Sir,
It is submitted with the utmost pain
that our officers were arrested by the police during discharge of official
duties on Imphal-Dimapur National Highway. However, they were granted bail by
the concerned court later. It is reiterated that this all happened during the
discharge of official duties by our officers and the police personnel hindered
govt. official work by their illegal action by going beyond their powers.
2. The Hon’ble court also took due
cognigence of the seriousness of the averment made by the counsel of our
officers that their arrest was made with a deliberate attempt to prevent our
officers from discharging their official duty. It is a very serious matter that
the concerned police personnel allowed the truck to move without check which
was suspected to carry contrabands. The police, instead of helping govt.
officials, helped the suspect to run away. By this act of police, their cozy
arrangements with the suspect under ulterior motive can’t be ruled out. The behavior
of the concerned police personnel towards our officers was also very
intimidating and high handed.
3. It is also worth to mention that
our poor officers are already forced to discharge their duties with full
dedication in National interest despite of getting the worst pay packages and
facing the worst career prospects and working conditions without having due
infrastructure. Already being worked under the worst circumstances, these poor
officers are also forced to face such ugly situations during discharge of their
official duties. So, due measures are required to be taken to provide the due
safeguards to them for discharging official duties and improve their working
conditions alongwith providing them due infrastructure and pay packages and
also improve their career prospects to boost their morale who are retiring with
single promotion in their whole career.
4. The Parliament of India has
enacted the CGST Act wherein State Police Officers, Railway Officers, Customs
Officers, Land Revenue Officers, Village Officers, SGST Officers have to
compulsorily assist the Central Tax Officers for implementation of the
provisions (including inspection of vehicles) of the CGST Act. Instead of
assisting our CGST officers, the Police Officers disrupted them in discharging
their official duties and helped the suspect to run away. The Show Cause Notices
should be issued to such erring Police Officers for violating the provisions of
section 72(1) and for imposing penalty upon them under section 122(3)(a) for
commission of offence of abetting in obstruction and preventing the CGST
officers in discharging their duties under the CGST Act. After issuance of the
Show Cause Notices, the same should be confirmed on priority and the confirmed
demand should be recovered under section 79 of the CGST Act from the police
officers. They may also be prosecuted under section 132 for committing offence
under section 132(1)(g) of the CGST Act and causing intentional hindrance in
discharge of govt. duties by the govt. officials. An ever remembering lesson
should be given to such miscreants.
5. In view of the above, it is
requested to kindly ensure personally that the stringent and exemplary action is
taken against the erring police officers for conniving with tax evaders under the
ulterior motive and due protection is also provided to our officers throughout
the country for discharge of their official duties.
