Came to know that AIASCT (All India Association of Superintendents of Central Tax) has filed a case in Delhi CAT challenging the seniority list of Central Excise/CGST Superintendents after issuance of the draft seniority list. If it is true, no doubt that it would hamper the DPC process for the post of Asstt. Commissioner for which thousands of our officers are waiting eagerly expecting rare IInd promotion of the career. If any stay is taken, nobody will be promoted and promotions will be stayed for long.
Not only it, such case may also hamper the ongoing cadre restructuring which is already under consideration with the DOPT. If 50% posts remain unfilled at Asstt. Commissioner level even on account of any legal stay, DOPT or any other concerned authority may take adverse view about the cadre restructuring or at least for the posts of Asstt. Commissioner meant for our promotion that CBIC can do without these posts as the same are unfilled for so long. So, they may ask CBIC to abolish the unfilled posts.
It was also appealed earlier not to hamper the said DPC. It is again appealed not to hamper promotions of our officers who are eagerly waiting for the same. No doubt that everybody has right for legal remedy for one's cause but the same should be fought in the manner that it doesn't harm others' promotions particularly on mass level. Our fight should be for the overall improvement of the career prospects instead of hampering it.
So, all concerned including AIASCT are again requested not to make any legal hindrance/stay in publication of final seniority list or conducting of DPC for the post of Asstt. Commissioner. The only request is not to get the things stayed/halted because we all know that the legal fight always go for very long and decades are taken to finalise the same. If so, it means that promotions would be hampered for decades and our officers would retire without promotion. Only request is to get the matter finalised on merits without taking any legal stay on promotions of others.
