To,
The
Chairman,

Sub: Promotions to the post of Asstt. Commissioner in r/o cadre
restructuring and DPC’s for panel years 2013-14, 2014-15 and 2015-16 by CBEC.
Sir,
Kindly refer to the
Ref. No.
78/D/14 Dt. 15.04.14 of the Association.
2. It is further
submitted with due regards that the cadre restructuring of CBEC was approved by
the Cabinet on 05.12.13 but CBEC is unable to conduct the DPC to the post of
Asstt. Commissioner despite of large number monthly retirements of our officers
without further promotion. 2118 posts of Asstt. Commissioner were created
particularly keeping in view the extraordinarily acute stagnation of our
officers but no serious & specific efforts have been made by the CBEC to
fill-up these posts forcing our officers every month to retire in the stagnated
state despite of thousands of promotional posts being vacant.
3. It is well
pertinent to mention that the CBEC is presently behind by 2 modal years in the
matter. The preparations for 3rd one should also have been started
as per DOPT guidelines. Our officers are already crying and going to home on the day of
retirement cursing us like anything with tears of humiliation in their eyes.
4. It
is also worth to mention that there is no requirement to get the DPC conducted
by UPSC for ad hoc promotions as per the provisions. Because all of the
promotions to the post of Asstt. commissioner are already being made on ad hoc
basis, the CBEC may conduct the DPC itself.
5. UPSC is a Constitutional body
bearing its own Constitutional powers particularly in regard of the measures to
be taken for career prospects & promotion mechanism of group ‘A’ & ‘B’
gazetted officers. On account of your goodself bearing a Constitutional post,
our members are looking towards you for the rescue at the fag end of their
career. Your goodself seems the ultimate hope for their salvage. Even a little
use of your kind influence will be of great help to our sinking cadre of
Central Excise Superintendent and our officers will be ever grateful to your
goodself.
6. In
view of the above, it is requested to ask CBEC to conduct the DPC for ad hoc
promotions without involvement of UPSC. If the involvement of the UPSC is
inevitable, the CBEC may kindly be asked to send the proposal to UPSC
immediately without further delay particularly keeping in view the large scale
regular retirements of our officers with single promotion in the service career
despite of thousands of vacancies being in hand.
Thanking you,
Yours
faithfully,
(RAVI MALIK),
Secretary
General.
