Keeping in view that the CBEC is terribly behind in the matter of DPC for promotion to the post of Asstt. Commissioner and our officers belonging to reserved as well as general category are retiring regularly without promotion, a combined representation was prepared and sent to SC/ST Employees Federation as well as General Category Candidates Association for signature. The representation is attached herewith which is self explanatory. No need to say that our 600 officers have retired without promotion since October, 2014 (200 from reserved category and 400 from general category). General Category Candidates Association has agreed to sign it but the final response of our SC/ST Employees Federation is still awaited. It is also worth to mention that their interim response is not promoting. Such efforts were also made during the pendency of case on reservation in promotion between our SC/ST and general category officers but the response was same.
No need also to say that 2½ years have already expired after creation of 2118 posts of Asstt. Commissioner meant only for promotion. Next 2½ years will also expire and these posts will be lapsed resulting no promotion for our officers whether belonging to reserved category or general category, if the existing situation is continued. So, all are requested to make our SC/ST Employees Federation to agree to sign the representation in the interest of both categories.

Sir,
It
is submitted with due regards that there is no legal stay for the promotion to
the post of Asstt. Commissioner as on date. The stay ordered by the Principal
Bench of Central Administrative Tribunal has already been vacated on 03.06.16.
2. It is further submitted that our officers belonging to
both categories (i.e., reserved and general) have been retiring regularly after
October, 2014 without promotion despite of thousands of promotional posts being
in hand. No need to say that CBEC is already behind by three years in
conducting the DPC for promotion to the post of Asstt. Commissioner.
3. As far as the amendment/framing/review of RRs is
concerned, the para 3.1 of the DOPT OM No. 22011/5/86-Estt. (D) Dt.
10.04.89 says that the holding
of DPC meetings need not be delayed or postponed on the ground that RRs for a
post are being reviewed/amended/framed.
4. It is also worth to mention that 2118 temporary posts
of Asstt. Commissioner were created only for 5 years w.e.f. 18.12.13 to be
filled by promotions, out of which around 2½ years have already expired.
5. In view of the above, it is requested to conduct immediate
DPC for the post of Asstt. Commissioner for the years 2014-15, 2015-16 &
2016-17 to grant immediate promotion to our officers.
