Sub: Promoting all the Superintendents who have completed 1.5 times of qualifying service on the lines of CSS.
 Madam,
Kindly refer to the minutes drawn against point No. 31 of the meeting held with your goodself on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of CBEC. It is submitted with due regards that the decision on this point has also unfortunately been deviated as usual merely to divert & dilute the issue in very tricky manner in the name of regularisation. No action has been taken on the issue till date despite of being agreed in the meeting of 15.03.12. Your goodself was also pleased to agree to it in the meetings of 02.11.12 and 31.01.13 but nothing has been done till date.
2. It is further submitted that the regularisation work has already been delayed tremendously particularly keeping in view that the CBEC asked the time only upto October, 12 from the Hon’ble Supreme Court to complete it. Our officers are retiring without promotion on regular basis due to the want of the said regularisation. Therefore, serious and immediate steps may kindly be taken to complete the regularisation work at its earliest.
3. If the officers completing 1.5 times of qualifying service can’t be promoted functionally due to any reason, they may kindly be promoted on in-situ basis for the time being on the lines of CSS where all the Section Officers (equivalent to our Superintendent) completing 1.5 times of qualifying service were promoted to the post of Under Secretary (equivalent to our Deputy Commissioner). In-situ promotions will also require no expenditure (as all of such Superintendents are already drawing a salary more than the Asstt. Commissioner with a grade pay of Rs. 5400/-) or creation of posts.
4. In view of the above, it is again requested that the serious steps may kindly be taken on the immediate basis to expedite the issue. It will give a bit solace to our officers (retiring without promotion) independent of cadre restructuring and bearing no Expenditure.

 Madam,
Kindly refer to the minutes drawn against point No. 32 of the meeting held with your goodself on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of CBEC. It is submitted with due regards that the decision on this point has also unfortunately been deviated as usual merely to divert & dilute the issue in very tricky manner referring Acts and recruitment rules. Your goodself was very well pleased to agree to the point in the meetings of 02.11.12 and 31.01.13 but nothing has been done till date except rejecting the issue in the minutes. It is really not understandable how the point has not been accepted in the minutes despite of being agreed in the meetings.
2. It is further submitted that the problem of defining change of official duties with the change of designation may be solved by granting the in-situ promotions for the time being. As far as the problem of requirement of 4 years of service as Asstt. Commissioner for the promotion to the post of Deputy Commissioner is concerned, the same may be solved by making the scheme effective with a retrospective date by 4 years.
3. Moreover, the problem may be solved in more pragmatic manner by granting the promotion to our group ‘B’ gazetted officers directly to the post of Deputy Commissioner based on the precedent of promoting the group ‘B’ gazetted officers directly to a STS post at many places in the Central government and at all places in State governments. Not only in CSS but also in Administrative Services, Police Services, Forest Services, Rajya Sabha Secretariat, Central Secretariat Stenographers Service (CSSS), Airforce Headquarters Service (AFHQ-Civil job), Engineering Services, Railway Services, Central Public Works Department (CPWD), State Services etc., the group ‘B’ gazetted officers are being directly promoted to a STS post and also given seniority benefit in group ‘A’ at many places in lieu of service rendered by them in group ‘B’. For example, State Service officers enter into IAS in a grade pay of Rs. 6600/- with 4 years of seniority benefit while the Central Excise Superintendents are unable to enter IRS in a grade pay of Rs. 5400/- even after serving for 35-40 years and retire at same level. 
4. It is also well pertinent to submit that 80% of the group ‘B’ gazetted officers have already been upgraded to group ‘A’ in Railways. The 80% of group ‘B’ gazetted officers of Indian Accounts & Audit stream were also upgraded to the grade of Rs. 8000-13500/-. In CBI and IB also, even all group ‘B’ gazetted officers (analogous counterparts of our Superintendents) were upgraded to group ‘A’ with the pay scale of Rs. 8000-13500/-. Even in the same Department of Revenue, all Chief Enforcement Officers (analogous counterparts of our Superintendents) were upgraded to the post of Asstt. Director with the pay scale of Rs. 8000-13500/-. So, there should not be any problem in upgrading our Superintendents to the higher posts.
5.  Moreover, the upgradation of the Superintendents already drawing the grade pay of Rs. 5400/- to the post of Asstt. Commissioner would be expenditure neutral. It will also have a negligible expenditure to upgrade the Superintendents already drawing the said grade pay for 4 years to the post of Deputy Commissioner because many of such officers are already drawing a grade pay of Rs. 6600/- on account of IIIrd MACP upgradation.
6. However as far as the Acts and recruitment rules are concerned as referred in the minutes, the same may also be changed on requirement, if the concerned authorities are really serious for us and have honest intention as well as will power.
7. It is also not out of place to mention that the CBEC has itself taken the following decisions in the Board meeting of 12.01.11-
i) to promote the Superintendents completing 20 years of service after joining as Inspector to the post of Asstt. Commissioner on in-situ basis and
ii) to promote the Superintendents completing 25 years of service after joining as Inspector to the post of Deputy Commissioner on in-situ basis.
8. In view of the above, it is again requested that the serious steps may kindly be taken on the immediate basis to expedite the issue. It will give a bit solace to our officers (retiring without promotion) independent of cadre restructuring and bearing no/minimal Expenditure.
