Sub: Creation of separate service or organization specific
Flexible Complementing/Dynamic Assured Career Progression Scheme for Central
Excise Executive officers.
Sir,
With due regards, no need to submit
that the Central Excise Executive Officers are the worst hit category of govt.
employees in the matter of stagnation. They are retiring on a PB2 post with only single promotion in the
career after entry into Inspector grade, whereas their intraorganisational,
intradepartmental as well as interdepartmental counterparts are able to get 5
to 6 promotions easily attaining the PB4 levels. Even in their own organization
of CBEC, they are forced to work under their extreme juniors of Customs
belonging to the same cadre.

Further, we have no ill-feeling against any of our counterparts. Rather we wish
them to get even more number of promotions instead of 5 to 6. But we request
that we should also be granted the equal treatment, if not better than them. The Central Excise Superintendents perform the duties of
Executive Authority, Administrative Authority, Assessing Authority, Preventive Authority, Registration Granting Authority, Examining Authority, Quasi-Judicial Authority,
Summons issuing and Statements recording Authority (statement recorded by them is valid
evidence upto Supreme Court unlike by other counterparts), Controller of Drug Trafficking
& Smuggling, Accountant, Chemist, Chartered Accountant, Auditor, Advocate,
Judge, Engineer, Scientist, Technical Authority
etc. It is very well evident from their nature of job that they are doing very
specific and expert job for the govt. Due to the specific and expert job being
done by them, no officer from other departments is entitled to come to CBEC on
deputation as Central Excise Executive Officer due to lack of the wanted
expertise. The Central Excise Superintendents always achieve the revenue
targets above the set targets on account of their committed efforts. Despite of
it, they are forced to face the worst career prospects for last many decades
instead of any special treatment being given to them.

After noticing decades-long worst career prospects, the Cabinet Secretary was
pleased to recommend to the Cabinet to bring some specific scheme independent
of cadre restructuring to remove their extraordinarily acute stagnation and
improve their career prospects in actual terms. As a result, the Cabinet was
also pleased to approve the same and this Study Group was formed under your
goodself. No need to say that this scheme should be beneficial to all of the
Central Excise Executive Officers already facing “the total worst”. The MACPS
is also unable to give any solace to these poor officers as they get now after
30 years of service which they were able to get after 24 years of service under
ACPS.

An organization specific scheme for these officers is the demand of the time to
boost their morale in the interest of the govt. Revenue improving their career
prospects. This scheme may be devised in very specific manner to remove their
disparities in promotions in comparison to other counterparts without having
any linkage with the number of promotional vacancies/posts on the lines of Flexible
Complementing or Dynamic Assured Career Progression Scheme.
It should be devised not only to remove the intraorganisational and
intradepartmental disparities but also to remove interdepartmental disparities.
No need to say that intra-Central
Excise as well as intra-Customs disparities will also be removed automatically
by this.

Your kind attention is also invited to the recommendations made by the CBEC to
the VIth CPC for these ill-fated officers. The CBEC recommended the measures
like creation of separate service, time scale after every 7 years, promotion
directly to STS instead of JTS etc. to the VIth CPC for these officers vide F.No.A.26017/147
/06-Ad.II.A Dt. 04.01.07. Now, this is
the proper time to implement its own recommendations by CBEC to VIth CPC. The
draft RR’s on separate service have already been submitted to your goodself alongwith
the representation made during the very first meeting of the Study Group held
on 31.07.14. The same are again enclosed herewith, which is the only permanent
solution to the problem of stagnation of Central Excise Executive Officers.

As per
DOPT guidelines issued vide OM No.
AB-14017/61/2008-Estt.(RR) dt. 24.03.09, the qualifying services/residency periods have been prescribed as under
(i) 2 years for promotion to a post with
a grade pay of Rs. 4,800/- after joining in a grade pay of Rs. 4600/-.
(ii) 7 years for promotion to a post
with a grade pay of Rs. 6,600/- after joining in a grade pay of Rs. 4600/-.
(iii) 12 years for promotion to a post
with a grade pay of Rs. 7,600/- after joining in a grade pay of Rs. 4600/-.
(iv) 17 years for promotion to a post
with a grade pay of Rs. 8,700/- after joining in a grade pay of Rs. 4600/-.
(v) 20 years for promotion to a post
with a grade pay of Rs. 10,000/- after joining in a grade pay of Rs. 4600/- and
so on.
7. If functional promotions are not
possible within the above mentioned residency periods due to the want of the
required number of posts, the officers may be granted at least in-situ
promotions under an organization specific scheme like
Flexible Complementing or Dynamic Assured Career Progression Scheme without any
linkage with the number of vacancies/posts.
8. In view of the above, it
is requested to take immediate measures for Group ‘B’ Central Excise Executive
Officers-
i) To create a separate
service on the lines of enclosed draft with the provisions of direct promotion
to STS from Group ‘B’ gazetted level as was also recommended by CBEC to VIth
CPC and/or
ii) To formulate an organization
specific scheme like Flexible Complementing or
Dynamic Assured Career Progression Scheme without any linkage with the number
of promotional vacancies/posts to grant at least in-situ promotion on
completion of residency period in accordance of DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 and/or
iii) To devise a scheme to
grant the time scale after every 7 years after
entry into Inspector grade as also recommended by CBEC to VIth CPC.
