increase in voluntary retirements from service.
Sir,
It is submitted
with due regards that there is exponential increase in voluntary retirements from
service particularly from GST side. The figures of Mumbai GST zone showing the voluntary
retirements by our Superintendents are as follows-

2. Except Mumbai
Zone, there are 14 more zones of GST functioning under CBIC. Thus, the figures
will be fourteen times if all zones are taken into consideration. The number of
the voluntary retirements being taken by the Asstt. Commissioners of Central
Excise/CGST are also to be included in above figures who are taking retirement
every day on regular basis.
3. It shows that
there is some serious problem and the officers are not happy with their career under
CBIC. There is something seriously wrong in the Human Resource policies of CBIC
which is very well evident from the fact that our officers recruited as
Inspector are retiring after single promotion barring some temporary Asstt.
Commissioners with the clause of no further promotion in comparison to their
counterparts of Customs and CBDT already getting the promotions upto the level
of Addl. Commissioner and Commissioner. The saddest thing is that the CBIC
doesn’t seem serious at all to resolve the situation.

Non-serious approach of the CBIC is evident from the fact that the serious issues
like DPC for the post of Asstt. Commissioner and All India Seniority List of
Central Excise/CGST Superintendents were neither the part of the agenda of the
recent workshop of all Cadre Controlling Authorities on cadre
matters nor these were discussed there despite of the fact that the DPC for the
post of Asstt. Commissioner is not being held for the want of the seniority
list beyond 2006 and DPCs for at least last three years are long pending.
Promotions are being affected everywhere for every cadre but our
Superintendents are not only deprived of further promotions but the CBIC is
unable to resolve their pay matters including pay scales, pay arrears, MACP
issues, time scale etc. Not only it, they are forced to face the worst working
conditions. Despite of doing the same GST work (rather more by adding IGST),
their designation and pay scales are one step lower than the counterparts of
SGST. Not only it, our officers are also forced to work under their juniors
belonging to the same cadre.
5. Due to above reasons, GST days has nothing to celebrate for our
officers which was very well communicated to the concerned authorities on the
occasion of the very first celebration of the GST day despite of the fact that
they are actual instruments to always collect the record revenue for the CBIC. The
time of celebrations for our officers will only come when our CBIC will be
serious on Human Resource issues to remove all disparities with other
counterparts alongwith the counterparts of SGST. It seems that our CBIC is only
for, of and by Direct Recruit IRS officers. This impression is required to be removed
immediately. IRS Officers Association and IRS Ladies Association are listened
and given every facility despite of not being recognized and we are not being
listened on the pretext of being not recognized. So, it seems that our CBIC was/is
never meant for staffside.
6. If our CBIC authorities really want to give some moments of
celebrations to our Group B officers, it is submitted that the Human Resources policies
in r/o Group B officers require tremendous improvement. For the sake of such
improvement and for the sake of justice to our Group B officers, the concerned
authorities will have to be serious and honest. To repose the faith of our
officers, some instant measures are required to be taken as follows-
I. Implementation
of the in-situ promotion scheme from the date of its approval as approved in
CBIC Board meeting of 18.02.11 to promote the officer with 10 years of service
after joining as Inspector to the post of Superintendent, 20 years to the post
of Asstt. Commissioner and 25 years to the post of Deputy Commissioner.
II. Issuance of
the updated All India Seniority List of Central Excise/CGST Superintendents.
III. DPCs for
the post of Asstt. Commissioner.
IV. Promotion of
ad hoc Assistant Commissioners promoted against temporary posts to the post of
Deputy Commissioner on completion of 4 years of service and counting of
temporary service for the further promotions.
V. Upgradation
of posts and scales at par with the state governments under GST.
VI. In rem
implementation of the court verdicts.
VII. Merger of
Level 9 and 10.
VIII. Four years
time scale/NFG/NFS in PB3 instead of PB2.
Other following
issues also require the serious and honest redressal at the earliest-
A.
Pay scale to our officers at par with the
counterparts with arrears.
B.
Parity in
promotions with other counterparts.
C. Undoing of offset of time scale/NFG/NFS
with MACP upgradation.
D. Undoing of
para 8.1 of MACP Scheme.
E. Implementation of the decisions taken under
Employee Grievance Redressal Mechanism and the issues already recommended by
the CBIC.
F. Bringing a scheme for the Central Excise
executive officers to remove their stagnation independent of cadre
restructuring as approved by the Cabinet in the year 2013.
G. Scheme to benefit old as well young
generations as was promised by the CBIC.
H.
Bringing of scheme to grant at least five promotions in the career.
I.
Direct promotion of our Superintendent to the post of Deputy Commissioner as
the most of the Group B officers in Central as well as State governments are
being promoted to STS post.
J.
Introduction of specific Flexible Complementary/Dynamic Assured Career Promotion
Scheme on the lines of Ministry of Health and Department of Science.
K.
Batch to batch Non Functional
Financial Upgradation (NFU) to grant financial parity to our officers with the
best placed counterparts to compensate the lack of promotions.
L. Uniform promotional hierarchy across all
ministries/departments for all Group ‘B’ officers as promotional hierarchy
differs from department to department for group B officers.
