Sir,

Kindly refer to the earlier representations of the Association on the subject matter including Ref. No. 23/AIB/P/22 Dt. 14.02.22.

 

2. It is submitted with due regards that the Association was given understanding on the DPC for the post of Asstt. Commissioner and the issuance of All India Seniority List of Central Excise Superintendents beyond 2006 that the same are pending due to the want of the order in Jarnail Singh case by the Hon’ble Supreme Court.

 

3. It is further submitted that the DOPT has already issued OM on this issue. It is also worth to mention that the All India Seniority List of Central Excise Superintendents was drafted upto 2011 years ago on the persuasion by the Association. But unfortunately, the said Seniority List is yet to be released and the seniority list for further years is also to be prepared.

 

4. The Association believes that there is no reason now which prevents our CBIC to release the Seniority List and to conduct the DPC for the post of Asstt. Commissioner particularly after OM issued by the DOPT. It is also worth to mention that the promotions of thousands of our officers to Group ‘A’ are held up due to the want of the Seniority List without any fault on their part. More than 2000 posts of Asstt. Commissioner are already lying vacant as on date. The vacant portion makes more than 50% of the sanction strength of the Asstt. Commissioners. We will have to feel the pain of the officers retiring without promotion despite of thousands of posts lying vacant. Your goodself and our Member (P&A) shall have to be serious and personal on the issue to take immediate steps.  

 

5. However, ad-hoc promotions may be affected based on the DOPT OM issued vide No. 38036/8/87-ESTT. (D) Dt. 30.03.88 in case of any seniority dispute, revision of seniority or court injunction. Even otherwise, there seems no hindrance in issuing the long pending seniority list particularly after the issuance of the relevant OM by the DOPT. Because the promotion orders are to be issued on ad hoc basis, it is not understood why we are so cautious and afraid of what to proceed in the matter. Even if we are afraid of any legal stay, the Hon’ble Supreme Court has already ordered that no stay can be prolonged and continue for more than 6 months if not specifically extended further.

           

 

 

6. It also seems that all of the litigants would also be promoted, if all of the vacancies of Asstt. Commissioner existing as on date are filled-up. The ad-hoc promotions may be reviewed later based on the court verdict/s.

           

7. In view of the above, it is requested that-

            i) The All India Seniority List of Central Excise Superintendents beyond 2006 may kindly be issued at the earliest.

ii) All vacancies of the Asstt. Commissioner existing as on date may kindly be filled immediately.
