Need to do something concrete for the officers joining the job as Central
Excise Inspector.
Madam,
Kindly refer to the letter Ref. No.
15/AIB/C/17 Dt. 30.06.17 of the Association.
2. It is
submitted with due regards in continuation of the above referred letter of the
Association that CBEC is under the process of taking continuous relaxations in the
residency periods for promotion of group A officers. No need to say
that this process would benefit the direct recruit group A officers a lot who
are already getting four promotions within a period of 17-20 years reaching the
post of Commissioner after joining at the level of Asstt. Commissioner. But
very unfortunately, nothing is being done for the officers joining the job as
Inspector despite of the assurance given by your goodself as well as the recommendations
of the Cabinet. The weekly news letters of your goodself are also silent on the
issue. These poor officers very much expect something from you to have a
feeling of job-satisfaction, which in turn may increase the efficiency of CBIC
in multifold manner under GST era.

No need to submit that the actual work-force of the CBEC/CBIC is the
Superintendents and Inspectors. Functionally being the
backbone of CBEC/CBIC, whole of the work of our organization is actually
done by them
including
drafting
of the Show Cause Notices, Adjudication Orders etc. and processing of the
refund & rebate applications. But it is really unfortunate that the most
vibrant cadre of the CBEC/CBIC is always treated with utter disdain.
4. It was
accepted by the
CBEC
in
the cadre restructuring proposal that the officers
joining the department as Central Excise Inspector are the most stagnated ones. Despite of
this accepted fact, nothing has ever been done for Central Excise
Superintendents and Inspectors. Keeping in view their extraordinarily acute stagnation, the Cabinet
recommended to bring specific scheme to remove the stagnation of these poor and
highly obedient & committed officers but nothing has been done till date
even after the expiry of more than 3½ years. Under cadre restructuring, a number of
new cadres like
Principal Commissioner and Principal Chief Commissioner were created
without any functional justification and only with the intent to benefit the
direct recruit group A officers. Nobody bothered to address the original issue of the stagnation
at the level of Inspectors and Superintendents. It is reiterated that a
Central Excise Inspector does not get the second promotion even in 35 or
more years of service.
5. No positive
step has
been taken
to mitigate the miseries of this struggling and under privileged cadre of Central
Excise Inspector/Superintendent. Despite of it, they are also abused and insulted by using
the wordings like “Inspector Raj” for them which further salts their wounds. It is
really not understood where “Inspector Raj” exists or whose “Raj” is actually
this under which these poor officers are deprived of the due pay matters,
promotional avenues and working conditions.
6. No need
to say that time has come to boost the morale of these poor officers by
granting them full degree of job-satisfaction. The CBEC
itself recommended to the VIth CPC to grant time scale to these officers after
every 7 years but that proved merely an eye-wash as none of the authorities
bothered to pursue the matter in actual term. This scheme would have given a
solace to these poor officers, if some actual & serious interest was taken
by our own authorities.
7. A scheme
of NFU at par with the counterparts of CSS was also recommended to DOPT, VIIth
CPC as well as Revenue Department but the same was also proved to be an
eye-wash due to the lack of will-power and interest in our own authorities to
get it finalized.
8. Whenever
any benefit is not to be given to us, it is denied saying that the committee or
commission has not recommended it. On another hand, benefits are also not given
to us despite of the recommendations of the commission or committee. The VIth
CPC made some favourable recommendations for us under para 7.15.24 which has
not been implemented till date only due to the pleasure of a lower level
authority of Expenditure despite of being approved by the competent authority.
HPC and Expenditure admitted the parity of our Superintendent with the DSP of
CBI but the pay scale of later category has never been granted to our
Superintendents despite of performing more hazardous & arduous duties than
the counterparts of CBI and regular increase in our responsibilities. Moreover,
the DSP of CBI was granted higher pay scale and status without the
recommendations of any CPC and based only on the simple recommendation of their
department without any increase in their responsibilities. It is really not
understandable why our department is unable to have any benefit for us whereas
other departments are very instrumental to give benefit to their employees.
9. One in-situ
promotion scheme was duly approved by the CBEC to grant in-situ promotion to
our officers to the post of Asstt. Commissioner on completion of 20 years and
Deputy Commissioner on completion 25 years of service after joining at the
level of Inspector but the implementation of the same is still awaited. Other
departments like Science & Technology and Health are able to bring
department-specific schemes to remove the stagnation of their employees in the
form of Flexible Promotion Scheme and Dynamic Assured Career Progression Scheme
but such department-specific scheme is missing in our CBEC/CBIC for our
officers despite of the recommendations of the Cabinet. Under GST, the states
have changed the promotional hierarchy of their employees but our CBEC/CBIS is
totally silent. This change by Andhra Pradesh state has already been
communicated to your goodself by above referred letter Ref. No. 15/AIB/C/17 Dt. 30.06.17 of the
Association. The change by the Rajasthan state is also enclosed herewith, in
which also the post of state CTO has been upgraded as Asstt. Commissioner. It
is really not understandable why such changes can’t be made in our CBIC. Due to
this reason, we’ll also be forced to have a degraded status in comparison to
the state employees under GST.
10. No need
to say that the officers joining as the Central Excise Inspector are the most formidable
work-force
of
CBIC. The
work carried out by them is the most critical and highly responsible.
Nothing will be achieved to CBIC, if the main work-force is unhappy, de-motivated and job-dissatisfied. Your
goodself
can
also not be
happy with this reality. It is the real time to look into the mismanagement
of the cadres in CBEC/CBIC as the
GST
era needs highly motivated Inspectors and Superintendents, the
largest cadre of CBIC. No need to say that no authority can be delighted
when
the
most efficient work force of the CBEC/CBIC is totally de-motivated and job-dissatisfied due to the mismanagement
of the cadre.
11. In view
of the above, it is requested to kindly have a serious look into
the issue to
rectify
dismal state
of mismanagement
of human
resource planning in CBEC/CBIC at least to grant parity to our officers with
their counterparts (if not better than them) ensuring promotion/upgradation at
least after every 7 years. Your goodself is again reminded of your intention and
assurance to bring a specific scheme to benefit the already stagnated officers
as well as new generation of the work-force of the officers joining as Central
Excise Inspector to spread the feeling of motivation and job-satisfaction across the entire
cadre.
A happy,
satisfied and motivated work-force will really give the more than desired results
under GST.
