.09.12. But the notification/OM/official order in this regard is still
awaited as a period of around 2 years is near to expire.

It is further submitted that a good number of officers are unable to get the
due rewards for the want of the issuance of the due notification/OM/official
order based on the minutes issued vide F.No.296/03/2012-CX.9 Dt. 28.0313.
4.
In view of the above, it is requested to issue the due order/notification/OM at
the earliest to enable the concerned officers to get the due reward
accordingly.
