by the Principal Bench of the Hon’ble Central Administrative Tribunal.
Sir,
Kindly
refer to the order given in OA No. 2806/2016
by the Principal Bench of the Hon’ble Central Administrative Tribunal.
2. It has been directed by the Hon’ble CAT to grant IInd
MACP upgradation in the Grade Pay of Rs. 5400/- in PB3 and IIIrd MACP
upgradation in the Grade Pay of Rs. 6600/- without offsetting the time scale/NFG
with MACP upgradation to those officers who are recruited as direct Inspector
and got time scale/NFG in the Grade Pay of Rs. 5400/- in PB2 prior to 01.09.08.
The IIIrd MACP upgradation is also to be granted in the Grade Pay of Rs. 5400/-
in PB3 to the similarly placed officers who got one promotion before becoming
Inspector. It is reiterated that the time scale/NFG is not to be considered an
upgradation under MACPS in these cases.

It has also been directed by the Hon’ble CAT to
grant the consequential
benefit and arrears of pay as may be due and payable to the officers. This exercise is to be completed within a period of three months from
the date of receipt of a certified copy of this order (order enclosed herewith).

It has further been directed
by the Hon’ble CAT to review the circular dated 20.06.2016 as a separate
exercise and re-issue after incorporating changes as are considered necessary
on the basis of the order given by the Hon’ble CAT.

In view of the above, it is
requested to do the needful at an early date.
It is also very much requested not to wait for three months to give the benefit
or reissue the circular. It is very necessary in the interest of our own
officers who are already looking towards your goodself with great hopes.
