As we all know, the draft All India Seniority List of Central Excise/CGST Superintendents has already been issued. The representations within a month have been sought to finalise it. The seniority being an individual matter, all concerned are requested to represent within prescribed period through proper channel. It is worth to mention that the seniority is actually first decided at local cadre control level. After it, it is forwarded to the the Board/HRD for reconciliation and final publication based on common guidelines/principles. So, we have not to forget to get our representations forwarded through concerned concerned cadre control authority in field formation. If direct representation is made, it will be sent back to concerned cadre controlling authority for comments. Only after the receipt of the comments from the concerned cadre control authority against such representations, the seniority list will be finalised based on common principles but such process will further delay the publication of the final seniority list.
All units and zonal office bearers are also requested to be vigil on the issue and make the members aware accordingly. We have also to be careful about the mention of the officers already voluntarily retired or unfortunately demised etc. The units have also to send the feedback on the points to be taken up by the All India Body alongwith getting the matter expedited with the concerned cadre controlling authority at local level to enable the earliest finalisation of the seniority list.
Members are also requested not to make any legal hindrance/stay in publication of final seniority list or conducting of DPC for the post of Asstt. Commissioner. No doubt that everyone has legal right to fight for individual cause but the only request is not to get the things stayed/halted because we all know that the legal fight has a very long way to finalise the matter. First CAT, then review in CAT. After it, High Court and review in it. Finally Supreme Court and review. After this fight, we don't know when the final verdict will be implemented. And at many times, we also have to fight for the contempt of the court to get the things implemented. In the meantime, huge number of our officers retire without any benefit. If legal fight is made even without getting a legal stay, the final legal order of the concerned court never changes. So, legal stay is never helpful to make any change in final legal order except delaying the things and having adverse effect on career prospects of our own colleagues waiting eagerly for rare IInd promotion of the career and retiring without it on account of legal stay.
The efforts are also being made for the seniority list for further years.
