Sir,
It is to submit with due regards that the Association was very much hopeful for the happening of DPC in the month of June, 2020 itself particularly after having the video conference on 10.06.20 by your goodself with all of the associations of the stake holders. All associations have already also submitted the consent letters in this regard.

2. But very
unfortunately, the DPC doesn’t seem to happen now even in the month of July,
2020 and many of our officers belonging to the Superintendent cadre would again
retire without promotion with no fault on their part despite of existing of
thousands of vacancies of Asstt. Commissioner in hand. Non-filling of the posts
of Asstt. Commissioner not only forcing our officers to retire without
promotion but the CBIC is also suffering from acute shortage of manpower at
Group ‘A’ entry level affecting the GST work badly and overburdening the
existing Group ‘A’ entry level officers by having multiple charges which may
affect the work efficiency of our CBIC very adversely.
3. The main
impediment in the way of the DPC is being understood the Himanshu Verma case
due to the apprehension of contempt. In this regard, it is worth to submit that
the Hon’ble CAT gave directions to prepare the revised seniority list within
three months in this case. It is worth to mention that it was noway linked with
the DPC. It means that the applicants may go for the contempt in the CAT for
the preparation of the seniority list only. It is also worth to mention that the
CBIC is already in the Hon’ble High Court on this issue. The matter being
pending in the High Court, there seems no chance of the contempt in this matter
at the level of CAT. However, we can’t rule out possibility of stay on DPC on
24th or 30th or any other day due to the ongoing
litigations.
4. In view of the above, it is requested to kindly
look into the matter to convene the DPC for the post of Asstt. Commissioner at
an early date not to retire our officers this month without promotion.
