Sub: Forcing officers to attend the office in violation of the MHA orders under lock down.
Sir,
            Your kind attention is also invited to some unwarranted directions being given to the officers to attend the office during lock down in Gandhinagar Commissionerate. Same thing is happening in Delhi in the Directorates like Anti-profiteering. Same situation is being faced by the officers in Lucknow Audit. There may be many more places where the officers may be facing the same situation.
            2. It is to submit with due regards that the govt. is very serious on the lock down and “total lock down” has again been extended till 03.05.20 to fight corona pandemic except essential services. Some additional relaxations are to be given w.e.f. 20.04.20 at the places barring containment zones. It is also worth to submit that the govt. has already declared 170 districts under the hotspot category.
3. Today on 15.04.20, our CBIC has also issued an order vide F.No. C.50/30/2020. Ad.II reiterating the MHA guidelines of today and ordering to follow these guidelines scrupulously. As per these guidelines, 100% officers of Deputy Secretary (our Joint Commissioner) and above have to attend the office w.e.f. 20.04.20 and others have to attend upto 33% as per the requirement provided the offices don’t fall under the containment zone.
4. Our officers are already engaged in the revenue augmentation work throughout the country by working from home and doing the work with full obedience. But it is not understandable why they are being forced to attend the office in violation of the MHA orders in the serious time of corona pandemic. It is also worth to mention that our officers may be exposed to the corona pandemic by it. All of our officers are also already attending the phone calls and social media messages from the trade as well as from higher authorities as part of the online outreach programmes initiated by the CBIC.
5. It is reiterated that the most of the Superintendents and promotee Group A officers are more than 50 years of age and underlying medical conditions like diabetes, hypertension etc. Exposing these vulnerable officers to the open may endanger their lives due to the pandemic and also their family members may get infected by them.
6. Our officers are already engaged in the official works from home including MSME involved in essential supply chain by attending various revenue related functions including GST registration, processing of refunds, online outreach and grievance redressal help desk for resolving tax payers’ queries during lock down so as to keep the wheels of economy moving in the present difficult time. The officers are not on leave but they are working from home using VPN facility specially given to them, so that they can use the GST network to facilitate the trade for the ease of doing business.
7. In view of the above, it is requested that all offices under the CBIC may kindly be very specifically directed to follow the MHA orders strictly and not to force the officers to attend the office in violation of the MHA orders not only to protect their lives and their family members’ lives from corona pandemic but also to save them from any penal action/punishment as mentioned in MHA orders.
