Namaste.
1. I am getting
regular calls about the next DPC for the post of AC. Regarding it as already
intimated, a review DPC will be conducted very soon. It was expected on
29.05.15 which couldn’t happen due to one reason or another. It is, however,
expected now to happen any time. After it, the DPC for the year 2014-15 is
expected to be conducted soon. The matter is being pursued with the concerned
authorities on regular basis. And after the DPC of 2014-15, the DPC for 2015-16
is also being pursued to be conducted at the earliest.
2. I am also
getting the calls regarding the status of the transfer orders to be issued for
Asstt. Commissioners. Status is that it is already under process and file had
been sent to MOS as per the information gathered.
3. All of the units are requested
once again not only to clear the dues but also donate maximum funds to the
Association.
4. The minutes
of the Associate Committee meeting held on 11.04.15 at Delhi are also attached
herewith.

MINUTES OF THE ASSOCIATE COMMITTEE MEETING
HELD ON 11.04.2015 AT C. R. BUILDING,
NEW DELHI
The Associate Committee meeting of
the AIACEGEO was held on 11.04.2015 at C. R. Building, New Delhi. First of all Shri R. Chandramauli, President
of the Association, welcomed all the delegates. After preliminary introduction
of all the office bearers, he requested to the Secretary General to apprise the
members regarding the agenda points already circulated to them.
Shri
Ravi Malik, Secretary General, welcomed all the delegates and made note
about the zonal office bearers who were absent. Sh. Rameshbabu, the former
President of the Association, was also pleased to come to the meeting with Sh.
Nagaraju. The SG gave the warm and heartiest welcome to him. He
informed the delegates about the non-conducting of the already badly delayed
DPC for the year 2014-15 and 2015-16 (due in the month of January-2015 and
January-2016 respectively), which is being pursued by the Association and expected
to be conducted in the month of May or June, 2015. Review DPC is expected be
conducted in the month of April or May, 2015 in respect of already promoted,
deceased etc. officers. He added that the DPC even for the year 2013-14 was
conducted in incomplete manner keeping around 200 vacancies unfilled. He said
that the unfilled vacancies existing at higher levels for the want of qualified
candidates should also be downgraded to promote our officers under FR 254 till
qualified candidates are available at higher levels. He further informed that the
Association had met the Cabinet Secretary 5 or 6 times for removal of the
stagnation in our cadre and the Cabinet Secretary was pleased to recommend to
the Cabinet to bring some scheme independent of cadre restructuring to remove
the stagnation of our officers. The Cabinet also accorded its approval to the
said proposal. The Cabinet Secretary was also suggested to bring the scheme of
NFU (Non-functional Financial Upgradation) for us at par with the best placed
group ‘B’ counterparts like CSS etc. on the lines of grant of NFU to group ‘A’
counterparts of IAS, if promotions can’t be given in time. He forwarded the
representation of the Association to the Revenue Department. As per the efforts
of the Association, the file was sent to DOPT by the CBEC but it was returned
with remarks that it is available to group ‘A’ officers only. Now, the same has
been referred to the 7th Pay Commission. The Secretary General
further added that our Memorandum meant for the CPC has also been forwarded to
CPC by the CBEC. He also said that the grant of the grade pay of Rs. 6600/- on
completion of 30 years of service under MACP upgradation is under active
consideration in DOPT and expectedly should be approved.
It was
also briefed by the SG that the B. B. Agrawal Committee report has been
submitted to Member (P&V). The representation to Parthasarathi Some
Committee has also been submitted by the Association about the poor prospects
of the cadre. He also narrated his meeting with the CPC twice on behalf of the
Promotee IRS Association which is the extension of All India Association of
Central Excise Gazetted Executive Officers. Whatever be the result but the
Commission agreed principally to consider the following in the Bombay meeting-
i) Direct
promotion of all Group B gazetted officers including us to STS post.
ii)
Uniform promotional hierarchy for Group B officers everywhere.
iii)
Removal of MACP anomalies.
In the
Jodhpur meeting, the Commission agreed to consider one rank, one pension for our
officers too.
Shri
Malik also informed that various cases regarding the pay matters are pending in
different courts, i.e., Jabalpur High Court, Cuttuck CAT and Principal Bench of
CAT in New Delhi challenging the pay scale & arrears, MACP scheme and RRs.
He informed that in the MACP case the rejoinder has been filed by the
Association and awaited for final hearing/verdict from the Court. He added that
some more cases may be required to be filed in the legal courts in the interest
of the cadre. He requested the delegates to ask the respective units to collect
maximum funds for legal fight as senior advocates are to be hired for every
case in the time of today who always charge hefty fees per hearing.
With reference to pay revision case
(since 1986) pending in Jabalpur High Court, the main applicant Shri Srinivas, Superintendent
of Nagpur (the then Secretary General of Inspectors Association) is being tried
to be contacted for the want of filing of rejoinder but no response is being
received as the rejoinder couldn’t be filed till last hearing. The matter is
also being pursued with the individual applicant Sh. K. P. Rai from Bhopal.
Shri Sasmal, General Secretary of Mumbai Unit, showed his willingness to
contact Sri Srinivas and, accordingly, he was requested to pursue the matter with
Shri Sriniwas.
The
Secretary General also informed the delegates regarding the expected
implementation of GST in the year 2016 that the Central Government is planning
to handover the units having upto Rs. 1.5 crore turnover to State Governments
which is not in the favour of our career prospects. He opined that the units
with only upto Rs. 8 to 10 lac should be given to the states. His opinion was
agreed by the house.
Sh. S.
Bhattachariya, one of the Joint Secretaries from East Zone, handed over a write
up on behalf of the Kolkata Unit on GST and Bombay Unit also volunteered to
give a detailed note to AIACEGEO within ten days on it. This hand out of
Kolkata Unit also had the issues of stepping of
pay of seniors at par with juniors getting higher pay on account of ACP/MACP
upgradation and withdrawal of one MACP benefit by Board. Sh. Bhattachariya
was requested to send the soft copy also on the mail.
The SG also informed the delegates
that the matter has already been taken up with the CBEC to provide the proper
infrastructure for the field formations, i.e., entitled sitting space, basic
amenities, entitled facilities etc. The Board has assured that the matter is
under consideration and will be sorted out soon. He further added that the
Association was successful to get the required letter written to the field
formations in this regard well in advance even before the issuance of the cadre
restructuring notification.
The
S.G. also requested the delegates to take up with the respective units of their
zones to submit the DDO certificates for renewal of recognition, clear the
subscription dues and donate maximum funds for smooth functioning of the
Association. Guntur
Unit gave funds worth Rs. 50,000/- to All India Body on the spot. Mumbai Unit
cleared the dues to the tune of Rs. One lac and promised to clear the remaining
dues very soon. Kanpur Unit also gave Rs. 10,000/-. Kolkata Unit cleared all
dues upto 2014-15. All were again requested to donate the maximum funds to the
Association particularly for legal cases. SG said that the subscription dues
since October, 14 were ideally required to be cleared based on the new
sanctioned strength as per the cadre restructuring. Accordingly, the
subscription due from the year 2015-16 are to be cleared based on the new
sanctioned strength. House was also unanimously agreed to it.
The
proposal of IRS Association to have a get-together with the Board authorities
alongwith CSS officials in our union was also placed before the house. It was
unanimously agreed. Delhi, Mumbai and Raipur Units volunteered to help the AIB
financially on the issue. Mumbai Unit proposed to bear all the expenses, if
this gathering is had in Mumbai. Mumbai unit also volunteered to help
financially in various legal cases. Delegates from Delhi informed that Delhi
Unit has already been giving financial help in legal matters.

also asked the delegates to suggest the steps to be taken to achieve our goals.
He added that the CBEC always achieved the revenue above targets due to hard,
dedicated, committed and sincere efforts of our officers but seems indifferent
to redress our grievances. On the issue of any agitational measures to be
taken, the Chief Executive was authorized to take required measures in this
regard. It was said
by the SG that the agitational measures may be taken like gathering before the
residences of the authorities on holidays, if our grievances are not redressed.
Keeping in view the law and order problem, the copy of the notice will
also be served to police authorities.
Shri Ashish Vajpeyi, one of the
Joint Secretaries from North Zone and General Secretary of Kanpur Unit,
suggested that DPC for the missing/death/VRS etc. cases should be conducted
immediately.
Shri M. K. Mishra, one of the Joint
Secretaries from West Zone, suggested that advance panel should be prepared at
the time of DPC. He also informed that Pay Commission do not have any term
& conditions to remove the earlier anomalies whereas DOPT is forwarding all
such matters to the Pay Commission which appears to be eyewash only. Such matters
should be taken at any platform of law or grievance redressal mechanism. He
also suggested that every Range should be allotted Rs. 1 lac for infrastructure
etc. as earlier being done under 1% scheme. Secretary General said that it
should be at least Rs. 5 lac in the expensive time of today and was also agreed
by the house. Secretary General
requested Shri A. K. Sasmal and Shri V. N. Jha to prepare a note on the issue
of infrastructure.
Shri A. K. Sasmal, General Secretary
of Mumbai Unit, suggested that DPC should be conducted before AGT, 2015.
Shri V. N. Jha from Patna suggested
that the date of implementation of CR, i.e., 15.10.2014 should be the criterion
for counting of 5 years for temporary posts of AC instead of 18th December,
2013. He also suggested to contact the current Chairman of the CBEC to redress
our grievances on account of revenue targets being achieved by us as per the
appeal of the Chairman in his very first meeting with the Association.
Shri
J. D. Patil, one of the Joint Secretaries from West Zone, informed that there
is a Grade Pay difference merely of Rs.200/- for promotion from Inspector to Superintendent
cadre whereas in the case of IRS & LDC it is much higher. He also
raised the point of some confusion relating the post of call of Parliament March
on 28th April by Central Govt Employees Federation on the blogspot
of the Association but was satisfied after the reply from the Dias.
SG said that the space being
utilized by us was given to group ‘A’ officers in the last cadre restructuring
and we are facing the shortage of office space till now since then. This time
also, same process has been started. It was informed by some delegates that
funds were allocated to the Commissionerates but the same was not completely
utilized in some cases and the major amount was forced to be surrendered. It
was unanimously resolved that local units should be involved while planning for
infrastructure and a letter should be written to the Board to issue directions
to the field formations in this regard. It was also
stressed that the local units should play active role in finding new offices
and sending the correct proposal for the same to avoid any query from the Board
office/HRD.
Some delegates suggested that Govt
agencies such as LIC/BSNL/MTNL in Mumbai, Chennai, Kolkata and other cities are
having spare space for offices and offering for rent. Therefore, our department
should take on rent such buildings liberally.
Sh.
N. Raman, one of the Vice-Presidents from South Zone, also suggested that we
should also participate in March to Parliament on 28th April, 2015
being held by the Central Government Employees Federation. It was decided to
hold lunch hour demonstration on 28th April for common cause of the
cadre and to give letter to the administration to support Central Government
Employees Federation.
Shri
L. L. Singhvi, one of the Vice-Presidents from Central Zone and President of
Indore Zone, informed that only those Superintendents are being posted on
deputation in SEZs who are getting GP of
Rs. 4800/- and not those getting GP of Rs. 5400/-. SG requested Shri Singhvi to send the details
on mail to SG/President so that issue can be take up at proper forum. Shri
Singhvi further informed that proposal of shifting of Gwaliar Commissionerate
HQ to Ujjain has been forwarded to CBEC after proper recommendations with
reasoning from the local Industrial Associations, local MP and the local staff
associations. He requested the SG to write a letter to Board in this regard. SG
requested him to send the soft copy of this issue also.
S/Sh. M. K. Mishra, J. D. Patil and
A. K. Sasmal were asked about the details of the cases filed by them in the
legal court regarding intra-Central Excise regional disparity and Parmar case.
They were requested to provide the copies of the petitions. S/Sh. M. K. Mishra
and J. D. Patil were asked whether they became the applicants as the all India
office bearers or otherwise. They replied that they had become the applicants
as individual. They were advised not to become the applicant even as individuals
on these all India issues because of bearing the posts of all India office
bearers. The delegates belonging to West Zone were, therefore, requested to
replace these officers by some other officers as all India office bearers.
Sh. Anand Kishore, one of the Joint
Secretaries from Central Zone and General Secretary of Raipur Unit, suggested
that the DPCs for the post of AC should be conducted regularly at prescribed
time without any delay. He also raised the point of changing of Bilaspur
Commissionerate to Raipur II. He was requested to get the proposal forwarded by
the local administration and also send the soft copy.
Sh.
Nagaraju raised the issue of the reservation at the time of promotion from Group
B to Group A. He was informed that the Board has already kept around 200
vacancies unfilled based on Chandigarh CAT judgement vs. DOPT advice. Rest of
the posts may be compensated from the share of 2014-15 and 2015-16 DPC.
The Mumbai, Kolkatta and Indore
units had to leave the meeting a bit early as per their journey schedule.
Shri R. K. Solanki, one of the Joint
Secretaries from North Zone, raised the issue of latest amendment in All India Seniority
List of Superintendents of Central Excise referring review DPCs in Mumbai Zone
and some other Zones after a gap of approximate 30 years due to which many
officers of the referred zones have been placed above other senior officers
belonging to other zones. The delegates belonging to various units, i.e.,
Chandigarh, Raipur, Chennai, Kanpur, Pune, Patna, Guntur, Daman, Kolkata, Delhi
etc. present in the meeting unanimously decided that the AIB should immediately
write a letter to the Board and HRD for restoring the earlier seniority list
and look into the matter afresh. The house agreed to it. Sh. J. D. Patil was
asked to clarify the issue but he showed his total unawareness on it. Sh.
Solanki informed him that his (Sh. J. D. Patil’s) own name has also been
upgraded in the seniority list. Sh. J. D. Patil clarified that the issue was
being taken-up with the administration but was not aware of upgradation of his
name in the list.
The President on behalf of the
Chennai Unit suggested that all the pending vigilance cases are to be taken up
with the appropriate authority for disposal in a time bound manner.
Sh. Anurag Chaudhary, one of the
Vice-Presidents of North Zone and President of Chandigarh Unit, alongwith other
delegates (Sh. Bhagwan Singh, General Secretary and Sh. Sanjeev Sharma,
Executive member) from the said unit raised the issue of the transfer &
posting in the Chandigarh Zone whether the same is to be filed in the legal
court or take up administratively. The house decided to take up the matter
administratively as the court verdict can never be predicted because it can go
even against us closing all the doors of relief.
All of the delegates were requested
to supply the soft copy of the resolutions brought by them on behalf of the
units of their zones enabling the AIB to use the same under ‘copy-paste’
process at the time of making representation to the concerned authority.
