REMINDER
PL.
To,
Ms. Mamta Kundra,
Joint Secretary, Establishment,
DOPT, North Block, New Delhi.
Sub: Posting of Association functionaries.
Madam,
With due regards, your kind
attention is invited to the following DOPT communications-
i)
ID No. 16/18/2008-JCA Dt. 01.12.09,
ii)
OM No. 16/18/2008-JCA Dt. 03.09.12 &
iii)
F.No. 16/18/2008-JCA Dt. 17.04.13.
2. Your kind attention is also invited to the following
communications of the Association-
i) Ref. No.
11/Assn/12 Dt. 09.08.12,
ii) Ref. No. 16/Assn/12 Dt. 13.08.12,
iii) Ref. No. 21/Assn/12 Dt. 22.08.12,
iv) Ref. No. 32/Assn /12 Dt. 10.09.12,
v) Ref. No. 56/Assn/13 Dt. 11.04.13,
vi) Ref. No. 149/Assn/13 Dt. 07.06.13 etc.
3. It is submitted
with due regards that DOPT has very clearly clarified vide F.No.
16/18/2008-JCA Dt. 17.04.13 regarding transfer of the Association functionaries
sent to Sh. Ajit Gambhir, Director, Ad IV of CBEC-
“In
such of the Government departments/offices where a different practice is being
followed now, the existing practice, if not less favourable, may continue.”
The same thing has been clarified
vide ID No. 16/18/2008-JCA Dt. 01.12.09 and OM No.
16/18/2008-JCA Dt. 03.09.12 of the DOPT. But it is very unfortunate that
the DOPT guidelines/clarifications are not being followed in CBEC. The issue
was started with the transfer of the Association functionaries in Chandigarh
Zone of CBEC and is still continued.
4. Very recently, the General
Secretary of Association unit in
Tirunelveli Commissionerate, Sh. M. Rajaclimax, has been transferred to Madurai
Commissionerate where the Association already has its another unit with
different officer as General Secretary. No officer has been transferred without
request to Madurai Commissionerate from Tirunelveli Commissionerate in the
history. He has been transferred ignoring all the DOPT guidelines as he is
going to retire within 1 year and also the office bearers of one
Commissionerate were never practiced to be transferred to other
Commissionerates. DOPT guidelines also very specifically say that the
officer near retirement is not to be disturbed.
5. Likewise after the transfer of the General
Secretary of Tirunelveli, the President of Association unit in Daman/Vapi
Commissionerate, Sh. Thandilal Meena, has been transferred to Surat
Commissionerate where also the Association already has its another unit with
different officer as President. He has been transferred ignoring all the DOPT
guidelines as the office bearers of one Commissionerate were never practiced to
be transferred to other Commissionerates. His tenure as the President of Daman/Vapi
Unit is yet to be completed and it still remains for more than one year.
6.
This has jeopardised the Association activities in the said zones and deactivated the employee grievance
redressal mechanism due to the transfer of main office bearers to
outstations/another zones. Such office bearers of branch units of the
Association may kindly be allowed to get posted to either concerned headquarters
or under the jurisdictional area of the concerned zone/Commissionerate only to
make them available to the members of the concerned unit/branch.
7. In view of the above, it is
again requested that the due guidelines may kindly be issued to the CBEC to
grant due protection to the Association functionaries and they may also kindly
be retained in concerned Commissionerates at the headquarters of the units of
the Association. It has become the practice in CBEC field formations to
transfer the Association functionaries to outstations/other zones whenever they
stand to watch the interests of the members against wrong doings of the
administration.
Thanking you,
Yours faithfully,
(RAVI MALIK),
Secretary General.
