Sub: In rem implementation of the Subramaniam verdict as per
the order given by the Hon’ble Central Administrative Tribunal, Chandigarh
Bench.
Sir,
Kindly refer to
the earlier various communications of the Association regarding in rem
implementation of the Subramaniam verdict. Your kind attention is also invited
to the verdict given in OA No. 060/00541/2019 on 22.05.19 by the Hon’ble Central Administrative Tribunal,
Chandigarh Bench.
2. It is also to submit further with due regards that the
officers are forced to go to the legal courts in similar matter which has
already been finalized/settled by the High Court of Madras and Apex Court. But
unfortunately, the benefit of court verdicts is being given only to the
petitioners/applicants instead of implementing the order in rem.
3. Para 8 of the order given by the Hon’ble Chandigarh
CAT in the above AO is reproduced below-
“8. We
expect from the respondents to also examine the cases of other similarly placed
persons in the department to extend them the similar benefits, so that they
need not approach the Court of law to seek similar benefits, as have already
been granted to a specific category, otherwise this Court would be constrained
to take coercive measures against the respondents for willful disobedience of
the order of this Court.”
4. In view of the above,
it is requested that the due circular may kindly be issued at an early date to
implement the Subramaniam verdict in rem.
