Sub: Stagnation in Group ‘B’ executive cadre in CBEC.
Sir,
Kindly refer to the Ref. No. 153/S/14 Dt. 30.07.14 of the Association as well
as the meeting held by the Study Group on 31.07.14 with the various
Associations on the subject.
2. It is submitted with due regards that the various discussions were held in the meeting, the minutes for which are awaited. You were also pleased to ask the Association to make the submissions on the proposed pyramidal structure of the CBEC in r/o of the numbers at various levels for the purpose of removal of the stagnation to give opportunity of getting parity with the common entry counterparts and reaching higher levels of promotion to the officers joining at Inspector level. Accordingly, three models of pyramidal structure are submitted as below based on the DOPT guidelines in r/o residency periods and taking ratio of feeder to promotional post as 1.5:1 (in consonance of ratio existing in Group ‘A’) taking base figure of Inspectors as 45000 (direct+promotee) as discussed during the meeting of 31.07.14-

posts in consonance of DOPT OM No. AB-14017/61/2008-Estt.(RR) dt.24.03.09.
** Ratio of 31:1 for the posts of Commissioner is
based on the ratio between the strength of promotee and direct officers at
proposed Group ‘A’ levels.
3. Any of the above models, most preferably 3rd one, may be considered to frame the structure. It is further submitted that the functional structure may be framed based on the assesment pattern of CBDT where ITO and AC/DC report directly to the JC/ADC, ITO and AC/DC having different prescribed assessment powers. Like it, group system may be adopted in CBEC by granting different prescribed assessment/adjudication/rebate/refund powers to the Superintendent and AC/DC with the provisions of directly reporting to JC/ADC with the provisions of larger groups to be headed by JC/ADC. In addition to Audit, more and more Preventive/Anti-evasion groups may be created at Central, field and sub-field formations. If Ranges and Divisions are not replaced by groups, the Ranges may be headed by Superintendents & AC/DC’s in accordance of degree of assessment/revenue etc. and Divisions may be headed by the JC/ADC by making sufficient increase in the number of Ranges and Divisions. It is also worth to submit that the Audit/Preventive/Anti-evasion groups are also to be headed by Superintendents & AC/DC’s in accordance of degree of revenue etc. and larger/bigger groups may also be headed even by JC/ADC based on larger revenue accordingly. The system may be duly expanded in the forthcoming GST era. The group pattern may also be adopted in the Appeal and Adjudication etc. making groups based on the revenue involved to be headed by Superintendents & AC/DC’s and even by JC/ADC in case of larger groups. The cadre restructuring is also to be done after every 3 years on the lines of CSS. If compensation of the undone cadre restructuring is given, the number of posts mentioned in the above models will automatically be justified. The above models will also protect the stature of IRS.
4. A permanent feature is also required to be incorporated in the recruitment rules to grant the next grade to the officer on completion of 1½ times of qualifying service/residency period {as prescribed vide OM No. AB-14017/61/2008-Estt.(RR) dt.24.03.09 of DOPT} based on the precedent of CSS of promoting all Section Officers on completion of 1½ times of qualifying service sometimes in 1999 to the post of Under Secretary (a STS post), if he/she is unable to get the promotion within the residency period due to the want of the posts. This will also remove inter and intra-cadre disparities.
5. In view of the above, it is again requested to formulate a concrete scheme for Central Excise Group ‘B’ executive officers to grant them parity with the intra-organisational, intra-departmental as well as inter-departmental common entry counterparts enabling them to enter PB4 levels.
