Sub: Salary cut or
leave deduction in lock down.
Sir,
It is to
submit with due regards that the HOD’s in the field formations have issued
directions to all the officers under their jurisdiction to compulsorily login
through VPN on back-end application of the CBIC during the
period of work from home in lock down failing which either they should submit
leave application or salary would be deducted considering such days if they could
not login on back-end application for a number of reasons. For example sake, copy of the order Dt. 30.04.20 of the Principal
Commissioner, GST, Noida is enclosed herwith for your kind reference.
2. It is
further to submit that the officers were ordered to work from
home due to lock down. It is not a choice of the officers to be locked down but
these are the orders of the govt. due to the wide spread
corona pandemic. In compliance of the orders of the Competent Authority,
the officers are working from home and giving their best provided the
situation is not out of their control.
3. The most
of the Group 'A' officers have been provided with enough infrastructure including
the lap-tops but officers below them have been provided no such
facilities and infrastructure. In spite of this, our member officers are login
through VPN on back-end application during work from home at their own cost and
efforts. Needless to submit that they are using their own appliances, electricity
connection, internet connection, telephone and mobile phone connection etc. for the
official work. There may be some difficulties with some officers, who either do
not have required infrastructure at their home or have not been provided VPN
access or facing some technical difficulties in login on back-end application.
It does not
mean that they do not intend to work from home, rather such
officers are attempting at their best to work from home with available
infrastructural facilities (like old or incompatible devices to
access VPN, non-availability of infrastructure, non-effective internet connection, improper
response from systems etc.) besides ensuring their availability all the times on phone in the
interest of the official work.
4. As per the
communications received from all corners of the country, our officers
are already working day and night from home even beyond office hours and also
on holidays to serve the Nation in this unprecedented time and channeling their
all energy and efforts not only to complete the official work but also
contributing a lot in combating with COVID-19 and also religiously following the
directions of lock-down issued by MHA, MoHFW, DOPT, State
Authorities /District Administration etc. Our member officers have made
all out efforts voluntarily to combat with COVID-19 by
contributing voluntarily in various ways with funds and also supporting to the
needy people of the far-end of the society by extending a helping hand to the
best of their means and measures. It has been greatly experienced by the officers that no
technical support by saksham-seva has been serving up to the satisfaction
level. Rather, it appears to have failed in such a need of hour to extend resolution
of technical glitches to our various officials in discharge of their
duties.

It is also not out of place to mention that the govt. never issued the order
for salary cut or leave deduction, if officers are not able to log-in due to the
circumstances totally out of their control. Rather, the govt. orders are
not to make any salary cut for even any non-working person. Neither MHA nor
DOPT
issued any order to make salary cut or leave deduction in the lock down period. Neither the
Department of Revenue nor the CBIC issued such an order.
6. It is,
therefore, requested to kindly look into the matter to issue necessary
directions to all the HOD’s concerned to consider all the officers as work
from home until and unless all the officers are provided all essential
infrastructural facilities at their home to login with back-end support
of technical team in case of need for application through VPN. No officer
may kindly be asked to submit leave application and no salary cut may kindly
be made for lock down period.
