Sir,
Kindly refer to the
letter F.No. CBIC-3/28/2022-Ad-IIIB Dt. 05.07.22 addressed to all Cadre
Controlling Authorities under CBIC on the subject of “Filling up of vacancies
in Mission Mode”.
2. It is
submitted with due regards that it is again unfortunate not to initiate such
mission by our CBIC to fill up the vacancies of Asstt. Commissioner despite of
the fact that we are working with less than 50% of the strength of Asstt.
Commissioner as on date. Due to working with such strength, not only the govt.
work is being suffered but the officers are also forced to work under
tremendous pressure due to looking after multiple charges. Thus, our
Superintendents and promotee Asstt. Commissioners are forced to tender
voluntary resignation on regular basis for the want of the said DPC and also
being worked under tremendous pressure due to acute shortage of working hands.
3. It seems that
the DPC for the post of Asstt. Commissioner is not on the agenda of our CBIC at
all because the same not being included either as agenda point for the workshop
of Cadre Controlling Authorities or part of the subject mentioned letter. Our
CBIC doesn’t seem serious about the issue because of which our Superintendents
are forced to retire without promotion on regular basis without any fault on
their part despite of the huge number of the posts of Asstt. Commissioner being
vacant. The DPCs for the last three consecutive years for the post of Asstt.
Commissioner are already pending.
4. It is also worth to mention that the promotions are
being affected by our CBIC for all other Group A posts on ad-hoc basis despite
of the seniority lists for the said promotions not being existed. The same
mechanism may also kindly be adopted to affect the promotions to the post of
Asstt. Commissioner. If any legal hurdle is there, the promotions may be
affected subject to the court verdicts or by resolving the legal hurdle. However,
because the promotions are to be affected on ad-hoc basis, the DPC may be
conducted as per the DOPT OM of 1988 in case of any court injunction or
seniority issue. The concerned authorities can’t and should not sit silently on
the issue.
5. In view of the above, it is requested that all vacancies of the Asstt.
Commissioner may also kindly be filled up in Mission mode treating the matter
as “Most Urgent” as being done to fill up the vacancies of Group B and C by the
CBIC.
