Sub: Minimisation of litigations
with staff.
Madam,
Kindly
refer to the minutes drawn against point No. 41 of the meeting held with your
goodself on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of
CBEC. Your
goodself was pleased to agree to the point in the meetings of 02.11.12 and
31.01.13 but there is no
change in the attitude of the administration.
2. There
are already the matters pending in the legal courts in r/o the issues like pay
scale, arrears of pay, parity in promotions, time scale in PB3 etc. on
account of inaction or anti-action of the administration. The staffside is
forced to approach the legal courts as none of the grievances is being
redressed due to the apathetic & non-serious attitude of the concerned
authorities. The judgements are not implemented despite of the verdict given by
the highest court. Rather, the matters are being contested against the
staffside. It is the sufficient evidence of the hostile attitude of the
administration towards the staff. Our officers have been retiring continuously
in PB2 while our counterparts are easily attaining the levels of PB4 but nobody
from the side of administration is bothered for us despite of the major portion
of government revenues being collected by us even above the target.
3. In view of the above, it is
requested that the staff grievances may kindly be redressed administratively
instead of forcing them to take legal recourse on each & every issue and
the favourable affidavits may also be filed in the legal courts, if the
administration really wants to help the staffside. It is very unfortunate that
our CBEC has an anti-staff image in each & every matter whereas all of
other organisations have pro-staff image.

Madam,
Kindly
refer to the minutes drawn against point No. 42 of the meeting held with your
goodself on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of
CBEC. Your
goodself was pleased to agree to the point in the meetings of 02.11.12 and
31.01.13 but there is no
change in the scenario.
2. The vigilance/disciplinary
matters are pending for years. As a result, the officers are being
punished without declaration of punishment. They are further being penalised on
finalisation of the cases despite of suffering for years on account of terribly
delayed proceedings in these matters. No prescribed time frame is being
followed in these cases. Our officers are also being made scapegoats on flimsy
& frivolous grounds. Long lists are prepared by figuring the names of our
officers. Their names have been figuring in the ODI, agreed etc. lists for
years, rather even for decades. As a result, they are continuously being placed
on non-sensitive seats vs tremendous mental agony. The delay in such matters is
posing great hardships before the concerned officers whether relating to
conducting of inquiry or taking decision on inquiry report or disposal of
appeal or any other vigilance/disciplinary matter. The decisions are not being
taken despite of the favourable reports in many of the cases.
3. In view of the above, it is
requested that all of such cases may kindly be disposed of within the
prescribed time-limit to protect the concerned officers from un-prescribed
sufferings.
