Kindly
refer to-
i)
the Ref. No. 99/H/13 Dt. 14.05.13 of the Association as well as
ii)
the letter F.No. MCEx/Misc/Coambatore (Zone)/2013 Dt. 24.05.13
of the Zonal Member of CBEC, Ms. J. M. Shanti Sundharam.
2. It is further submitted with due regards that Sh.
M. Rajaclimax, the General Secretary of Tirunelveli Unit of the Association, has been transferred to Madurai out of the
Tiruneveli Commissionerate vide Order No. 31/2013 dt. 03.05.2013. The transfer of Shri M.
Rajaclimax appears to be against the rules, instructions & policy of the
government as looked from all angles.
3. Shri M. Rajaclimax is
just having 11 months to retire and it is not the policy of the government to
transfer such officers to distant stations against their willingness. As
per DOPT guidelines, the government officers
near retirement should not be disturbed from existing station and be placed at their
desired station but the guidelines are not being followed in
his case.
4. So far, no officer has been transferred
from Tirunelveli to other Commissionerate except on requests. While so,
transfer of the General Secretary against his willingness doesn’t appear justified. The DOPT clarification ID No.
16/18/2008-JCA Dt. 01.12.09 as well as OM No.
16/18/2008-JCA Dt. 03.09.12 also says that the existing practice should
be continued in r/o of the transfer of the Association functionaries, if it is
not less favourable in comparison to the DOPT guidelines on the issue.
5. It has again been clarified/reiterated
latestly by the DOPT in this regard vide F.No. 16/18/2008-JCA Dt. 17.04.13
that, “In such of the Government departments/offices where a different practice
is being followed now, the existing practice, if not less favourable, may
continue.”

Shri Rajaclimax submitted a representation for cancellation of the subject
transfer and is on Earned Leaves awaiting favourable orders. It is hoped that
it might not be the intention of the government to make the officer exhaust his
precious Earned Leaves near retirement.

The Member, CBEC has also written to your goodself to reconsider the transfer
orders of Sh. Rajaclimax as per the existing practice and rules.

Madurai and Tirunelveli are two separate Commissionerates. Both Commissionerates
have separate Associations with separate General Secretaries. While so, transferring
the General Secretary of Tirunelveli to Madurai hardly makes out any reasoning.
9. If Mr. Rajaclimax had to
be transferred on ‘administrative reasons’, he could have been transferred to a
non-sensitive seat inside the Tirunelveli Commissionerate itself.

It has also been ascertained that the Assistant Commissioner of Tuticorin and
the Commissioner of Tirunelveli have not even whispered anything against his
retention in their report to the Chief Commissioner at the time of forwarding his
representation for retention.
11. It has also been learnt
that Shri M. Rajaclimax has been graded as “excellent” in all of his ACR’s for
recent years and the worthy Commissioner had also agreed to post him to
Preventive Unit expecting some good cases from him. Hence, the said ‘administrative
ground’ developed at the level of Chief Commissioner doesn’t seem to be sound
enough to warrant this transfer.
12. In view of the above, it is
again requested that Sh. Rajaclimax may kindly be retained at Tuticorin itself under
the jurisdiction of Tirunelveli
Commissionerate by cancelling
his transfer orders in larger interest.
