Commissionerates.
Sir,
As the Association came to
know, it is submitted with due regards that the overall number of the
Commissionerates in r/o cadre restructuring is going to be reduced by
subtracting or adding at some places at this stage after the final approval and
notification of the cadre restructuring. It is further submitted that the
number of posts may also require reduction by this on account of overall
revamping of the process despite of the approval upto the level of Cabinet.
This deviation after the approval from Cabinet, Cadre Review Committee, Finance
Minister, CBEC and other nodal departments on the basis of the reports of Study
Groups may be looked as the misrepresentation of the actual facts and may also
delay the implementation of the Cadre Restructuring.
2. This
process of reduction of the Commissionerates at this stage seems unjustified
& unwarranted because there is no negative change in the factors like workload,
revenue etc., rather these factors are on regular increase. The Board
constituted well in advance the Study Groups as part of the Cadre Restructuring
and assigned them the exercise of reorganisation of different Zones and
Commissionerates by way of examining the detailed revenue & workload of the
field formations, legislative changes of the statute, staffing norms etc. among
others. The Study Groups after a detailed examination suggested the
reorganisation of all Zones and Commissionerates corroborated with due
statistics. The proposals were duly approved by the appropriate authorities. Thus,
any change at this stage seems unwarranted and will merely give an unwanted
impression to the concerned higher authorities about us. We are merely
challenging the caliber of our former authorities including Study Groups and
field formations by making any reduction/amendment at this stage particularly
when there is no reduction in workload and revenue.
3. The various Committees in relation of Cadre Restructuring should
have been constituted with the intention to facilitate the smooth
implementation of the already approved Cadre Restructuring by the highest
authorities instead of making any amendment at this stage. The re-examination
of the studies regarding workload, revenue & other aspects will only negate
& annul the already accepted reports of the Study Groups threatening the finally
approved entire Cadre Restructuring which has been approved based on the
findings of these Study Groups. Such re-examination will reopen the process of
Cadre Restructuring, delay its implementation and our officers will keep
retiring without promotion. As a consequence, the efforts to reduce the number
of originally proposed Commissionerates may de-motivate our workforce particularly
at the places to be affected by this reduction. The proposed reduction in
contrary to their bonafide belief has already evoked strong reaction from the staffside
throughout the country.
4. If number of Commissionerates is reduced in
any Zone, not only the promotional avenues for Inspectors, Ministerial Officers
etc. will be reduced there as a result but the number of postings for group A
officers (promotee as well as direct) of that Zone would also be reduced and
they will have to be transferred to other Zones. This will pose great hardships
particularly before the promotee officers being promoted at the fag end of the
career. No need to submit that our Superintendents would be the worst affected
by this on account of being promoted to the post of Asstt. Commissioner at
the age group very vulnerable to various
old age diseases & deformities. Neither they will be
able to live alone at new place leaving their family at old place nor be able
to make new settlement at the new place near retirement.
5. As your goodself knows, the Cabinet approved
119 Commissionerates for Central Excise, 22 for Service Tax, 45 for Audit and
60 for Customs. Any deviation/reduction from the approval of Cabinet may not
please the higher authorities upto the level of Cabinet which may be disastrous
for our organisation and against our future interests. The Commissionerates
need to be created on the basis of workload, revenue etc. at each place under
the respective Zone as per the norms fixed by the IInd Study Group instead of
making any overall or intra-zonal change in the number. But contrary to it, the
Commissionerates are also being created at the places with revenue &
workload less than even the prescribed norms while not being created despite of
many times more revenue & workload at many places. For example, Raipur
Commissionerate deserves not only to be at least tri-furcated but one Audit
Commissionerate should also be created there alongwith in accordance of the
revenue & workload. Not only it, the Customs
formations to be created under the jurisdiction of Central Excise Zones should
also be manned by the Central Excise personnel only as per the existing system
and long well-established practice at all places including Ahmedabad,
Bangalore, Delhi, Kolkata, Chennai, Mumbai, Patna-Ranchi-Jamshedpur,
Thiruchirapalli, Guntur, Visakhapatnam, Shillong, Goa, Lucknow, Cochin, Pune,
Vadodara etc. Zones/Commissionerates.
6. In view of the above, it is requested that-
i) No reduction may kindly be made
in the number of Commissionerates in any Zone in comparison to original
proposal.
ii) The Commissionerates may kindly
be created in the Zones based on the revenue & workload.
iii) The Customs formations to be
created under the jurisdiction of Central Excise Zones may kindly be manned by
Central Excise personnel.
