            Madam,

2. It is submitted with due regards that the proposal of DPC for 421 regular posts of Asstt. Commissioner to be sent to UPSC was approved by your goodself on 07.08.14 but the same has not been sent to UPSC till date even after more than 1½ weeks of its approval by our highest authority. We are also not aware when the proposal for 2118 temporary posts would be sent to UPSC.
3. It is further submitted that the things are moving at very slow pace (slower even than the routine pace) w.e.f. 05.12.13 after the approval of the cadre restructuring by the Cabinet. The relaxation to fill-up all of the temporary posts of Asstt. Commissioner by promotion was taken from DOPT in this month only after more than 8 months of the approval instead of taking it immediately despite of large number monthly retirements of our officers without further promotion. Our officers are crying and going to home on the day of retirement cursing us like anything with tears of humiliation in their eyes but nobody seems to be moved. No time limit is being adhered to any issue and all of the things particularly relating to other than Group ‘A’ officers seem to be lingered-on for endless time. 2118 posts of Asstt. Commissioner were created particularly keeping in view the extraordinarily acute stagnation of our officers but no serious & specific efforts have been made by the CBEC to fill-up these posts forcing our officers every month to retire in the stagnated state despite of thousands of promotional posts being vacant.
4. Very disappointingly, it is happening despite of the provisions vide the DOPT OM No. 22011/9/98-Estt. (D) Dt. 14.12.2000 to fix the responsibility for the lapse in adherence to the prescribed time frame in holding of DPC’s. It is well pertinent to mention that the CBEC is presently behind by 2 modal years in the matter. The preparations for 3rd one should also have been started as per DOPT guidelines. Many unlucky officers, due for the rarest IInd promotion in the career of 35-40 years, have already retired and many more have been retiring every month. Even the provisions of extended panel are unable to give any relief to the serving officers due to the delayed process.
5. The chain vacancies on account of cascading effect from higher side are also required to be included for the promotion to the post of Asstt. Commissioner as per the DOPT OM No. 22011/9/98-Estt(D) Dt. 06.10.99. As far as the vacancy position as on 01.01.14 is concerned, it seems to be total 584 (Commissioner-39, JC/ADC-252, DC/AC-293).
6. Promotions have been affected to 108 posts of AC in the month of March, 14. Thus, effective VP comes to 476. Out of 108 promoted as AC, 26 are to retire in 2014-15. A total of 96 are also to retire from the existing strength of other Group ‘A’ in 2014-15 making the VP 598 (this would be increased by another 125 against deputations, if not included in the VP). To VP of 598, additional AC/DC posts of 500 in CR (300+200) are to be added making it to 1098, 50% of which workout to be 549. Further, 489 additional  posts  have been created in CR above the AC/DC level, the chain effect of which adds 245 more posts (50%) making the regular posts for promotion of Group ‘B’ to Group ‘A’ to 794 or 919 (if deputationists have not been included in the VP). It comes to be 3037 after adding 2118 temporary posts of Asstt. Commissioner.
7. It is clearly mentioned in the DOPT OM No. 22011/9/98-Estt(D) Dt. 06.10.99 that the existing and clear anticipated vacancies as well as chain vacancies on account of retirement, promotion etc. in all the higher grades/hierarchy should be included for the purpose of DPC.
8. It is also worth to mention that there is no requirement to get the DPC conducted by UPSC for ad hoc promotions as per the provisions. Because all of the promotions are being made on ad hoc basis, the CBEC is well empowered to conduct the DPC. A time bound mechanism is required to be adopted by the CBEC to conduct the DPC for the post of Asstt. Commissioner making answerable the concerned section/authority for the unwarranted delay. This is the proper time to fix the responsibility of the concerned authority for the lapse as per the DOPT OM No. 22011/9/98-Estt. (D) Dt. 14.12.2000. The Association may also kindly be allowed to know what the final date would be for holding of the DPC for the post of Asstt. Commissioner. If no time limit is adhered to conduct the said DPC immediately against all of the vacant posts including chain/anticipated vacancies, the Association will be forced to take necessary measures including legal recourse as per the DOPT OM No. 22011/9/98-Estt. (D) Dt. 14.12.2000, approaching higher authorities, agitational programmes etc.  
9. In view of the above, it is requested that the DPC for total 3037 (421+498+2118) posts of Asstt. Commissioner may kindly be conducted immediately without further delay particularly keeping in view the large scale regular retirements of our officers with single promotion in the service career despite of thousands of vacancies being in hand. It is also requested that the responsibility may also kindly be fixed of the concerned person for not being adhered to the prescribed time frame as per the DOPT OM No. 22011/9/98-Estt. (D) Dt. 14.12.2000.
